Le rejet des mesures disproportionn\u00e9es et le sort des meubles<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#fondements-juridiques\">Fondements juridiques<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Le Tribunal judiciaire de Lille, par un jugement rendu le 27 mars 2026 (n\u00b025\/09196), a \u00e9t\u00e9 saisi par un bailleur d\u2019une action en constat de l\u2019acquisition d\u2019une clause r\u00e9solutoire ins\u00e9r\u00e9e dans un bail d\u2019habitation conclu le 22 ao\u00fbt 2022. Ce bail portait sur un logement situ\u00e9 \u00e0 Roubaix, et le locataire n\u2019avait pas r\u00e9gl\u00e9 l\u2019int\u00e9gralit\u00e9 des loyers et charges. Un commandement de payer visant la clause r\u00e9solutoire avait \u00e9t\u00e9 d\u00e9livr\u00e9 le 13 f\u00e9vrier 2025, pour un montant de 1194,65 \u20ac. Ce commandement \u00e9tait demeur\u00e9 infructueux pendant plus de deux mois, conduisant le bailleur \u00e0 assigner le locataire devant la juridiction de proximit\u00e9. Le locataire, bien que r\u00e9guli\u00e8rement assign\u00e9, n\u2019a pas comparu \u00e0 l\u2019audience. Le juge, statuant par jugement r\u00e9put\u00e9 contradictoire, a constat\u00e9 l\u2019acquisition de la clause r\u00e9solutoire \u00e0 la date du 14 avril 2025, ordonn\u00e9 l\u2019expulsion, condamn\u00e9 le locataire au paiement de la dette locative et d\u2019une indemnit\u00e9 d\u2019occupation, et rejet\u00e9 la demande de s\u00e9questration des meubles. La question juridique centrale soulev\u00e9e est celle des conditions dans lesquelles le juge peut, en pr\u00e9sence d\u2019une clause r\u00e9solutoire contractuelle et d\u2019un commandement de payer infructueux, constater la r\u00e9siliation de plein droit du bail, sans pouvoir accorder de d\u00e9lais de paiement d\u00e8s lors que le locataire est d\u00e9faillant et ne justifie d\u2019aucune reprise des paiements courants. La solution retenue par le tribunal consiste \u00e0 faire application stricte de l\u2019article 24 de la loi du 6 juillet 1989, en v\u00e9rifiant la r\u00e9gularit\u00e9 des formalit\u00e9s pr\u00e9alables et en constatant que le jeu de la clause r\u00e9solutoire est acquis, sans suspension ni am\u00e9nagement.<\/p>\n<h2 id=\"i-la-rigueur-procedurale-au-service-de-la-constatation-de-la-resiliation-de-plei\">I. La rigueur proc\u00e9durale au service de la constatation de la r\u00e9siliation de plein droit<\/h2>\n<p><\/p>\n<h3 id=\"a-la-recevabilite-de-laction-subordonnee-au-respect-des-obligations-prealables\">A. La recevabilit\u00e9 de l\u2019action subordonn\u00e9e au respect des obligations pr\u00e9alables<\/h3>\n<p>Le juge a d\u2019abord v\u00e9rifi\u00e9 la recevabilit\u00e9 de l\u2019action, conditionn\u00e9e par deux obligations l\u00e9gales pr\u00e9cises. D\u2019une part, l\u2019assignation d\u00e9livr\u00e9e le 31 juillet 2025 avait \u00e9t\u00e9 notifi\u00e9e \u00e0 la pr\u00e9fecture du Nord par voie \u00e9lectronique le 1er ao\u00fbt 2025, soit plus de six semaines avant l\u2019audience, conform\u00e9ment \u00e0 l\u2019article 24 III de la loi du 6 juillet 1989. D\u2019autre part, le bailleur justifiait avoir saisi la commission de coordination des actions de pr\u00e9vention des expulsions locatives le 14 f\u00e9vrier 2025, soit deux mois au moins avant la d\u00e9livrance de l\u2019assignation, en application de l\u2019article 24 II de la m\u00eame loi. Ces formalit\u00e9s, destin\u00e9es \u00e0 permettre un \u00e9ventuel traitement social de la situation du locataire, sont rigoureusement contr\u00f4l\u00e9es. Leur accomplissement en l\u2019esp\u00e8ce a emport\u00e9 la recevabilit\u00e9 de la demande. Le tribunal \u00e9carte ainsi tout risque de nullit\u00e9 de l\u2019action et assure la conformit\u00e9 de la proc\u00e9dure avec les exigences protectrices du logement. Cette approche est constante en jurisprudence, et le juge se montre particuli\u00e8rement attentif \u00e0 la preuve de ces diligences.<\/p>\n<h3 id=\"b-lacquisition-certaine-de-la-clause-resolutoire-en-labsence-de-contestation\">B. L\u2019acquisition certaine de la clause r\u00e9solutoire en l\u2019absence de contestation<\/h3>\n<p>Le bail conclu le 22 ao\u00fbt 2022 contenait une clause r\u00e9solutoire, pr\u00e9vue \u00e0 l\u2019article 18. Conform\u00e9ment \u00e0 l\u2019article 24 I de la loi du 6 juillet 1989, cette clause ne produit effet que deux mois apr\u00e8s un commandement de payer demeur\u00e9 infructueux. En l\u2019esp\u00e8ce, le commandement d\u00e9livr\u00e9 le 13 f\u00e9vrier 2025, pour un principal de 1194,65 \u20ac, n\u2019a pas \u00e9t\u00e9 suivi de paiement dans le d\u00e9lai l\u00e9gal. Le juge a donc constat\u00e9 que les conditions d\u2019acquisition \u00e9taient r\u00e9unies \u00e0 la date du 14 avril 2025. Ce constat emporte r\u00e9siliation de plein droit du bail, sans que le juge dispose d\u2019un pouvoir d\u2019appr\u00e9ciation sur le principe m\u00eame de la r\u00e9siliation, d\u00e8s lors que les conditions sont objectives. Le locataire, non comparant, n\u2019a sollicit\u00e9 aucun d\u00e9lai de paiement ni d\u00e9montr\u00e9 avoir repris le paiement int\u00e9gral des loyers courants \u00e0 la date de l\u2019audience. L\u2019article 24 V de la loi, qui permet au juge d\u2019accorder des d\u00e9lais, ne trouve donc pas \u00e0 s\u2019appliquer. Le tribunal se borne \u00e0 tirer les cons\u00e9quences de la carence du locataire. Cette solution s\u2019inscrit dans la logique de la loi, qui conf\u00e8re \u00e0 la clause r\u00e9solutoire un effet automatique sous r\u00e9serve du respect des formalit\u00e9s.<\/p>\n<h2 id=\"ii-les-consequences-indemnitaires-et-lexecution-de-lexpulsion-encadrees-par-la-l\">II. Les cons\u00e9quences indemnitaires et l\u2019ex\u00e9cution de l\u2019expulsion encadr\u00e9es par la loi<\/h2>\n<p><\/p>\n<h3 id=\"a-la-condamnation-a-larriere-locatif-et-a-une-indemnite-doccupation\">A. La condamnation \u00e0 l\u2019arri\u00e9r\u00e9 locatif et \u00e0 une indemnit\u00e9 d\u2019occupation<\/h3>\n<p>Le bailleur produisait un d\u00e9compte arr\u00eat\u00e9 au 13 f\u00e9vrier 2025, faisant appara\u00eetre une dette de 1194,65 \u20ac. Le locataire, sans contestation, a \u00e9t\u00e9 condamn\u00e9 \u00e0 payer cette somme, assortie des int\u00e9r\u00eats au taux l\u00e9gal \u00e0 compter du commandement de payer, en application des articles 1231-6 et 1231-7 du code civil. En outre, le tribunal a condamn\u00e9 le locataire au paiement d\u2019une indemnit\u00e9 mensuelle d\u2019occupation, \u00e0 compter du loyer de mars 2025 jusqu\u2019\u00e0 la lib\u00e9ration effective des lieux. Cette indemnit\u00e9 est fix\u00e9e au montant du loyer et des charges qui auraient \u00e9t\u00e9 dus si le bail s\u2019\u00e9tait poursuivi. Elle r\u00e9pare le pr\u00e9judice subi par le bailleur, priv\u00e9 de la jouissance de son bien par une occupation indue. Une telle fixation est conforme \u00e0 la pratique judiciaire, rappel\u00e9e par la Cour d\u2019appel de Rouen qui a pu souligner que <em>&#8220;le bail a donc pris fin ; la SAS Jumbo Pneus est d\u00e9bitrice, depuis cette derni\u00e8re date d\u2019une indemnit\u00e9 d\u2019occupation&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67a5a2fccb8e9293803aec29\" rel=\"nofollow\" target=\"_blank\">(Cour d\u2019appel de Rouen, 6 f\u00e9vrier 2025, n\u00b024\/01720)<\/a><\/strong>. La solution du tribunal de Lille s\u2019inscrit dans cette continuit\u00e9.<\/p>\n<h3 id=\"b-le-rejet-des-mesures-disproportionnees-et-le-sort-des-meubles\">B. Le rejet des mesures disproportionn\u00e9es et le sort des meubles<\/h3>\n<p>Le bailleur sollicitait que le transport et la s\u00e9questration des meubles soient ordonn\u00e9s. Le tribunal a refus\u00e9 d\u2019y faire droit, estimant que ces mesures \u00e9taient purement hypoth\u00e9tiques \u00e0 ce stade et que le sort des meubles est d\u00e9j\u00e0 organis\u00e9 par les articles R.433-1 et suivants du code des proc\u00e9dures civiles d\u2019ex\u00e9cution lors de la phase d\u2019ex\u00e9cution de l\u2019expulsion. Il s\u2019agit d\u2019une position pragmatique, qui \u00e9vite de prononcer une mesure anticip\u00e9e et potentiellement superflue. La Cour d\u2019appel de Paris, dans une d\u00e9cision du 6 mars 2025, avait admis le principe de la s\u00e9questration <em>&#8220;en garantie des loyers, indemnit\u00e9s d\u2019occupation et r\u00e9parations locatives qui resteraient dus&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67ca907e24597c2a80ff5985\" rel=\"nofollow\" target=\"_blank\">(Cour d\u2019appel de Paris, 6 mars 2025, n\u00b024\/08410)<\/a><\/strong>. Le juge lillois, en l\u2019esp\u00e8ce, a choisi de ne pas anticiper cette mesure, r\u00e9servant son application \u00e9ventuelle \u00e0 la phase d\u2019ex\u00e9cution forc\u00e9e. Enfin, le locataire, partie perdante, a \u00e9t\u00e9 condamn\u00e9 aux d\u00e9pens, incluant les frais de commandement et d\u2019assignation, ainsi qu\u2019\u00e0 une somme de 700 \u20ac sur le fondement de l\u2019article 700 du code de proc\u00e9dure civile. Sauf disposition contraire de la loi, ces int\u00e9r\u00eats courent \u00e0 compter du prononc\u00e9 du jugement \u00e0 moins que le juge n&#8217;en d\u00e9cide autrement.<\/p>\n<p>En cas de confirmation pure et simple par le juge d&#8217;appel d&#8217;une d\u00e9cision allouant une indemnit\u00e9 en r\u00e9paration d&#8217;un dommage, celle-ci porte de plein droit int\u00e9r\u00eat au taux l\u00e9gal \u00e0 compter du jugement de premi\u00e8re instance. Dans les autres cas, l&#8217;indemnit\u00e9 allou\u00e9e en appel porte int\u00e9r\u00eat \u00e0 compter de la d\u00e9cision d&#8217;appel. Le juge d&#8217;appel peut toujours d\u00e9roger aux dispositions du pr\u00e9sent alin\u00e9a.<\/p>\n<\/div>\n<\/div>\n<div class=\"fj-article\">\n<h3><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000045268436\" rel=\"nofollow\" target=\"_blank\">Article 700 du Code de proc\u00e9dure civile<\/a> <span class=\"fj-badge fj-en-vigueur\">En vigueur<\/span><\/h3>\n<div class=\"fj-texte\">\n<p>Le juge condamne la partie tenue aux d\u00e9pens ou qui perd son proc\u00e8s \u00e0 payer :<\/p>\n<p>1\u00b0 A l&#8217;autre partie la somme qu&#8217;il d\u00e9termine, au titre des frais expos\u00e9s et non compris dans les d\u00e9pens ;<\/p>\n<p>2\u00b0 Et, le cas \u00e9ch\u00e9ant, \u00e0 l&#8217;avocat du b\u00e9n\u00e9ficiaire de l&#8217;aide juridictionnelle partielle ou totale une somme au titre des honoraires et frais, non compris dans les d\u00e9pens, que le b\u00e9n\u00e9ficiaire de l&#8217;aide aurait expos\u00e9s s&#8217;il n&#8217;avait pas eu cette aide. Dans ce cas, il est proc\u00e9d\u00e9 comme il est dit aux  alin\u00e9as 3 et 4 de l&#8217;article 37 de la loi n\u00b0 91-647 du 10 juillet 1991 .<\/p>\n<p>Dans tous les cas, le juge tient compte de l&#8217;\u00e9quit\u00e9 ou de la situation \u00e9conomique de la partie condamn\u00e9e.
