Le locataire ne compara\u00eet pas, conduisant \u00e0 un jugement r\u00e9put\u00e9 contradictoire. La juridiction statue sur la r\u00e9gularit\u00e9, la recevabilit\u00e9 et le bien-fond\u00e9 de la demande du bailleur social. Elle constate la r\u00e9siliation du bail, condamne le locataire \u00e0 payer une dette locative et une indemnit\u00e9 d&#8217;occupation, et autorise l&#8217;acc\u00e8s aux lieux pour des travaux. L&#8217;ex\u00e9cution provisoire de la d\u00e9cision est retenue.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale et le fondement de la r\u00e9siliation<\/p>\n<p>Les conditions de recevabilit\u00e9 de l&#8217;action en r\u00e9siliation. Le bailleur social d\u00e9montre le strict respect des formalit\u00e9s pr\u00e9alables exig\u00e9es par la loi. Il justifie avoir notifi\u00e9 l&#8217;assignation au repr\u00e9sentant de l&#8217;\u00c9tat plus de six semaines avant l&#8217;audience. Il \u00e9tablit \u00e9galement avoir saisi la commission de coordination des actions pr\u00e9vention des expulsions deux mois avant l&#8217;assignation. Son action est donc d\u00e9clar\u00e9e recevable au regard des dispositions de l&#8217;article 24 de la loi du 6 juillet 1989. Ce contr\u00f4le rigoureux assure la protection du locataire malgr\u00e9 son absence \u00e0 l&#8217;instance.<\/p>\n<p>L&#8217;application stricte du r\u00e9gime de la clause r\u00e9solutoire l\u00e9gale. Le juge rappelle le cadre l\u00e9gal issu de la r\u00e9forme de 2023. &#8220;Aux termes de l&#8217;article 24 de la loi du 6 juillet 1989 modifi\u00e9 par la loi du 27 juillet 2023, tout contrat de bail d&#8217;habitation contient une clause pr\u00e9voyant la r\u00e9siliation de plein droit du contrat de location pour d\u00e9faut de paiement du loyer ou des charges aux termes convenus ou pour non-versement du d\u00e9p\u00f4t de garantie&#8221; (Motifs, 1.2). Cette clause ne produit effet que six semaines apr\u00e8s un commandement demeur\u00e9 infructueux. Les conditions \u00e9tant r\u00e9unies depuis le 23 janvier 2025, la r\u00e9siliation est constat\u00e9e. Cette application illustre la mise en \u0153uvre du nouveau d\u00e9lai de six semaines, plus protecteur que le d\u00e9lai d&#8217;un mois applicable en mati\u00e8re commerciale. &#8220;Aux termes des dispositions du premier alin\u00e9a de l&#8217;article L. 145-41 du code de commerce, toute clause ins\u00e9r\u00e9e dans le bail pr\u00e9voyant la r\u00e9siliation de plein droit ne produit effet qu&#8217;un mois apr\u00e8s un commandement demeur\u00e9 infructueux&#8221; (Tribunal judiciaire de Paris, le 14 mai 2025, n\u00b022\/11698). Le juge ordonne l&#8217;expulsion mais rappelle le d\u00e9lai de deux mois apr\u00e8s commandement de quitter les lieux, pr\u00e9servant ainsi les garanties proc\u00e9durales.<\/p>\n<p>Les cons\u00e9quences p\u00e9cuniaires de la r\u00e9siliation et les mesures accessoires<\/p>\n<p>La liquidation de la cr\u00e9ance dans le respect du principe de contradiction. Le juge applique les r\u00e8gles de preuve des obligations. &#8220;Aux termes de l&#8217;article 1353 du code civil, celui qui r\u00e9clame l&#8217;ex\u00e9cution d&#8217;une obligation doit la prouver tandis que celui qui se pr\u00e9tend lib\u00e9r\u00e9 doit justifier le paiement&#8221; (Motifs, 2). Le bailleur produit un d\u00e9compte mais, en l&#8217;absence de d\u00e9fenseur, le principe de contradiction impose de limiter la condamnation au montant de l&#8217;assignation. Le locataire est donc condamn\u00e9 \u00e0 payer la somme de 6 626,20 euros, avec int\u00e9r\u00eats. Cette solution d\u00e9montre l&#8217;adaptation des r\u00e8gles de fond au contexte proc\u00e9dural du d\u00e9faut de comparution, \u00e9vitant une condamnation par d\u00e9faut excessive.<\/p>\n<p>L&#8217;octroi de mesures accessoires justifi\u00e9es par l&#8217;urgence et la n\u00e9cessit\u00e9. La juridiction fixe une indemnit\u00e9 d&#8217;occupation \u00e9gale au dernier loyer et charges, payable jusqu&#8217;\u00e0 la lib\u00e9ration effective des lieux. Surtout, elle autorise le bailleur \u00e0 acc\u00e9der au logement pour effectuer un traitement contre les nuisibles. Cette d\u00e9cision s&#8217;appuie sur l&#8217;article 7e de la loi de 1989 et sur la preuve de l&#8217;infestation et de l&#8217;absence du locataire. Elle concilie le droit du locataire \u00e0 la jouissance paisible et la n\u00e9cessit\u00e9 de pr\u00e9server l&#8217;immeuble. Enfin, le juge retient l&#8217;ex\u00e9cution provisoire de droit, consid\u00e9rant l&#8217;anciennet\u00e9 de la dette et l&#8217;absence de reprise de paiement.
