L\u2019indemnit\u00e9 d\u2019occupation et les condamnations accessoires<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#fondements-juridiques\">Fondements juridiques<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Le Tribunal judiciaire de Toulouse, statuant en r\u00e9f\u00e9r\u00e9 le 27 mars 2026, a \u00e9t\u00e9 saisi par un bailleur social d\u2019une demande tendant \u00e0 voir constater l\u2019acquisition de la clause r\u00e9solutoire d\u2019un bail d\u2019habitation pour impay\u00e9s de loyers, ordonner l\u2019expulsion du locataire et obtenir une provision \u00e0 valoir sur la dette locative et une indemnit\u00e9 d\u2019occupation. Le locataire, assign\u00e9, n\u2019a pas comparu. Par l\u2019ordonnance comment\u00e9e, le juge a fait droit \u00e0 l\u2019int\u00e9gralit\u00e9 des demandes, apr\u00e8s avoir v\u00e9rifi\u00e9 la r\u00e9gularit\u00e9 de la proc\u00e9dure et le bien-fond\u00e9 des pr\u00e9tentions. La solution interroge sur les conditions dans lesquelles le juge des r\u00e9f\u00e9r\u00e9s peut, en pr\u00e9sence d\u2019un d\u00e9fendeur d\u00e9faillant, constater l\u2019acquisition d\u2019une clause r\u00e9solutoire et allouer des provisions. Il s\u2019agit donc de d\u00e9terminer le p\u00e9rim\u00e8tre des obligations proc\u00e9durales et substantielles pesant sur le bailleur qui agit sur le fondement de l\u2019article 24 de la loi du 6 juillet 1989. Le juge rappelle que l\u2019action est recevable d\u00e8s lors que l\u2019assignation a \u00e9t\u00e9 notifi\u00e9e \u00e0 la pr\u00e9fecture dans le d\u00e9lai requis et que le commandement de payer respectait les mentions l\u00e9gales. Il constate que les conditions de l\u2019acquisition de la clause r\u00e9solutoire sont r\u00e9unies et condamne le locataire non comparant au paiement d\u2019une provision et d\u2019une indemnit\u00e9 d\u2019occupation.<\/p>\n<p>L\u2019analyse de cette d\u00e9cision conduit \u00e0 envisager d\u2019abord la rigueur des conditions proc\u00e9durales de la constatation de la clause r\u00e9solutoire (I), puis les pouvoirs indemnitaires exerc\u00e9s en r\u00e9f\u00e9r\u00e9 par le juge (II).<\/p>\n<h2 id=\"i-la-rigueur-des-conditions-procedurales-de-la-constatation-de-la-clause-resolut\">I. La rigueur des conditions proc\u00e9durales de la constatation de la clause r\u00e9solutoire<\/h2>\n<p><\/p>\n<h3 id=\"a-les-diligences-prealables-a-laction-en-justice\">A. Les diligences pr\u00e9alables \u00e0 l\u2019action en justice<\/h3>\n<p>Le juge des r\u00e9f\u00e9r\u00e9s v\u00e9rifie minutieusement le respect des obligations pr\u00e9vues \u00e0 l\u2019article 24 III de la loi du 6 juillet 1989 avant de d\u00e9clarer l\u2019action recevable. En l\u2019esp\u00e8ce, la notification de l\u2019assignation \u00e0 la pr\u00e9fecture de la Haute-Garonne a \u00e9t\u00e9 effectu\u00e9e par voie \u00e9lectronique le 2 septembre 2025, soit plus de six semaines avant l\u2019audience. Cette exigence, impos\u00e9e \u00e0 peine d\u2019irrecevabilit\u00e9, garantit que les pouvoirs publics puissent intervenir en amont de toute d\u00e9cision d\u2019expulsion. La cour d\u2019appel d\u2019Aix-en-Provence rappelle \u00e0 cet \u00e9gard que <em>&#8221; le bailleur, personne physique, qui sollicite la constatation de l&#8217;acquisition de la r\u00e9siliation du bail d&#8217;habitation pour impay\u00e9s locatifs, doit justifier, \u00e0 peine d&#8217;irrecevabilit\u00e9 de sa demande, de la notification de l&#8217;assignation au repr\u00e9sentant de l&#8217;Etat dans le d\u00e9partement au moins deux mois avant l&#8217;audience &#8220;<\/em> (CA Aix-en-Provence, 27 f\u00e9vrier 2025, n\u00b024\/05491). En l\u2019esp\u00e8ce, le bailleur est une personne morale, mais le texte s\u2019applique indistinctement. De plus, le bailleur justifie avoir signal\u00e9 la situation d\u2019impay\u00e9s \u00e0 la caisse d\u2019allocations familiales par courrier du 16 octobre 2024, soit deux mois avant l\u2019assignation du 25 septembre 2025, conform\u00e9ment \u00e0 l\u2019article 24 II. Ce signalement permet de d\u00e9clencher les m\u00e9canismes de pr\u00e9vention des expulsions. Le juge en d\u00e9duit que la saisine de la commission de coordination des actions de pr\u00e9vention des expulsions locatives est r\u00e9put\u00e9e constitu\u00e9e, ce qui \u00e9carte tout grief de proc\u00e9dure.<\/p>\n<h3 id=\"b-la-validite-du-commandement-de-payer-et-lacquisition-de-la-clause-resolutoire\">B. La validit\u00e9 du commandement de payer et l\u2019acquisition de la clause r\u00e9solutoire<\/h3>\n<p>Le commandement de payer constitue le pr\u00e9alable n\u00e9cessaire \u00e0 la mise en \u0153uvre de la clause r\u00e9solutoire. L\u2019article 24 I de la loi du 6 juillet 1989, dans sa version applicable \u00e0 la date de conclusion du contrat <strong>(avis de la Cour de cassation, 13 juin 2024, n\u00b024-70.002)<\/strong>, exige que ce commandement reproduise plusieurs mentions obligatoires \u00e0 peine de nullit\u00e9. La cour d\u2019appel de Toulouse a pr\u00e9cis\u00e9 que ces mentions sont pr\u00e9vues <em>&#8221; \u00e0 peine de nullit\u00e9, sous r\u00e9serve cependant que le destinataire d\u00e9montre que l&#8217;absence de l&#8217;une ou l&#8217;autre lui a caus\u00e9 un grief &#8220;<\/em> (CA Toulouse, 29 avril 2025, n\u00b024\/01971). En l\u2019esp\u00e8ce, le commandement signifi\u00e9 le 12 juin 2025 mentionne les six points impos\u00e9s par la loi, notamment le montant de la dette, le d\u00e9lai de deux mois pour payer et l\u2019avertissement des risques d\u2019expulsion. Le locataire ne comparaissant pas, il ne peut invoquer aucun grief. Le d\u00e9lai de deux mois ayant expir\u00e9 sans paiement, le juge constate que les conditions d\u2019acquisition de la clause r\u00e9solutoire \u00e9taient r\u00e9unies au 13 ao\u00fbt 2025. Il en r\u00e9sulte que le locataire est devenu occupant sans droit ni titre \u00e0 compter de cette date.<\/p>\n<h2 id=\"ii-les-mesures-indemnitaires-exercees-en-refere-par-le-juge\">II. Les mesures indemnitaires exerc\u00e9es en r\u00e9f\u00e9r\u00e9 par le juge<\/h2>\n<p><\/p>\n<h3 id=\"a-la-condamnation-provisionnelle-au-titre-de-larriere-locatif\">A. La condamnation provisionnelle au titre de l\u2019arri\u00e9r\u00e9 locatif<\/h3>\n<p>Sur le fondement de l\u2019article 835 du code de proc\u00e9dure civile, le juge des r\u00e9f\u00e9r\u00e9s peut accorder une provision lorsque l\u2019obligation n\u2019est pas s\u00e9rieusement contestable. En l\u2019esp\u00e8ce, le bailleur produit un d\u00e9compte arr\u00eat\u00e9 au 27 janvier 2026 faisant appara\u00eetre une dette de 634,39 \u20ac, incluant l\u2019\u00e9ch\u00e9ance de d\u00e9cembre 2025. Le locataire, non comparant, ne conteste ni le principe ni le montant de cette dette. Le juge rel\u00e8ve que l\u2019obligation de payer le loyer et les charges est une obligation essentielle du locataire, consacr\u00e9e \u00e0 l\u2019article 7 a) de la loi du 6 juillet 1989. Il v\u00e9rifie d\u2019office, comme l\u2019y autorise l\u2019article 24 V de cette m\u00eame loi, les \u00e9l\u00e9ments constitutifs de la dette. En l\u2019absence de contestation s\u00e9rieuse, il condamne le locataire au paiement de la somme provisionnelle avec int\u00e9r\u00eats au taux l\u00e9gal \u00e0 compter de l\u2019ordonnance. Cette solution est classique en mati\u00e8re de r\u00e9f\u00e9r\u00e9 : le juge ne tranche pas le fond, mais accorde une avance sur cr\u00e9ance certaine.<\/p>\n<h3 id=\"b-lindemnite-doccupation-et-les-condamnations-accessoires\">B. L\u2019indemnit\u00e9 d\u2019occupation et les condamnations accessoires<\/h3>\n<p>\u00c0 compter de la date d\u2019acquisition de la clause r\u00e9solutoire, le locataire occupe les lieux sans droit ni titre. Le juge condamne ce dernier \u00e0 une indemnit\u00e9 mensuelle d\u2019occupation fix\u00e9e au montant du loyer et des charges qui auraient \u00e9t\u00e9 dus si le contrat s\u2019\u00e9tait poursuivi, sous d\u00e9duction des aides au logement vers\u00e9es directement au bailleur. Cette indemnit\u00e9 court \u00e0 compter du 1er janvier 2026, l\u2019arri\u00e9r\u00e9 ant\u00e9rieur \u00e9tant d\u00e9j\u00e0 compris dans la provision allou\u00e9e. Cette mesure r\u00e9pare le pr\u00e9judice subi par le bailleur du fait de l\u2019occupation illicite. Par ailleurs, le locataire, partie perdante, supporte les d\u00e9pens, qui incluent le co\u00fbt du commandement de payer, de l\u2019assignation et de sa notification \u00e0 la pr\u00e9fecture. Le juge accorde \u00e9galement une somme de 150 \u20ac au titre de l\u2019article 700 du code de proc\u00e9dure civile pour les frais irr\u00e9p\u00e9tibles expos\u00e9s par le bailleur. En revanche, il d\u00e9boute la demanderesse de sa demande relative aux actes signifi\u00e9s dans le cadre de mesures conservatoires, estimant que ces d\u00e9penses demeurent hypoth\u00e9tiques. L\u2019ordonnance est assortie de l\u2019ex\u00e9cution provisoire de plein droit, ce qui permet au bailleur de poursuivre l\u2019expulsion sans attendre l\u2019expiration des voies de recours.<\/p>\n<p><h2 id=\"jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/h2>\n<p><\/p>\n<ul class=\"jurisprudences-rag-sources\">\n<li><a href=\"https:\/\/www.courdecassation.fr\/decision\/6811aead81f47e994feb264b\" rel=\"nofollow\" target=\"_blank\">Cour d&#x27;appel de Toulouse, le 29 avril 2025, n\u00b024\/01971<\/a><\/li>\n<li><a href=\"https:\/\/www.courdecassation.fr\/decision\/67c159f54ca4138f1ed05fa5\" rel=\"nofollow\" target=\"_blank\">Cour d&#x27;appel d\u2019Aix-en-Provence, le 27 f\u00e9vrier 2025, n\u00b024\/05491<\/a><\/li>\n<\/ul>\n<\/div>\n<style scoped>.fondements-juridiques{margin:40px 0 0;padding:0}.fondements-juridiques>h2{font-size:22px;color:#1a1a1a;border-bottom:2px solid #2c5f8a;padding-bottom:10px;margin-bottom:20px}.fj-article{background:#fdfdfd;border:1px solid #e8e8e8;border-radius:6px;padding:20px;margin-bottom:16px}.fj-article h3{font-size:17px;color:#2c5f8a;margin:0 0 12px;font-weight:600}.fj-texte{font-size:15px;line-height:1.7;color:#333}.fj-texte p{margin:8px 0}.fj-badge{font-size:11px;padding:2px 8px;border-radius:3px;margin-left:8px;font-weight:500;vertical-align:middle}.fj-en-vigueur{background:#e8f5e9;color:#2e7d32}.fj-abroge{background:#ffebee;color:#c62828}.fj-modifie{background:#fff3e0;color:#e65100}<\/style>\n<section class=\"fondements-juridiques\">\n<h2 id=\"fondements-juridiques\">Fondements juridiques<\/h2>\n<div class=\"fj-article\">\n<h3><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042597284\" rel=\"nofollow\" target=\"_blank\">Article 835 du Code de proc\u00e9dure civile<\/a> <span class=\"fj-badge fj-en-vigueur\">En vigueur<\/span><\/h3>\n<div class=\"fj-texte\">\n<p>Le pr\u00e9sident du tribunal judiciaire ou le juge des contentieux de la protection dans les limites de sa comp\u00e9tence peuvent toujours, m\u00eame en pr\u00e9sence d&#8217;une contestation s\u00e9rieuse, prescrire en r\u00e9f\u00e9r\u00e9 les mesures conservatoires ou de remise en \u00e9tat qui s&#8217;imposent, soit pour pr\u00e9venir un dommage imminent, soit pour faire cesser un trouble manifestement illicite.<\/p>\n<p>Dans les cas o\u00f9 l&#8217;existence de l&#8217;obligation n&#8217;est pas s\u00e9rieusement contestable, ils peuvent accorder une provision au cr\u00e9ancier, ou ordonner l&#8217;ex\u00e9cution de l&#8217;obligation m\u00eame s&#8217;il s&#8217;agit d&#8217;une obligation de faire.<\/p>\n<\/p>\n<\/div>\n<\/div>\n<div class=\"fj-article\">\n<h3><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000045268436\" rel=\"nofollow\" target=\"_blank\">Article 700 du Code de proc\u00e9dure civile<\/a> <span class=\"fj-badge fj-en-vigueur\">En vigueur<\/span><\/h3>\n<div class=\"fj-texte\">\n<p>Le juge condamne la partie tenue aux d\u00e9pens ou qui perd son proc\u00e8s \u00e0 payer :<\/p>\n<p>1\u00b0 A l&#8217;autre partie la somme qu&#8217;il d\u00e9termine, au titre des frais expos\u00e9s et non compris dans les d\u00e9pens ;<\/p>\n<p>2\u00b0 Et, le cas \u00e9ch\u00e9ant, \u00e0 l&#8217;avocat du b\u00e9n\u00e9ficiaire de l&#8217;aide juridictionnelle partielle ou totale une somme au titre des honoraires et frais, non compris dans les d\u00e9pens, que le b\u00e9n\u00e9ficiaire de l&#8217;aide aurait expos\u00e9s s&#8217;il n&#8217;avait pas eu cette aide. Dans ce cas, il est proc\u00e9d\u00e9 comme il est dit aux  alin\u00e9as 3 et 4 de l&#8217;article 37 de la loi n\u00b0 91-647 du 10 juillet 1991 .<\/p>\n<p>Dans tous les cas, le juge tient compte de l&#8217;\u00e9quit\u00e9 ou de la situation \u00e9conomique de la partie condamn\u00e9e.
