Le bailleur social demandait la r\u00e9siliation d\u2019un bail pour d\u00e9faut de paiement et l\u2019expulsion du locataire. Le juge, statuant par d\u00e9faut, a accueilli la demande principale mais en a limit\u00e9 les modalit\u00e9s d\u2019ex\u00e9cution. La d\u00e9cision aborde la r\u00e9solution du bail et le r\u00e9gime probatoire de la dette, tout en \u00e9cartant l\u2019ex\u00e9cution provisoire.<\/p>\n<p>La d\u00e9termination du d\u00e9lai de gr\u00e2ce applicable au bail<\/p>\n<p>Le juge pr\u00e9cise d\u2019abord le r\u00e9gime l\u00e9gal de la clause r\u00e9solutoire pour d\u00e9faut de paiement. Il rappelle que la loi du 6 juillet 1989 impose une clause de r\u00e9siliation de plein droit. Cette clause ne produit effet que six semaines apr\u00e8s un commandement de payer demeur\u00e9 infructueux. Le texte applique ici une jurisprudence constante sur le principe de non-r\u00e9troactivit\u00e9. &#8220;Cependant, la loi du 27 juillet 2023 ne comprend aucune disposition d\u00e9rogeant \u00e0 l&#8217;article 2 du code civil, selon lequel la loi ne dispose que pour l&#8217;avenir et n&#8217;a point d&#8217;effet r\u00e9troactif&#8221; (Motifs, 1.2). Le contrat, conclu en 2012, reste donc soumis \u00e0 l\u2019ancien d\u00e9lai de deux mois. Cette solution confirme la s\u00e9curit\u00e9 juridique attach\u00e9e aux contrats en cours. Elle emp\u00eache toute application r\u00e9troactive d\u2019une loi nouvelle modifiant les d\u00e9lais au d\u00e9triment d\u2019une partie.<\/p>\n<p>La v\u00e9rification des conditions de la r\u00e9solution<\/p>\n<p>Le juge v\u00e9rifie ensuite la r\u00e9union des conditions de la r\u00e9solution. Le bailleur a justifi\u00e9 de la signification d\u2019un commandement r\u00e9gulier. L\u2019historique des versements d\u00e9montre que la dette vis\u00e9e n\u2019a pas \u00e9t\u00e9 apur\u00e9e dans le d\u00e9lai de deux mois. Aucun plan d\u2019apurement n\u2019a \u00e9t\u00e9 conclu entre les parties dans ce d\u00e9lai. Le juge en d\u00e9duit que les conditions de la clause r\u00e9solutoire sont r\u00e9unies depuis une date pr\u00e9cise. Il ordonne donc la lib\u00e9ration des lieux et autorise l\u2019expulsion en cas de refus. Toutefois, il rappelle le d\u00e9lai de deux mois apr\u00e8s commandement de quitter les lieux. Cette analyse rigoureuse prot\u00e8ge le locataire contre une r\u00e9solution abusive. Elle garantit le respect des formalit\u00e9s protectrices \u00e9dict\u00e9es par la loi.<\/p>\n<p>La preuve de la dette locative et ses cons\u00e9quences<\/p>\n<p>Sur la demande en paiement, le juge applique les principes g\u00e9n\u00e9raux de la charge de la preuve. Il cite l\u2019article 1353 du code civil pour fonder son raisonnement. &#8220;Celui qui r\u00e9clame l&#8217;ex\u00e9cution d&#8217;une obligation doit la prouver tandis que celui qui se pr\u00e9tend lib\u00e9r\u00e9 doit justifier le paiement&#8221; (Motifs, 2). Le bailleur a produit un d\u00e9compte d\u00e9taill\u00e9 de la cr\u00e9ance arr\u00eat\u00e9e \u00e0 une date certaine. Le locataire d\u00e9faillant n\u2019a apport\u00e9 aucun \u00e9l\u00e9ment pour contester ce montant. Le juge condamne donc au paiement de la somme due avec des int\u00e9r\u00eats diff\u00e9renci\u00e9s. Il ordonne \u00e9galement le paiement d\u2019une indemnit\u00e9 d\u2019occupation post-r\u00e9siliation. Cette application stricte de la charge de la preuve est favorable au cr\u00e9ancier diligent. Elle souligne que le d\u00e9faut de contestation vaut acceptation des \u00e9l\u00e9ments produits.<\/p>\n<p>La modulation des effets de la d\u00e9cision<\/p>\n<p>Enfin, le juge use de son pouvoir d\u2019appr\u00e9ciation pour mod\u00e9rer les effets de sa d\u00e9cision. Il accorde une somme au titre de l\u2019article 700 du code de proc\u00e9dure civile en tenant compte de l\u2019\u00e9quit\u00e9. Surtout, il \u00e9carte l\u2019ex\u00e9cution provisoire de droit pr\u00e9vue par l\u2019article 514. Il estime que cette ex\u00e9cution serait incompatible avec la nature de l\u2019affaire. Elle entra\u00eenerait des cons\u00e9quences graves et irr\u00e9versibles avant un \u00e9ventuel appel. Cette mesure prive de r\u00e9alit\u00e9 le droit au double degr\u00e9 de juridiction. Cette d\u00e9cision temp\u00e8re la s\u00e9v\u00e9rit\u00e9 du jugement en faveur du locataire absent. Elle pr\u00e9serve son droit \u00e0 un recours effectif malgr\u00e9 son d\u00e9faut de comparution.<\/p>\n<p>Cette d\u00e9cision illustre l\u2019\u00e9quilibre recherch\u00e9 par le juge des contentieux de la protection. Elle applique avec rigueur le droit des bails et la charge de la preuve au profit du bailleur. Mais elle neutralise l\u2019effet imm\u00e9diat de la d\u00e9cision pour prot\u00e9ger les droits de la d\u00e9fense.
