L&#8217;absence de fondement des demandes d&#8217;interdiction et d&#8217;extension de mission<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#fondements-juridiques\">Fondements juridiques<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Par un arr\u00eat rendu le 27 avril 2026, la premi\u00e8re chambre civile de la Cour d&#8217;appel de Bordeaux a eu \u00e0 conna\u00eetre d&#8217;un litige opposant des copropri\u00e9taires et leur soci\u00e9t\u00e9 d&#8217;architecture au syndicat de copropri\u00e9t\u00e9 relatif \u00e0 des travaux d&#8217;am\u00e9nagement int\u00e9rieur et ext\u00e9rieur. Les appelants, propri\u00e9taires d&#8217;un lot, avaient entrepris la r\u00e9alisation d&#8217;une mezzanine et d&#8217;un <em>&#8221; office corner &#8220;<\/em> ainsi que le remplacement du rev\u00eatement de leur terrasse et la modification de jardini\u00e8res. Le syndicat estimait que ces travaux portaient atteinte aux parties communes sans autorisation de l&#8217;assembl\u00e9e g\u00e9n\u00e9rale.<\/p>\n<p>Saisi par le syndicat, le juge des r\u00e9f\u00e9r\u00e9s du tribunal judiciaire de Bordeaux, par ordonnance du 4 ao\u00fbt 2025, avait ordonn\u00e9 l&#8217;interruption et l&#8217;interdiction des travaux sous astreinte sur le fondement de l&#8217;article 835 alin\u00e9a 1er du code de proc\u00e9dure civile, estimant qu&#8217;ils constituaient un trouble manifestement illicite. Les copropri\u00e9taires et la soci\u00e9t\u00e9 d&#8217;architecture ont interjet\u00e9 appel, contestant l&#8217;existence d&#8217;un tel trouble. Le syndicat, pour sa part, sollicitait la confirmation de l&#8217;ordonnance et l&#8217;extension de la mission d&#8217;expertise d\u00e9j\u00e0 ordonn\u00e9e.<\/p>\n<p>La question de droit centrale \u00e9tait de savoir si les travaux litigieux, en l&#8217;absence d&#8217;autorisation de l&#8217;assembl\u00e9e g\u00e9n\u00e9rale, constituaient un trouble manifestement illicite ou un dommage imminent justifiant l&#8217;intervention du juge des r\u00e9f\u00e9r\u00e9s. La cour d&#8217;appel a infirm\u00e9 l&#8217;ordonnance sur ce point, jugeant que les conditions de l&#8217;article 835 alin\u00e9a 1er n&#8217;\u00e9taient pas r\u00e9unies. Elle a, en revanche, confirm\u00e9 l&#8217;ordonnance pour le surplus, rejetant les demandes reconventionnelles du syndicat.<\/p>\n<h2 id=\"i-lexclusion-du-trouble-manifestement-illicite-fondee-sur-une-analyse-technique-\">I. L&#8217;exclusion du trouble manifestement illicite fond\u00e9e sur une analyse technique des travaux<\/h2>\n<p><\/p>\n<h3 id=\"a-labsence-datteinte-caracterisee-aux-parties-communes-interieures\">A. L&#8217;absence d&#8217;atteinte caract\u00e9ris\u00e9e aux parties communes int\u00e9rieures<\/h3>\n<p>La cour d&#8217;appel a \u00e9cart\u00e9 l&#8217;existence d&#8217;un trouble manifestement illicite s&#8217;agissant des am\u00e9nagements int\u00e9rieurs. Elle s&#8217;est appuy\u00e9e sur la note de l&#8217;expert judiciaire du 2 d\u00e9cembre 2025, dont il ressort que <em>&#8221; l&#8217;int\u00e9ress\u00e9 n&#8217;a pas constat\u00e9 d&#8217;ancrage dans une partie structurelle du b\u00e2timent s&#8217;agissant de la mezzanine ou de l&#8217;office corner &#8220;<\/em>. Le juge a ainsi relev\u00e9 que la structure \u00e9tait autoporteuse et ne pr\u00e9sentait aucune attache dans les murs porteurs, contrairement aux all\u00e9gations du syndicat fond\u00e9es sur un constat de commissaire de justice.<\/p>\n<p>La cour a \u00e9galement r\u00e9fut\u00e9 l&#8217;argument selon lequel la chape aurait \u00e9t\u00e9 atteinte, pr\u00e9cisant que <em>&#8221; le seul fait d&#8217;ins\u00e9rer les pieds sous cette chape et de la refaire ensuite ne saurait \u00eatre une modification structurelle, ce d&#8217;autant plus qu&#8217;il s&#8217;agit d&#8217;une partie privative &#8220;<\/em>. Cette analyse a permis de constater que les travaux n&#8217;affectaient ni le gros \u0153uvre ni le syst\u00e8me de chauffage, et que la mezzanine n&#8217;\u00e9tait pas ancr\u00e9e dans les parties communes. D\u00e8s lors, l&#8217;absence de preuve d&#8217;une atteinte caract\u00e9ris\u00e9e aux parties communes conduisait \u00e0 \u00e9carter le trouble manifestement illicite.<\/p>\n<h3 id=\"b-la-justification-des-amenagements-exterieurs-par-lurgence-et-labsence-de-conse\">B. La justification des am\u00e9nagements ext\u00e9rieurs par l&#8217;urgence et l&#8217;absence de cons\u00e9quences illicites<\/h3>\n<p>Pour les travaux ext\u00e9rieurs, la cour a adopt\u00e9 un raisonnement similaire en soulignant leur n\u00e9cessit\u00e9 imp\u00e9rieuse. Elle a constat\u00e9 que <em>&#8221; c&#8217;est l&#8217;ancien rev\u00eatement constitu\u00e9 de dalles de b\u00e9ton qui est \u00e0 l&#8217;origine de l&#8217;atteinte \u00e0 l&#8217;\u00e9tanch\u00e9it\u00e9 constat\u00e9e et non les travaux effectu\u00e9s &#8220;<\/em>. Le remplacement des dalles par des lames de bois r\u00e9pondait donc \u00e0 une exigence de p\u00e9rennit\u00e9 du b\u00e2ti, de sorte qu&#8217;il ne pouvait constituer un trouble manifestement illicite.<\/p>\n<p>La cour a \u00e9galement \u00e9cart\u00e9 les griefs relatifs \u00e0 la suppression de la partie v\u00e9g\u00e9talis\u00e9e et aux percements dans les murs, estimant qu&#8217;il n&#8217;\u00e9tait pas \u00e9tabli que ces modifications <em>&#8221; constituent une atteinte au gros oeuvre en l&#8217;absence d&#8217;incidence sur l&#8217;imperm\u00e9abilit\u00e9 du balcon ou de cons\u00e9quence sur les murs perc\u00e9s &#8220;<\/em>. En outre, elle a relev\u00e9 que ces am\u00e9nagements relevaient de l&#8217;article 2.6 du r\u00e8glement de copropri\u00e9t\u00e9, qui autorise les travaux d&#8217;am\u00e9nagement initial sans autorisation de l&#8217;assembl\u00e9e g\u00e9n\u00e9rale. Ainsi, aucun trouble illicite ni dommage imminent n&#8217;\u00e9tait d\u00e9montr\u00e9, justifiant l&#8217;infirmation de l&#8217;ordonnance sur ce point.<\/p>\n<h2 id=\"ii-la-confirmation-de-lexpertise-et-le-rejet-des-demandes-accessoires-au-regard-\">II. La confirmation de l&#8217;expertise et le rejet des demandes accessoires au regard des exigences probatoires<\/h2>\n<p><\/p>\n<h3 id=\"a-le-maintien-de-la-mesure-dinstruction-pour-motif-legitime\">A. Le maintien de la mesure d&#8217;instruction pour motif l\u00e9gitime<\/h3>\n<p>La cour d&#8217;appel a confirm\u00e9 l&#8217;expertise ordonn\u00e9e par le premier juge sur le fondement de l&#8217;article 145 du code de proc\u00e9dure civile. Elle a jug\u00e9 que le pr\u00e9-rapport d&#8217;expertise communiqu\u00e9 <em>&#8221; a permis, du fait des constatations effectu\u00e9es par l&#8217;homme de l&#8217;art, non seulement d&#8217;\u00e9clairer la juridiction, mais \u00e9galement d&#8217;\u00e9carter certaines affirmations relatives aux solutions techniques retenues &#8220;<\/em>. D\u00e8s lors, il existait un motif l\u00e9gitime de conserver la preuve des faits, la mesure \u00e9tant n\u00e9cessaire pour trancher le litige. Cette solution s&#8217;inscrit dans la ligne de la jurisprudence qui admet que la force probante d&#8217;un rapport d&#8217;expertise amiable n&#8217;est pas d\u00e9terminante en r\u00e9f\u00e9r\u00e9, d\u00e8s lors qu&#8217;il constitue un \u00e9l\u00e9ment rendant possible qu&#8217;une action ne soit pas forclose <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/6799c43d5331f58c9ee86fc6\" rel=\"nofollow\" target=\"_blank\">(Cour d&#8217;appel de Poitiers, 28 janvier 2025, n\u00b024\/01487)<\/a><\/strong>. La cour a donc rejet\u00e9 l&#8217;argument des appelants tendant \u00e0 contester l&#8217;utilit\u00e9 de l&#8217;expertise.<\/p>\n<h3 id=\"b-labsence-de-fondement-des-demandes-dinterdiction-et-dextension-de-mission\">B. L&#8217;absence de fondement des demandes d&#8217;interdiction et d&#8217;extension de mission<\/h3>\n<p>La cour a ensuite rejet\u00e9 la demande reconventionnelle du syndicat tendant \u00e0 \u00e9tendre la mission de l&#8217;expert \u00e0 l&#8217;installation d&#8217;une unit\u00e9 ext\u00e9rieure de climatisation. Elle a relev\u00e9 qu&#8217;<em>&#8221; il n&#8217;est pas \u00e9tabli par les \u00e9l\u00e9ments mis en avant que l&#8217;unit\u00e9 ext\u00e9rieure d\u00e9nonc\u00e9e ait \u00e9t\u00e9 install\u00e9e d\u00e9finitivement &#8220;<\/em>. L&#8217;absence de certitude sur la r\u00e9alit\u00e9 et la persistance de l&#8217;installation a conduit \u00e0 \u00e9carter la demande.<\/p>\n<p>Enfin, la cour a refus\u00e9 d&#8217;ordonner l&#8217;interruption des travaux pour d\u00e9gradations des parties communes, estimant que les d\u00e9sordres constat\u00e9s <em>&#8221; ne comportent pas en l&#8217;\u00e9tat de p\u00e9ril imminent ou d&#8217;atteinte manifestement illicite &#8220;<\/em>. Elle a soulign\u00e9 que la g\u00eane li\u00e9e \u00e0 des travaux d&#8217;ach\u00e8vement d&#8217;un logement est normale et qu&#8217;aucune preuve d&#8217;une intensit\u00e9 anormale n&#8217;\u00e9tait rapport\u00e9e.
