L\u2019absence de d\u00e9monstration d\u2019une atteinte \u00e0 l\u2019int\u00e9r\u00eat collectif<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Par un arr\u00eat du 30 avril 2026, la cour d\u2019appel de Douai (chambre 1 section 3, n\u00b024\/02069) a \u00e9t\u00e9 saisie d\u2019un litige relatif \u00e0 la validit\u00e9 de deux r\u00e9solutions adopt\u00e9es lors d\u2019une assembl\u00e9e g\u00e9n\u00e9rale extraordinaire de copropri\u00e9taires tenue le 13 mai 2022. Le copropri\u00e9taire demandeur contestait la r\u00e9solution n\u00b04, qui autorisait un autre copropri\u00e9taire \u00e0 effectuer des travaux, ainsi que la r\u00e9solution n\u00b05, qui modifiait la destination de certains lots pour y installer un cabinet d\u2019ost\u00e9opathie pour animaux. En premi\u00e8re instance, le tribunal judiciaire avait rejet\u00e9 l\u2019int\u00e9gralit\u00e9 de ses demandes. Ce dernier a interjet\u00e9 appel, soutenant que la r\u00e9solution n\u00b04 \u00e9tait nulle faute de communication des conditions essentielles du contrat pr\u00e9vue par l\u2019article 11 du d\u00e9cret du 17 mars 1967, et que la r\u00e9solution n\u00b05 constituait un abus de majorit\u00e9. La cour d\u2019appel a confirm\u00e9 le jugement en toutes ses dispositions, rejetant les demandes d\u2019annulation et les pr\u00e9tentions accessoires. La question de droit centrale \u00e9tait de d\u00e9terminer, d\u2019une part, si l\u2019autorisation de travaux individuels requiert la communication pr\u00e9alable des conditions du contrat au sens de l\u2019article 11 pr\u00e9cit\u00e9, et d\u2019autre part, dans quelles conditions une r\u00e9solution modifiant la destination de l\u2019immeuble peut \u00eatre annul\u00e9e pour abus de majorit\u00e9. La solution retenue par la cour d\u2019appel de Douai repose sur une double qualification : l\u2019absence d\u2019obligation d\u2019informer sur un contrat inexistant s\u2019agissant des travaux individuels, et l\u2019absence de preuve d\u2019un abus de majorit\u00e9.<\/p>\n<h2 id=\"i-la-confirmation-de-la-regularite-de-lautorisation-de-travaux-individuels\">I. La confirmation de la r\u00e9gularit\u00e9 de l\u2019autorisation de travaux individuels<\/h2>\n<p><\/p>\n<h3 id=\"a-labsence-dapplication-de-larticle-11-du-decret-de-1967-aux-autorisations-de-tr\">A. L\u2019absence d\u2019application de l\u2019article 11 du d\u00e9cret de 1967 aux autorisations de travaux<\/h3>\n<p>Le copropri\u00e9taire demandeur invoquait la nullit\u00e9 de la r\u00e9solution n\u00b04 au motif que les conditions essentielles du contrat de travaux ne lui avaient pas \u00e9t\u00e9 communiqu\u00e9es pr\u00e9alablement au vote. Il se fondait sur l\u2019article 11 du d\u00e9cret n\u00b067-223 du 17 mars 1967, qui impose la notification, avec l\u2019ordre du jour, des conditions essentielles du contrat lorsque l\u2019assembl\u00e9e est appel\u00e9e \u00e0 l\u2019approuver. La cour d\u2019appel de Douai a \u00e9cart\u00e9 cette argumentation en distinguant l\u2019acte d\u2019autoriser des travaux de l\u2019acte d\u2019approuver un contrat. Elle rel\u00e8ve que <em>&#8221; la r\u00e9solution n\u00b04 a pour objet d\u2019autoriser un copropri\u00e9taire \u00e0 effectuer des travaux et non d\u2019approuver un contrat de travaux &#8220;<\/em>. D\u00e8s lors, les exigences de l\u2019article 11 ne sont pas applicables. Cette solution est conforme \u00e0 la lettre du texte, qui ne vise que l\u2019approbation d\u2019un contrat, d\u2019un devis ou d\u2019un march\u00e9. En ne confondant pas autorisation et contractualisation, la cour pr\u00e9serve la libert\u00e9 des copropri\u00e9taires d\u2019ex\u00e9cuter des travaux sans formalisme excessif, d\u00e8s lors que l\u2019autorisation elle-m\u00eame est r\u00e9guli\u00e8rement donn\u00e9e.<\/p>\n<h3 id=\"b-linformation-prealable-suffisante-du-coproprietaire-sur-le-projet-de-travaux\">B. L\u2019information pr\u00e9alable suffisante du copropri\u00e9taire sur le projet de travaux<\/h3>\n<p>La cour d\u2019appel ne s\u2019est pas arr\u00eat\u00e9e \u00e0 l\u2019inapplicabilit\u00e9 de l\u2019article 11 ; elle a v\u00e9rifi\u00e9 que le copropri\u00e9taire demandeur avait \u00e9t\u00e9 suffisamment inform\u00e9 du projet. Elle se fonde sur une attestation \u00e9tablissant qu\u2019<em>&#8221; avant la tenue de l\u2019assembl\u00e9e g\u00e9n\u00e9rale, les futurs acqu\u00e9reurs du lot 1 ont expliqu\u00e9 leur projet, certifi\u00e9 qu\u2019ils en supporteraient la charge mais qu\u2019ils ont \u00e9galement remis et expliqu\u00e9 les plans, r\u00e9pondant \u00e0 toutes les interrogations &#8220;<\/em>. Cette information a \u00e9t\u00e9 d\u00e9livr\u00e9e par l\u2019envoi de documents annex\u00e9s \u00e0 la convocation ainsi que lors d\u2019une pr\u00e9-r\u00e9union \u00e0 laquelle l\u2019appelant a assist\u00e9. Ainsi, la cour \u00e9carte la contestation en relevant que le copropri\u00e9taire disposait des \u00e9l\u00e9ments n\u00e9cessaires pour voter en connaissance de cause. Cette approche pragmatique \u00e9vite un formalisme qui aurait pu paralyser les travaux d\u2019int\u00e9r\u00eat priv\u00e9. Elle s\u2019inscrit dans une jurisprudence constante exigeant une information loyale, sans imposer de mode de communication unique.<\/p>\n<h2 id=\"ii-le-rejet-de-la-qualification-dabus-de-majorite\">II. Le rejet de la qualification d\u2019abus de majorit\u00e9<\/h2>\n<p><\/p>\n<h3 id=\"a-la-charge-de-la-preuve-de-labus-incombant-au-coproprietaire-contestataire\">A. La charge de la preuve de l\u2019abus incombant au copropri\u00e9taire contestataire<\/h3>\n<p>La r\u00e9solution n\u00b05, adopt\u00e9e par deux copropri\u00e9taires sur trois, modifiait la destination des locaux pour y permettre l\u2019exercice d\u2019une activit\u00e9 d\u2019ost\u00e9opathie pour animaux. Le demandeur soutenait qu\u2019elle \u00e9tait constitutive d\u2019un abus de majorit\u00e9. La cour d\u2019appel rappelle le principe selon lequel une d\u00e9cision d\u2019assembl\u00e9e g\u00e9n\u00e9rale ne peut \u00eatre annul\u00e9e pour abus que s\u2019il est \u00e9tabli qu\u2019elle <em>&#8221; est contraire aux int\u00e9r\u00eats collectifs des copropri\u00e9taires ou qu\u2019elle a \u00e9t\u00e9 prise dans le seul but de favoriser les int\u00e9r\u00eats personnels des copropri\u00e9taires majoritaires &#8220;<\/em>. Elle pr\u00e9cise que <em>&#8221; il appartient au copropri\u00e9taire qui demande la nullit\u00e9 d\u2019une d\u00e9cision fond\u00e9e sur l\u2019abus de majorit\u00e9 de d\u00e9montrer que celle-ci a \u00e9t\u00e9 adopt\u00e9e sans motif valable &#8220;<\/em>. Cette charge probatoire p\u00e8se donc sur le contestataire. La cour d\u2019appel d\u2019Aix-en-Provence, le 27 mars 2025 (n\u00b021\/15985), a \u00e9galement jug\u00e9 que <em>&#8221; il appartient \u00e0 celui qui invoque l\u2019abus de majorit\u00e9 de le d\u00e9montrer &#8220;<\/em>. En l\u2019esp\u00e8ce, le copropri\u00e9taire n\u2019a fourni aucun \u00e9l\u00e9ment de preuve d\u2019un pr\u00e9judice collectif ou d\u2019un d\u00e9tournement de pouvoir.<\/p>\n<h3 id=\"b-labsence-de-demonstration-dune-atteinte-a-linteret-collectif\">B. L\u2019absence de d\u00e9monstration d\u2019une atteinte \u00e0 l\u2019int\u00e9r\u00eat collectif<\/h3>\n<p>La cour d\u2019appel examine les griefs concrets avanc\u00e9s par le demandeur. Elle observe que la copropri\u00e9t\u00e9 ne compte que trois copropri\u00e9taires et que l\u2019un des votants favorables ne b\u00e9n\u00e9ficie pas de la r\u00e9solution, ce qui \u00e9carte l\u2019hypoth\u00e8se d\u2019un int\u00e9r\u00eat personnel exclusif. Les nuisances sonores ou olfactives invoqu\u00e9es ne sont pas \u00e9tablies, la cour relevant que <em>&#8221; les locaux qui seraient destin\u00e9s \u00e0 \u00eatre un cabinet d\u2019ost\u00e9opathie pour animaux \u00e9taient jusqu\u2019\u00e0 pr\u00e9sent, selon les indications du syndicat des copropri\u00e9taires non contredites, utilis\u00e9s par une soci\u00e9t\u00e9 de b\u00e2timent &#8220;<\/em>. De m\u00eame, la division du lot ou la pluralit\u00e9 de locataires n\u2019est pas d\u00e9montr\u00e9e comme pr\u00e9judiciable \u00e0 l\u2019int\u00e9r\u00eat collectif. La cour de Metz a pu juger, dans une esp\u00e8ce similaire, qu\u2019une modification de destination peut requ\u00e9rir l\u2019unanimit\u00e9 si elle constitue une modification du r\u00e8glement de copropri\u00e9t\u00e9 <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67d3ccb85e1d46608f42d397\" rel=\"nofollow\" target=\"_blank\">(Cour d\u2019appel de Metz, 13 mars 2025, n\u00b023\/02410)<\/a><\/strong>. Mais en l\u2019absence de toute demande d\u2019annulation fond\u00e9e sur l\u2019unanimit\u00e9, la cour d\u2019appel de Douai se concentre sur l\u2019absence d\u2019abus. La r\u00e9solution n\u00b05 \u00e9tant conforme \u00e0 l\u2019int\u00e9r\u00eat collectif faute de nuisance prouv\u00e9e, la demande d\u2019annulation est l\u00e9gitimement rejet\u00e9e.
