Le preneur, d\u00e9faillant, n\u2019a pas honor\u00e9 le paiement de sept loyers cons\u00e9cutifs. La soci\u00e9t\u00e9 bailleuse sollicite le r\u00e8glement des loyers impay\u00e9s, une indemnit\u00e9 de r\u00e9siliation incluant les loyers \u00e0 \u00e9choir, une indemnit\u00e9 forfaitaire de recouvrement et une indemnit\u00e9 de non-restitution du bien. Le tribunal fait droit \u00e0 l\u2019ensemble des demandes de la cr\u00e9anci\u00e8re, condamnant le locataire d\u00e9faillant \u00e0 payer les sommes r\u00e9clam\u00e9es avec int\u00e9r\u00eats.<\/p>\n<p>Le contr\u00f4le judiciaire des clauses contractuelles<\/p>\n<p>Le juge op\u00e8re un contr\u00f4le minutieux des stipulations contractuelles invoqu\u00e9es. Il v\u00e9rifie d\u2019abord le bien-fond\u00e9 de la r\u00e9siliation en se fondant sur les termes du contrat. Le bailleur peut r\u00e9silier le contrat \u00e0 effet imm\u00e9diat par courrier recommand\u00e9 en cas de retard de paiement de trois loyers. &#8220;Au regard des pi\u00e8ces produites, sept loyers mensuels cons\u00e9cutifs n\u2019ont pas \u00e9t\u00e9 vers\u00e9s, \u00e0 savoir ceux dus du mois d\u2019avril 2020 au mois d\u2019octobre 2020, de sorte que la SAS GRENKE LOCATION \u00e9tait bien fond\u00e9e \u00e0 r\u00e9silier le contrat avec effet imm\u00e9diat.&#8221; (Motifs de la d\u00e9cision). La gravit\u00e9 du manquement, caract\u00e9ris\u00e9 par une inex\u00e9cution prolong\u00e9e, justifie pleinement la rupture anticip\u00e9e. Le juge constate ensuite l\u2019absence de tout \u00e9l\u00e9ment justificatif produit par le d\u00e9biteur d\u00e9faillant pour se lib\u00e9rer de son obligation. Cette approche rappelle que le cr\u00e9ancier doit prouver l\u2019obligation, mais que le d\u00e9biteur doit justifier de son extinction. La d\u00e9cision affirme ainsi le principe de l\u2019autorit\u00e9 de la convention l\u00e9galement form\u00e9e, tout en en v\u00e9rifiant scrupuleusement les conditions d\u2019application.<\/p>\n<p>Le tribunal proc\u00e8de ensuite \u00e0 l\u2019examen d\u00e9taill\u00e9 des indemnit\u00e9s stipul\u00e9es au contrat. Il applique litt\u00e9ralement la clause pr\u00e9voyant le paiement des loyers \u00e0 \u00e9choir en cas de r\u00e9siliation. &#8220;Par cons\u00e9quent, Monsieur [W] [H] devra \u00eatre condamn\u00e9 \u00e0 verser \u00e0 la SAS GRENKE LOCATION, au titre de l\u2019indemnit\u00e9 compos\u00e9e des loyers \u00e0 \u00e9choir du 1er novembre 2020 au 1er janvier 2023 la somme de 2.500 \u20ac&#8221; (Motifs de la d\u00e9cision). Le juge ne proc\u00e8de pas ici \u00e0 un contr\u00f4le de proportionnalit\u00e9 de cette clause. Cette solution contraste avec une jurisprudence r\u00e9cente qui soumet ce type de stipulation \u00e0 un contr\u00f4le de l\u2019\u00e9quilibre contractuel. &#8220;La clause qui pr\u00e9voit une indemnit\u00e9, du fait de l&#8217;inex\u00e9cution des obligations du locataire, comprenant le versement des loyers \u00e0 \u00e9choir, major\u00e9 d&#8217;une p\u00e9nalit\u00e9 constitue une clause p\u00e9nale. Le montant de l&#8217;indemnit\u00e9 de r\u00e9siliation doit alors s&#8217;analyser au regard de l&#8217;\u00e9quilibre financier du contrat. Il appartient au juge de rechercher si la clause est manifestement excessive.&#8221; (Cour d&#8217;appel de Paris, le 6 mai 2024, n\u00b022\/10832). L\u2019absence de discussion sur ce point dans les motifs r\u00e9v\u00e8le une application stricte du contrat, sans modulation par l\u2019\u00e9quit\u00e9.<\/p>\n<p>Les cons\u00e9quences p\u00e9cuniaires de l\u2019inex\u00e9cution<\/p>\n<p>La d\u00e9cision d\u00e9taille avec pr\u00e9cision le calcul de l\u2019indemnit\u00e9 de non-restitution, d\u00e9montrant une application arithm\u00e9tique de la clause contractuelle. Le juge se r\u00e9f\u00e8re aux dispositions de l\u2019article 11 des conditions g\u00e9n\u00e9rales pour effectuer le calcul. &#8220;Ainsi, l\u2019indemnit\u00e9 est la suivante : (3.114,90 \u20ac HT \/ 36 mois X 27 mois) X 1,1 = 2.569,79 \u20ac.&#8221; (Motifs de la d\u00e9cision). Cette indemnit\u00e9, distincte du paiement des loyers \u00e0 \u00e9choir, cumule les effets financiers de la r\u00e9siliation pour le preneur d\u00e9faillant. Elle vise \u00e0 compenser la privation de jouissance du bien pour le bailleur. Le juge valide ce cumul sans s\u2019interroger sur un \u00e9ventuel enrichissement sans cause ou disproportion. La solution adopt\u00e9e garantit une r\u00e9paration int\u00e9grale du pr\u00e9judice subi par le cr\u00e9ancier, tel que contractuellement d\u00e9fini. Elle t\u00e9moigne d\u2019une interpr\u00e9tation litt\u00e9rale des stipulations, privil\u00e9giant la s\u00e9curit\u00e9 juridique et la force obligatoire du contrat.<\/p>\n<p>Le jugement ordonne \u00e9galement des mesures accessoires renfor\u00e7ant la position du cr\u00e9ancier. Il accorde l\u2019indemnit\u00e9 forfaitaire pour frais de recouvrement pr\u00e9vue par le code de commerce. &#8220;Il sera fait droit \u00e0 la demande de la SAS GRENKE LOCATION sur ce point, celle-ci ayant d\u00e9montr\u00e9 le retard de paiement&#8221; (Motifs de la d\u00e9cision). Il condamne en outre le d\u00e9biteur aux d\u00e9pens et \u00e0 une somme au titre de l\u2019article 700 du code de proc\u00e9dure civile. Enfin, il ordonne la capitalisation des int\u00e9r\u00eats et rappelle l\u2019ex\u00e9cution provisoire de la d\u00e9cision. Cet ensemble de mesures cr\u00e9e un dispositif complet et dissuasif contre l\u2019inex\u00e9cution contractuelle. La d\u00e9cision assure ainsi une protection efficace des int\u00e9r\u00eats du bailleur, en alignant les cons\u00e9quences de la rupture sur la volont\u00e9 des parties telle qu\u2019exprim\u00e9e dans le contrat.
