Le cas est fr\u00e9quent au moment des cl\u00f4tures mensuelles, trimestrielles ou semestrielles : commandes sign\u00e9es avant le d\u00e9part, factures \u00e9mises apr\u00e8s, client qui r\u00e8gle plus tard, employeur qui invoque une condition de pr\u00e9sence, tableau de commissionnement incomplet.<\/p>\n<p>La difficult\u00e9 tient rarement \u00e0 une seule question. Il faut v\u00e9rifier le contrat de travail, le plan de r\u00e9mun\u00e9ration variable, les avenants, les objectifs, les bons de commande, les factures, les encaissements, les bulletins de paie et le solde de tout compte. Il faut aussi distinguer la prime, le bonus, la commission, l&#8217;int\u00e9ressement commercial et l&#8217;indemnit\u00e9 de cong\u00e9s pay\u00e9s aff\u00e9rente.<\/p>\n<p>Une commission commerciale est un \u00e9l\u00e9ment de salaire lorsqu&#8217;elle r\u00e9mun\u00e8re le travail du salari\u00e9. Elle ne dispara\u00eet pas automatiquement parce que le salari\u00e9 a d\u00e9missionn\u00e9, a \u00e9t\u00e9 licenci\u00e9, a \u00e9t\u00e9 dispens\u00e9 de pr\u00e9avis ou a quitt\u00e9 l&#8217;entreprise avant l&#8217;encaissement d\u00e9finitif du client. Tout d\u00e9pend de la clause applicable, de sa clart\u00e9 et des faits qui d\u00e9clenchent le droit \u00e0 commission.<\/p>\n<h2>La premi\u00e8re question : quand la commission est-elle acquise ?<\/h2>\n<p>Le contrat ou le plan de r\u00e9mun\u00e9ration peut pr\u00e9voir plusieurs d\u00e9clencheurs : signature du bon de commande, validation de la commande, facturation, encaissement, marge brute, livraison, absence d&#8217;annulation, absence d&#8217;impay\u00e9 client, atteinte d&#8217;un seuil ou cl\u00f4ture d&#8217;un trimestre.<\/p>\n<p>Le salari\u00e9 ne doit pas se limiter \u00e0 dire que la vente vient de lui. Il doit identifier pr\u00e9cis\u00e9ment le fait g\u00e9n\u00e9rateur pr\u00e9vu par les documents contractuels. Une vente sign\u00e9e peut ne pas suffire si le plan pr\u00e9voit une commission au r\u00e8glement du client. \u00c0 l&#8217;inverse, l&#8217;employeur ne peut pas refuser toute commission apr\u00e8s le d\u00e9part si la clause ne le permet pas clairement.<\/p>\n<p>La Cour d&#8217;appel de Toulouse a rappel\u00e9, le 10 mars 2026, qu&#8217;un plan de r\u00e9mun\u00e9ration pouvait distinguer les primes et les commissions. Dans cette affaire, elle a retenu que &#8220;la condition de pr\u00e9sence s&#8217;applique aux primes et pas aux commissions&#8221; et a condamn\u00e9 l&#8217;employeur \u00e0 payer un rappel de commissions et les cong\u00e9s pay\u00e9s aff\u00e9rents.<\/p>\n<p>Cette d\u00e9cision illustre un point pratique : une condition de pr\u00e9sence ne doit pas \u00eatre lue trop largement. Si le document vise les primes mais pas les commissions, ou si la clause est ambigu\u00eb, le salari\u00e9 peut soutenir que les commissions d\u00e9j\u00e0 g\u00e9n\u00e9r\u00e9es restent dues.<\/p>\n<h2>Les preuves \u00e0 r\u00e9unir avant de r\u00e9clamer<\/h2>\n<p>Le litige se gagne souvent sur les pi\u00e8ces. Le salari\u00e9 doit reconstituer une chronologie simple : prospection, \u00e9change client, devis, bon de commande, signature, facturation, encaissement, ligne de commission attendue et paiement r\u00e9ellement re\u00e7u.<\/p>\n<p>Les pi\u00e8ces utiles sont notamment :<\/p>\n<ul>\n<li>contrat de travail et avenants ;<\/li>\n<li>plan de r\u00e9mun\u00e9ration variable applicable \u00e0 l&#8217;ann\u00e9e concern\u00e9e ;<\/li>\n<li>courriels de fixation des objectifs ou du taux de commission ;<\/li>\n<li>tableaux de suivi commercial ;<\/li>\n<li>CRM, captures de pipeline, fiches client, bons de commande ;<\/li>\n<li>factures, avoirs, preuves d&#8217;encaissement si le salari\u00e9 y a acc\u00e8s ;<\/li>\n<li>bulletins de paie avec lignes de commissions ;<\/li>\n<li>solde de tout compte ;<\/li>\n<li>\u00e9changes avec le manager, la direction commerciale, la paie ou les ressources humaines ;<\/li>\n<li>comparatifs avec les commissions vers\u00e9es les mois pr\u00e9c\u00e9dents.<\/li>\n<\/ul>\n<p>L&#8217;article 1353 du Code civil pose la r\u00e8gle g\u00e9n\u00e9rale : celui qui r\u00e9clame l&#8217;ex\u00e9cution d&#8217;une obligation doit la prouver, et celui qui pr\u00e9tend avoir pay\u00e9 doit justifier le paiement. En pratique, le salari\u00e9 doit donc produire des \u00e9l\u00e9ments suffisamment pr\u00e9cis. Mais l&#8217;employeur, qui d\u00e9tient souvent les factures, les marges, les encaissements et les tableaux internes, doit r\u00e9pondre avec ses propres \u00e9l\u00e9ments.<\/p>\n<p>Il ne faut pas attendre plusieurs mois pour demander ces documents. Un courrier pr\u00e9cis peut r\u00e9clamer le d\u00e9tail des commandes prises en compte, le taux appliqu\u00e9, les factures, les avoirs, les encaissements, les motifs d&#8217;exclusion et le calcul des cong\u00e9s pay\u00e9s sur commissions.<\/p>\n<h2>L&#8217;employeur peut-il opposer le d\u00e9part du salari\u00e9 ?<\/h2>\n<p>L&#8217;employeur invoque souvent trois arguments.<\/p>\n<p>Premier argument : le salari\u00e9 n&#8217;\u00e9tait plus pr\u00e9sent au moment du paiement. Cet argument n&#8217;est pas toujours suffisant. Si le droit \u00e0 commission \u00e9tait d\u00e9j\u00e0 n\u00e9 avant le d\u00e9part, ou si la condition de pr\u00e9sence ne vise pas les commissions, le rappel de salaire reste d\u00e9fendable.<\/p>\n<p>Deuxi\u00e8me argument : le client n&#8217;a pas encore pay\u00e9. Il faut alors v\u00e9rifier la clause. Certaines commissions sont dues \u00e0 la facturation, d&#8217;autres \u00e0 l&#8217;encaissement. Mais l&#8217;employeur doit produire les \u00e9l\u00e9ments qui permettent de contr\u00f4ler la situation : factures, r\u00e8glements, dates d&#8217;encaissement, annulations ou avoirs.<\/p>\n<p>Troisi\u00e8me argument : la vente n&#8217;a pas \u00e9t\u00e9 suivie jusqu&#8217;au bout par le salari\u00e9. L\u00e0 encore, la clause compte. Si le commissionnement d\u00e9pend d&#8217;un suivi effectif du contrat jusqu&#8217;\u00e0 bonne fin, l&#8217;employeur peut discuter la cr\u00e9ance. Mais si le contrat r\u00e9mun\u00e8re l&#8217;apport d&#8217;affaires, la signature ou la marge g\u00e9n\u00e9r\u00e9e, le d\u00e9part ne suffit pas n\u00e9cessairement \u00e0 effacer la commission.<\/p>\n<p>Le salari\u00e9 doit donc \u00e9viter une r\u00e9clamation globale du type &#8220;mes commissions ne sont pas pay\u00e9es&#8221;. Il faut viser chaque client, chaque commande, chaque p\u00e9riode, chaque taux et chaque somme.<\/p>\n<h2>Commissions et cong\u00e9s pay\u00e9s : un point souvent oubli\u00e9<\/h2>\n<p>Les commissions qui r\u00e9mun\u00e8rent l&#8217;activit\u00e9 du salari\u00e9 peuvent entrer dans l&#8217;assiette des cong\u00e9s pay\u00e9s. Beaucoup d&#8217;employeurs indiquent que les cong\u00e9s pay\u00e9s sont d\u00e9j\u00e0 inclus dans le mode de calcul. Cette clause doit \u00eatre examin\u00e9e avec attention.<\/p>\n<p>Une inclusion forfaitaire n&#8217;est pas toujours opposable si elle ne permet pas de distinguer clairement la part correspondant au travail et la part correspondant aux cong\u00e9s. Dans l&#8217;arr\u00eat du 10 mars 2026, la Cour d&#8217;appel de Toulouse a \u00e9galement retenu qu&#8217;une clause d&#8217;inclusion des cong\u00e9s pay\u00e9s dans les commissions n&#8217;\u00e9tait pas suffisamment transparente et compr\u00e9hensible.<\/p>\n<p>En pratique, il faut contr\u00f4ler les bulletins de paie. Si les commissions apparaissent sans ligne distincte de cong\u00e9s pay\u00e9s, si aucune p\u00e9riode de cong\u00e9 n&#8217;est identifiable, ou si l&#8217;employeur ne peut pas expliquer le calcul, une demande compl\u00e9mentaire peut \u00eatre envisag\u00e9e.<\/p>\n<h2>Quel d\u00e9lai pour agir ?<\/h2>\n<p>L&#8217;action en paiement du salaire se prescrit par trois ans. L&#8217;article L3245-1 du Code du travail pr\u00e9voit que la demande peut porter sur les sommes dues au titre des trois derni\u00e8res ann\u00e9es ou, lorsque le contrat est rompu, sur les sommes dues au titre des trois ann\u00e9es pr\u00e9c\u00e9dant la rupture.<\/p>\n<p>Ce d\u00e9lai est court dans les dossiers de commerciaux. Les tableaux de commissions changent, les acc\u00e8s informatiques sont coup\u00e9s, les interlocuteurs quittent l&#8217;entreprise et les preuves deviennent difficiles \u00e0 obtenir.<\/p>\n<p>Le salari\u00e9 doit donc agir rapidement apr\u00e8s la remise du solde de tout compte. S&#8217;il a sign\u00e9 un re\u00e7u pour solde de tout compte, il faut aussi v\u00e9rifier s&#8217;il doit \u00eatre d\u00e9nonc\u00e9 dans le d\u00e9lai applicable et si les commissions litigieuses y sont suffisamment d\u00e9taill\u00e9es.<\/p>\n<h2>Comment r\u00e9clamer les commissions non pay\u00e9es ?<\/h2>\n<p>La premi\u00e8re \u00e9tape consiste \u00e0 envoyer une demande \u00e9crite, calme et chiffr\u00e9e. Elle doit demander le d\u00e9tail des commissions, les justificatifs de calcul et le paiement des sommes identifi\u00e9es. Il est pr\u00e9f\u00e9rable d&#8217;\u00e9viter les accusations g\u00e9n\u00e9rales et de joindre un tableau.<\/p>\n<p>La deuxi\u00e8me \u00e9tape consiste \u00e0 relancer l&#8217;employeur si la r\u00e9ponse est incompl\u00e8te. Le salari\u00e9 peut demander pourquoi telle commande est exclue, pourquoi tel taux est r\u00e9duit, pourquoi tel client est absent du tableau, ou pourquoi les cong\u00e9s pay\u00e9s aff\u00e9rents ne sont pas vers\u00e9s.<\/p>\n<p>La troisi\u00e8me \u00e9tape consiste \u00e0 envisager une mise en demeure. Elle doit rappeler le contrat, le plan de r\u00e9mun\u00e9ration, les sommes r\u00e9clam\u00e9es, les pi\u00e8ces demand\u00e9es et le d\u00e9lai laiss\u00e9 \u00e0 l&#8217;employeur pour r\u00e9gulariser.<\/p>\n<p>La quatri\u00e8me \u00e9tape consiste, si n\u00e9cessaire, \u00e0 saisir le conseil de prud&#8217;hommes. La demande peut porter sur le rappel de commissions, les cong\u00e9s pay\u00e9s aff\u00e9rents, les int\u00e9r\u00eats, les documents de paie rectifi\u00e9s et, dans certains cas, un pr\u00e9judice distinct si l&#8217;employeur a retenu des \u00e9l\u00e9ments de mani\u00e8re fautive.<\/p>\n<h2>Paris et \u00cele-de-France : les dossiers fr\u00e9quents<\/h2>\n<p>\u00c0 Paris et en \u00cele-de-France, ces litiges concernent souvent les commerciaux, ing\u00e9nieurs commerciaux, business developers, charg\u00e9s d&#8217;affaires, responsables de comptes, mandataires salari\u00e9s, cadres au forfait jours, salari\u00e9s de l&#8217;immobilier, de la tech, du conseil, de la formation, du m\u00e9dico-technique, des services B2B et de la vente complexe.<\/p>\n<p>Le conseil de prud&#8217;hommes comp\u00e9tent d\u00e9pend notamment du lieu de travail, du si\u00e8ge de l&#8217;\u00e9tablissement, du domicile du salari\u00e9 lorsque le travail est r\u00e9alis\u00e9 hors \u00e9tablissement, ou du lieu o\u00f9 l&#8217;engagement a \u00e9t\u00e9 contract\u00e9. Un salari\u00e9 ayant travaill\u00e9 \u00e0 Paris, La D\u00e9fense, Boulogne-Billancourt, Saint-Denis, Cr\u00e9teil, Versailles ou \u00c9vry doit v\u00e9rifier le ressort comp\u00e9tent avant de saisir.<\/p>\n<p>Le dossier doit \u00eatre pr\u00e9par\u00e9 avant la saisine. Il faut un tableau clair, une pi\u00e8ce par client lorsque c&#8217;est possible, les bulletins de paie, le solde de tout compte, les \u00e9changes avec la paie et les \u00e9l\u00e9ments prouvant que l&#8217;employeur d\u00e9tient les donn\u00e9es de calcul.<\/p>\n<h2>Les erreurs \u00e0 \u00e9viter<\/h2>\n<p>La premi\u00e8re erreur consiste \u00e0 r\u00e9clamer une somme sans expliquer le calcul. Un tableau impr\u00e9cis permet \u00e0 l&#8217;employeur de r\u00e9pondre que la demande est inv\u00e9rifiable.<\/p>\n<p>La deuxi\u00e8me erreur consiste \u00e0 oublier les cong\u00e9s pay\u00e9s aff\u00e9rents. Sur plusieurs ann\u00e9es, l&#8217;oubli peut repr\u00e9senter une somme r\u00e9elle.<\/p>\n<p>La troisi\u00e8me erreur consiste \u00e0 laisser passer le temps. Trois ans passent vite, surtout lorsque le salari\u00e9 attend une r\u00e9ponse amiable qui ne vient pas.<\/p>\n<p>La quatri\u00e8me erreur consiste \u00e0 confondre prime et commission. Une condition de pr\u00e9sence peut jouer diff\u00e9remment selon la nature de la r\u00e9mun\u00e9ration variable.<\/p>\n<p>La cinqui\u00e8me erreur consiste \u00e0 signer puis classer le solde de tout compte sans contr\u00f4le.
