La bailleresse, propri\u00e9taire d&#8217;un logement meubl\u00e9, avait assign\u00e9 sa locataire d\u00e9faillante apr\u00e8s un commandement de payer rest\u00e9 infructueux. La d\u00e9fenderesse, bien que r\u00e9guli\u00e8rement cit\u00e9e, n&#8217;a pas comparu \u00e0 l&#8217;audience. La question de droit portait sur la recevabilit\u00e9 de l&#8217;action et l&#8217;acquisition de la clause r\u00e9solutoire contractuelle. Le juge a d\u00e9clar\u00e9 l&#8217;action recevable, constat\u00e9 la r\u00e9siliation du bail et condamn\u00e9 la locataire au paiement d&#8217;une provision.<\/p>\n<p>La r\u00e9gularit\u00e9 de la saisine du juge des r\u00e9f\u00e9r\u00e9s.<\/p>\n<p>Le juge v\u00e9rifie d&#8217;abord la recevabilit\u00e9 de la demande au regard des obligations l\u00e9gales de notification. Il constate que &#8220;l\u2019assignation en date du 13 octobre 2025 a \u00e9t\u00e9 d\u00e9nonc\u00e9e le 16 octobre 2025 \u00e0 la Pr\u00e9fecture des Bouches-du-Rh\u00f4ne soit six semaines au moins avant l\u2019audience&#8221; (Motifs, sur la recevabilit\u00e9). Cette notification respecte le d\u00e9lai impos\u00e9 par l&#8217;article 24 III de la loi du 6 juillet 1989. La valeur de ce contr\u00f4le est de garantir la protection des locataires par l&#8217;information pr\u00e9alable des autorit\u00e9s administratives. La port\u00e9e de cette d\u00e9cision est de rappeler le caract\u00e8re imp\u00e9ratif de cette formalit\u00e9 pour la validit\u00e9 de l&#8217;action en r\u00e9f\u00e9r\u00e9.<\/p>\n<p>Les conditions de mise en \u0153uvre de la clause r\u00e9solutoire.<\/p>\n<p>Le juge se fonde sur le contrat de bail contenant une clause r\u00e9solutoire et sur le commandement de payer d\u00e9livr\u00e9. Il rel\u00e8ve que ce commandement &#8220;rappelle la mention que la locataire dispose d&#8217;un d\u00e9lai de deux mois pour payer sa dette&#8221; (Motifs, sur l&#8217;acquisition de la clause). Ce commandement \u00e9tant r\u00e9gulier et demeur\u00e9 infructueux, le juge constate que les conditions de la clause sont r\u00e9unies au 17 septembre 2025. Le sens de cette solution est l&#8217;application automatique de la clause r\u00e9solutoire, sans appr\u00e9ciation d&#8217;urgence. Sa port\u00e9e est de confirmer la force obligatoire des conventions en mati\u00e8re de baux d&#8217;habitation en r\u00e9f\u00e9r\u00e9.<\/p>\n<p>L&#8217;octroi d&#8217;une provision et la fixation de l&#8217;indemnit\u00e9 d&#8217;occupation.<\/p>\n<p>Le juge accorde une provision au titre de l&#8217;arri\u00e9r\u00e9 locatif, s&#8217;\u00e9levant \u00e0 7.380 euros. Il pr\u00e9cise que &#8220;Mme [H] [Y], non comparante, n\u2019apporte par d\u00e9finition aucun \u00e9l\u00e9ment de nature \u00e0 contester le principe ni le montant de la dette&#8221; (Motifs, sur la demande en paiement). Cette absence de contestation rend l&#8217;obligation non s\u00e9rieusement contestable au sens de l&#8217;article 835 du code de proc\u00e9dure civile. La valeur de cette d\u00e9cision est de permettre au cr\u00e9ancier d&#8217;obtenir rapidement une somme d&#8217;argent. Sa port\u00e9e est d&#8217;illustrer l&#8217;office du juge des r\u00e9f\u00e9r\u00e9s en pr\u00e9sence d&#8217;un d\u00e9fendeur d\u00e9faillant.<\/p>\n<p>La condamnation aux d\u00e9pens et \u00e0 l&#8217;indemnit\u00e9 de proc\u00e9dure.<\/p>\n<p>Enfin, le juge condamne la partie perdante aux d\u00e9pens et \u00e0 une indemnit\u00e9 au titre de l&#8217;article 700 du code de proc\u00e9dure civile. Il estime que &#8220;compte tenu des d\u00e9marches judiciaires qu\u2019a d\u00fb accomplir&#8221; la demanderesse, il convient d&#8217;allouer une somme de 200 euros (Motifs, sur les demandes accessoires). Cette d\u00e9cision applique le principe selon lequel la partie qui succombe supporte les frais de la proc\u00e9dure.
