Un exploitant occupait un local au sein d&#8217;un camping depuis 2007, chaque ann\u00e9e, sous le couvert de contrats successifs intitul\u00e9s <em>&#8221; convention d&#8217;occupation pr\u00e9caire &#8220;<\/em> puis <em>&#8221; contrat de sous-location saisonni\u00e8re &#8220;<\/em> en 2019. Apr\u00e8s un commandement de quitter les lieux, l&#8217;occupant a assign\u00e9 la soci\u00e9t\u00e9 exploitante du camping en requalification de la relation contractuelle en bail commercial. Le tribunal judiciaire de B\u00e9ziers a requalifi\u00e9 les conventions en locations saisonni\u00e8res et d\u00e9clar\u00e9 l&#8217;action prescrite. La question de droit portait sur le point de d\u00e9part du d\u00e9lai de prescription biennale de l&#8217;action en requalification en pr\u00e9sence d&#8217;une succession de contrats distincts. La cour a infirm\u00e9 le jugement sur la prescription et d\u00e9clar\u00e9 l&#8217;action recevable pour le seul contrat de 2019.<\/p>\n<p>I. Le revirement jurisprudentiel sur le point de d\u00e9part de la prescription<\/p>\n<p>Le d\u00e9lai de prescription de l&#8217;action en requalification court d\u00e9sormais \u00e0 compter de la conclusion du contrat dont la requalification est sp\u00e9cifiquement recherch\u00e9e. La cour applique la solution d\u00e9gag\u00e9e par la Cour de cassation dans son arr\u00eat du 25 mai 2023, qui constitue un revirement par rapport \u00e0 la jurisprudence ant\u00e9rieure. Elle cite express\u00e9ment ce principe : <em>&#8221; Le d\u00e9lai de prescription biennale applicable \u00e0 l&#8217;action en requalification d&#8217;un contrat en bail commercial court, m\u00eame en pr\u00e9sence d&#8217;une succession de contrats distincts d\u00e9rogatoires aux dispositions du statut des commerciaux, \u00e0 compter de la conclusion du contrat dont la requalification est recherch\u00e9e &#8220;<\/em> <strong>(R\u00e9f\u00e9rence \u00e0 Cass. 3e civ., 25 mai 2023, n\u00b022-15.946)<\/strong>. La valeur de cette position est d&#8217;offrir une s\u00e9curit\u00e9 juridique renouvel\u00e9e \u00e0 chaque nouveau contrat, permettant \u00e0 l&#8217;occupant d&#8217;agir sans \u00eatre enferm\u00e9 dans une prescription globale. La port\u00e9e de ce revirement est majeure car elle impose de raisonner contrat par contrat, et non plus sur l&#8217;ensemble d&#8217;une relation continue.<\/p>\n<p>II. La recevabilit\u00e9 de l&#8217;action limit\u00e9e au contrat de 2019<\/p>\n<p>L&#8217;action en requalification est d\u00e9clar\u00e9e recevable uniquement pour le contrat de sous-location saisonni\u00e8re conclu en 2019. La cour constate que l&#8217;assignation a \u00e9t\u00e9 d\u00e9livr\u00e9e le 1er d\u00e9cembre 2020, soit moins de deux ans apr\u00e8s la conclusion de ce contrat le 15 juin 2019. Elle \u00e9carte ainsi l&#8217;argument de la prescription biennale qui aurait commenc\u00e9 \u00e0 courir en 2007, date du premier contrat. Le sens de cette d\u00e9cision est d&#8217;individualiser chaque convention comme un acte juridique autonome, malgr\u00e9 la continuit\u00e9 de la relation d&#8217;affaires. La port\u00e9e pratique est que l&#8217;occupant peut d\u00e9sormais poursuivre la requalification du seul contrat de 2019, sans \u00eatre paralys\u00e9 par la prescription des contrats ant\u00e9rieurs.
