Le juge de la mise en \u00e9tat, statuant par ordonnance du 4 d\u00e9cembre 2025, examine une exception de prescription. Un client assigne son ancien avocat pour responsabilit\u00e9 professionnelle suite \u00e0 une proc\u00e9dure close en octobre 2018. Le conseil invoque la prescription quinquennale de l’article 2225 du code civil. Le juge, saisi apr\u00e8s la d\u00e9signation du juge de la mise en \u00e9tat, rejette l’exception au motif que la demande d’aide juridictionnelle a interrompu le d\u00e9lai.<\/p>\n

La comp\u00e9tence exclusive du juge de la mise en \u00e9tat pour statuer sur les exceptions<\/p>\n

Le juge rappelle son pouvoir pour trancher les incidents mettant fin \u00e0 l’instance. L’article 789 du code de proc\u00e9dure civile dispose notamment que lorsque la demande est pr\u00e9sent\u00e9e post\u00e9rieurement \u00e0 sa d\u00e9signation, le juge de la mise en \u00e9tat est, jusqu’\u00e0 son dessaisissement, seul comp\u00e9tent, \u00e0 l’exclusion de toute autre formation du tribunal, pour statuer notamment sur les exceptions de proc\u00e9dure et sur les incidents mettant fin \u00e0 l’instance. Cette attribution confirme l’autorit\u00e9 du magistrat charg\u00e9 de l’instruction sur les questions pr\u00e9judicielles. Elle assure une gestion efficace et coh\u00e9rente de la proc\u00e9dure avant l’audience de plaidoirie. Cette comp\u00e9tence sp\u00e9ciale \u00e9vite les dilations proc\u00e9durales et les conflits de juridiction internes au tribunal. Elle renforce ainsi l’\u00e9conomie des moyens et la c\u00e9l\u00e9rit\u00e9 de la justice.<\/p>\n

L’interruption de la prescription par la demande d’aide juridictionnelle<\/p>\n

Le juge applique le r\u00e9gime d\u00e9rogatoire de la prescription des actions contre les auxiliaires de justice. L\u2019article 2225 du code civil dispose que l’action en responsabilit\u00e9 dirig\u00e9e contre les personnes ayant repr\u00e9sent\u00e9 ou assist\u00e9 les parties en justice, y compris \u00e0 raison de la perte ou de la destruction des pi\u00e8ces qui leur ont \u00e9t\u00e9 confi\u00e9es, se prescrit par cinq ans \u00e0 compter de la fin de leur mission. Ce point de d\u00e9part objectif, indiff\u00e9rent \u00e0 la connaissance du dommage, est une r\u00e8gle sp\u00e9ciale. Comme le rel\u00e8ve une jurisprudence, “la r\u00e9alisation et la connaissance du dommage sont indiff\u00e9rents ; seule compte la fin de la mission” (Cour d’appel, le 18 f\u00e9vrier 2025, n\u00b024\/09322). Le d\u00e9lai a donc commenc\u00e9 \u00e0 courir le 23 octobre 2018, date de l’arr\u00eat closant la mission.<\/p>\n

Le juge constate ensuite l’interruption du d\u00e9lai par la demande d’aide juridictionnelle. L\u2019article 43 du d\u00e9cret n\u00b0 2020-1717 du 28 d\u00e9cembre 2020 dispose que l’action est r\u00e9put\u00e9e intent\u00e9e dans le d\u00e9lai si la demande d’aide juridictionnelle s’y rapportant est d\u00e9pos\u00e9e avant son expiration. La demande fut pr\u00e9sent\u00e9e le 30 ao\u00fbt 2023, avant le terme du d\u00e9lai quinquennal. L’action au fond fut ensuite introduite dans le nouveau d\u00e9lai ouvert par l’admission. Cette solution est conforme \u00e0 la jurisprudence qui estime que “cette demande d’aide juridictionnelle a interrompu le d\u00e9lai de prescription de l’action” (Cour d’appel, le 5 mars 2025, n\u00b024\/09747). L’interruption prot\u00e8ge ainsi l’acc\u00e8s au juge pour les justiciables les plus d\u00e9munis.
