La bailleur s&#8217;est d\u00e9sist\u00e9e de ses demandes principales apr\u00e8s le r\u00e8glement de la dette par la locataire. Le juge a d\u00fb trancher la question des d\u00e9pens et des frais irr\u00e9p\u00e9tibles suite \u00e0 ce d\u00e9sistement. Il a condamn\u00e9 la locataire, consid\u00e9r\u00e9e comme partie perdante, \u00e0 supporter les d\u00e9pens et \u00e0 payer une indemnit\u00e9 au titre de l&#8217;article 700 du code de proc\u00e9dure civile.<\/p>\n<p>La qualification juridique du d\u00e9sistement et ses cons\u00e9quences<\/p>\n<p>Le r\u00e9gime proc\u00e9dural du d\u00e9sistement d&#8217;instance<br \/>\nLe juge rappelle les conditions de validit\u00e9 du d\u00e9sistement pr\u00e9vues aux articles 394 et 395 du code de proc\u00e9dure civile. Il constate que le d\u00e9sistement est parfait car le d\u00e9fendeur &#8220;ne formule ni fin de non-recevoir ni d\u00e9fance au fond&#8221; (Motifs). L&#8217;acceptation de la partie adverse n&#8217;est donc pas n\u00e9cessaire pour valider l&#8217;extinction de l&#8217;instance sur les demandes principales.<\/p>\n<p>Les effets du d\u00e9sistement sur les frais de l&#8217;instance<br \/>\nLe d\u00e9sistement emporte des cons\u00e9quences financi\u00e8res distinctes pour les d\u00e9pens et les frais irr\u00e9p\u00e9tibles. Le texte pr\u00e9cise que &#8220;le d\u00e9sistement emporte, sauf convention contraire, soumission de payer les frais de l&#8217;instance \u00e9teinte&#8221; (Motifs). Le juge conserve cependant le pouvoir de statuer sur une demande au titre de l&#8217;article 700 du code de proc\u00e9dure civile, qui vise sp\u00e9cifiquement les frais expos\u00e9s et non compris dans les d\u00e9pens.<\/p>\n<p>La r\u00e9partition des frais malgr\u00e9 l&#8217;extinction de l&#8217;instance<\/p>\n<p>La d\u00e9signation de la partie perdante en cas de d\u00e9sistement<br \/>\nLe juge proc\u00e8de \u00e0 une analyse originale pour identifier la partie perdante malgr\u00e9 l&#8217;absence de jugement sur le fond. Il estime que la locataire est &#8220;partie perdante en ce que la r\u00e9siliation du bail par l\u2019effet du commandement de payer demeur\u00e9 infructueux est acquise au moment de la d\u00e9livrance de l\u2019assignation&#8221; (Motifs). Cette qualification justifie la condamnation aux d\u00e9pens sur le fondement de l&#8217;article 696 du code de proc\u00e9dure civile.<\/p>\n<p>L&#8217;application \u00e9quitable de l&#8217;article 700 du code de proc\u00e9dure civile<br \/>\nLe juge exerce son pouvoir d&#8217;appr\u00e9ciation pour fixer l&#8217;indemnit\u00e9 au titre des frais non compris dans les d\u00e9pens. Il se r\u00e9f\u00e8re aux dispositions de l&#8217;article 700 qui lui permettent de tenir compte &#8220;de l&#8217;\u00e9quit\u00e9 ou de la situation \u00e9conomique de la partie condamn\u00e9e&#8221; (Motifs). En l&#8217;esp\u00e8ce, il alloue une somme mod\u00e9r\u00e9e de deux cents euros \u00e0 la bailleur, manifestement inf\u00e9rieure \u00e0 ce qui \u00e9tait demand\u00e9.<\/p>\n<p>Cette d\u00e9cision illustre la persistance de la comp\u00e9tence du juge apr\u00e8s un d\u00e9sistement. Elle confirme que l&#8217;extinction de l&#8217;instance sur le fond ne prive pas le juge de son pouvoir pour r\u00e9gler les cons\u00e9quences financi\u00e8res du proc\u00e8s. La solution rappelle que la qualification de partie perdante peut d\u00e9couler de la situation de fait existant au moment de l&#8217;introduction de l&#8217;instance.<\/p>\n<p>La port\u00e9e de l&#8217;ordonnance r\u00e9side dans l&#8217;interpr\u00e9tation souple de la notion de partie perdante. Le juge ne se limite pas \u00e0 un formalisme proc\u00e9dural mais examine la r\u00e9alit\u00e9 des positions respectives.
