Apr\u00e8s l&#8217;expiration du bail, les locataires refusant de quitter les lieux, les bailleurs saisissent la justice pour obtenir leur expulsion. La juridiction examine la r\u00e9gularit\u00e9 formelle et substantielle du cong\u00e9 ainsi que la demande de d\u00e9lais des occupants. Elle ordonne finalement la lib\u00e9ration des locaux et condamne les locataires au paiement d&#8217;une indemnit\u00e9 d&#8217;occupation.<\/p>\n<p>La validation du cong\u00e9 pour reprise<\/p>\n<p>La d\u00e9cision v\u00e9rifie d&#8217;abord le strict respect des conditions l\u00e9gales de forme. Le cong\u00e9 notifi\u00e9 par acte de commissaire de justice a \u00e9t\u00e9 d\u00e9livr\u00e9 plus de six mois avant le terme du bail. Le d\u00e9lai de pr\u00e9avis est donc int\u00e9gralement respect\u00e9 conform\u00e9ment \u00e0 l&#8217;article 15-I de la loi du 6 juillet 1989. La date de prise d&#8217;effet du bail, fix\u00e9e au contrat, pr\u00e9vaut sur la prise de possession effective pour calculer le terme. Cette rigueur formelle assure la s\u00e9curit\u00e9 juridique des notifications et pr\u00e9serve les droits du locataire.<\/p>\n<p>Le juge contr\u00f4le ensuite la r\u00e9alit\u00e9 et le s\u00e9rieux du motif de reprise invoqu\u00e9. Le cong\u00e9 doit indiquer pr\u00e9cis\u00e9ment l&#8217;identit\u00e9 du b\u00e9n\u00e9ficiaire et le lien de parent\u00e9 avec le bailleur. En l&#8217;esp\u00e8ce, le cong\u00e9 mentionne que la reprise est destin\u00e9e \u00e0 la fille de l&#8217;usufruiti\u00e8re, elle-m\u00eame nue-propri\u00e9taire. &#8220;Le cong\u00e9 d\u00e9livr\u00e9 le 31 juillet 2024 mentionne qu&#8217;il a pour objet l&#8217;exercice du droit de reprise des lieux lou\u00e9s pour les faire habiter par Madame [Z] [C] &#8216;nue-propri\u00e9taire et fille de Madame [H] [B] [S] divorc\u00e9e [C], usufruiti\u00e8re'&#8221; (Motifs de la d\u00e9cision). La jurisprudence rappelle que la preuve du caract\u00e8re s\u00e9rieux n&#8217;est \u00e0 apporter qu&#8217;en cas de contestation. &#8220;Il appartient seulement au bailleur, en cas de contestation de la validit\u00e9 du cong\u00e9 par le locataire, de justifier le caract\u00e8re r\u00e9el et s\u00e9rieux de la reprise&#8221; (Cour d&#8217;appel de Paris, le 11 f\u00e9vrier 2025, n\u00b022\/15705). Le motif non contest\u00e9 est donc retenu.<\/p>\n<p>Les cons\u00e9quences de l&#8217;occupation apr\u00e8s terme<\/p>\n<p>Le refus de lib\u00e9rer les lieux \u00e0 l&#8217;\u00e9ch\u00e9ance du bail constitue une faute civile. Il cause un pr\u00e9judice certain au propri\u00e9taire, priv\u00e9 de la jouissance de son bien. Le juge condamne donc les occupants au paiement d&#8217;une indemnit\u00e9 d&#8217;occupation. Celle-ci est fix\u00e9e au montant du dernier loyer et charges, conform\u00e9ment \u00e0 la demande des bailleurs. Elle est due jusqu&#8217;\u00e0 la remise effective des cl\u00e9s. Son caract\u00e8re indemnitaire et compensatoire est r\u00e9affirm\u00e9. La condamnation est rendue solidaire en application d&#8217;une clause du bail, la solidarit\u00e9 ne se pr\u00e9sumant pas.<\/p>\n<p>La demande de d\u00e9lais pour quitter les lieux est rejet\u00e9e apr\u00e8s une appr\u00e9ciation in concreto. Le juge p\u00e8se les situations respectives des parties et les diligences des locataires. Ces derniers ont multipli\u00e9 les d\u00e9marches de relogement mais justifient de capacit\u00e9s financi\u00e8res limit\u00e9es. Toutefois, l&#8217;un des occupants peut envisager un achat immobilier. Les bailleurs, dont la b\u00e9n\u00e9ficiaire de la reprise est au ch\u00f4mage, ont un besoin l\u00e9gitime. &#8220;Il ne revient pas aux bailleresses d&#8217;attendre davantage qu&#8217;ils trouvent un bien \u00e0 leur convenance&#8221; (Motifs de la d\u00e9cision). Les occupants ont d\u00e9j\u00e0 b\u00e9n\u00e9fici\u00e9 d&#8217;un d\u00e9lai de fait.
