Le bail de l&#8217;occupant initial n&#8217;a pas \u00e9t\u00e9 renouvel\u00e9 \u00e0 son terme. Un nouveau preneur, titulaire d&#8217;un bail post\u00e9rieur, demande l&#8217;expulsion pour trouble manifestement illicite. La cour infirme l&#8217;ordonnance de premi\u00e8re instance et ordonne l&#8217;expulsion de l&#8217;occupant sans titre ainsi que le versement d&#8217;une provision.<\/p>\n<p>I. La recevabilit\u00e9 de l&#8217;action en expulsion affirm\u00e9e<\/p>\n<p>La cour \u00e9carte les fins de non-recevoir oppos\u00e9es par l&#8217;occupant \u00e9vinc\u00e9, confirmant ainsi l&#8217;acc\u00e8s au juge pour le nouveau preneur.<\/p>\n<p><em>La qualit\u00e9 \u00e0 agir du locataire titulaire d&#8217;un bail<\/em><\/p>\n<p>L&#8217;occupant soutenait que l&#8217;action \u00e9tait r\u00e9serv\u00e9e aux seuls preneurs d\u00e9tenant un mandat d&#8217;op\u00e9rateur de t\u00e9l\u00e9phonie. La cour rejette cette interpr\u00e9tation restrictive des textes applicables. Elle rappelle que l&#8217;article L 34-9-1-1 du code des postes et des communications \u00e9lectroniques n&#8217;impose pas cette condition pour la signature du bail. &#8220;Cet article impose seulement sa communication au maire, au titre de son information&#8221; (Motifs, point 1). La sanction du d\u00e9faut de mandat est uniquement l&#8217;impossibilit\u00e9 de r\u00e9aliser des travaux. Le droit de jouissance issu du contrat conf\u00e8re donc une qualit\u00e9 \u00e0 agir pour expulser un occupant sans droit.<\/p>\n<p><em>L&#8217;int\u00e9r\u00eat \u00e0 agir ind\u00e9pendant de l&#8217;exploitation future<\/em><\/p>\n<p>L&#8217;occupant arguait \u00e9galement d&#8217;un d\u00e9faut d&#8217;int\u00e9r\u00eat, le preneur n&#8217;ayant pas initi\u00e9 de d\u00e9marches pour exploiter le site. La cour estime cet argument sans pertinence pour l&#8217;action en expulsion. L&#8217;int\u00e9r\u00eat \u00e0 agir na\u00eet de la privation actuelle de jouissance. &#8220;Le fait que la SAS Valocime soit ou non en mesure d&#8217;exploiter la parcelle est sans int\u00e9r\u00eat pour la d\u00e9termination de son int\u00e9r\u00eat \u00e0 agir&#8221; (Motifs, point 1). L&#8217;int\u00e9r\u00eat l\u00e9gitime est \u00e9tabli par l&#8217;occupation illicite subie, ind\u00e9pendamment de l&#8217;usage futur des lieux.<\/p>\n<p>II. Le trouble manifestement illicite caract\u00e9ris\u00e9 et ses cons\u00e9quences<\/p>\n<p>La cour proc\u00e8de \u00e0 la qualification du trouble et en d\u00e9duit les mesures appropri\u00e9es pour y mettre fin, en limitant leur \u00e9tendue.<\/p>\n<p><em>La caract\u00e9risation du trouble par l&#8217;occupation sans titre<\/em><\/p>\n<p>La cour d\u00e9finit le trouble manifestement illicite comme une violation \u00e9vidente de la r\u00e8gle de droit. Elle le reconna\u00eet en l&#8217;esp\u00e8ce du fait du maintien dans les lieux apr\u00e8s l&#8217;\u00e9ch\u00e9ance du bail. &#8220;L&#8217;occupation sans droit ni titre du bien d&#8217;autrui constitue un trouble manifestement illicite&#8221; (Motifs, point 2). Elle rejette l&#8217;argument tir\u00e9 de l&#8217;absence de mandat op\u00e9rateur, qui ne remet pas en cause la validit\u00e9 du titre du nouveau preneur. La balance des int\u00e9r\u00eats ne saurait privil\u00e9gier l&#8217;int\u00e9r\u00eat g\u00e9n\u00e9ral invoqu\u00e9 par l&#8217;occupant, chaque partie d\u00e9fendant ses int\u00e9r\u00eats priv\u00e9s.<\/p>\n<p><em>Les mesures ordonn\u00e9es pour faire cesser le trouble<\/em><\/p>\n<p>La cour ordonne l&#8217;expulsion de l&#8217;occupant et de tous ceux tenant leurs droits de lui. Elle pr\u00e9cise que les op\u00e9rateurs mobiles, non parties \u00e0 l&#8217;instance, n&#8217;ont pas de titre opposable au propri\u00e9taire. Elle limite cependant l&#8217;obligation de remise en \u00e9tat aux seuls \u00e9l\u00e9ments d\u00e9tachables, conform\u00e9ment aux termes du bail initial. &#8220;La lettre de non-renouvellement du droit au bail ne comprenant aucune demande de r\u00e9tablissement des lieux en l&#8217;\u00e9tat primitif&#8221; (Motifs, point 3). Un d\u00e9lai de deux mois est accord\u00e9, assorti d&#8217;une astreinte, et une provision est allou\u00e9e au preneur pour le loyer pay\u00e9 sans contrepartie.<\/p>\n<p>Cette d\u00e9cision rappelle avec fermet\u00e9 l&#8217;intangibilit\u00e9 du droit de jouissance issu d&#8217;un titre contractuel. Elle affirme que l&#8217;occupation sans droit apr\u00e8s l&#8217;\u00e9ch\u00e9ance d&#8217;un bail constitue un trouble manifestement illicite justifiant une expulsion en r\u00e9f\u00e9r\u00e9. La cour op\u00e8re une distinction nette entre les conditions de validit\u00e9 du bail et les obligations administratives ult\u00e9rieures, prot\u00e9geant ainsi la s\u00e9curit\u00e9 juridique des conventions.
