La d\u00e9cision intervient apr\u00e8s l\u2019inex\u00e9cution d\u2019une injonction prononc\u00e9e en r\u00e9f\u00e9r\u00e9. Le juge applique les r\u00e8gles de liquidation des astreintes et statue sur les frais irr\u00e9p\u00e9tibles. Il rappelle enfin le principe de l\u2019ex\u00e9cution provisoire de sa d\u00e9cision.<\/p>\n<p>La comp\u00e9tence exclusive du juge de l\u2019ex\u00e9cution pour liquider l\u2019astreinte<\/p>\n<p>Le juge fonde sa comp\u00e9tence sur une interpr\u00e9tation stricte des textes applicables. Il rappelle que le juge de l\u2019ex\u00e9cution est le comp\u00e9tent de droit commun pour cette mission. &#8220;L&#8217;astreinte, m\u00eame d\u00e9finitive, est liquid\u00e9e par le juge de l&#8217;ex\u00e9cution, sauf si le juge qui l&#8217;a ordonn\u00e9e reste saisi de l&#8217;affaire ou s&#8217;en est express\u00e9ment r\u00e9serv\u00e9 le pouvoir&#8221; (Motifs de la d\u00e9cision). Cette solution consacre une r\u00e9partition claire des r\u00f4les entre le juge du fond et le juge de l\u2019ex\u00e9cution. Elle \u00e9vite ainsi les conflits de comp\u00e9tence et garantit une sp\u00e9cialisation de la liquidation.<\/p>\n<p>La liquidation op\u00e9r\u00e9e respecte les principes directeurs \u00e9nonc\u00e9s par la loi. Le juge constate simplement le d\u00e9faut d\u2019ex\u00e9cution pendant la p\u00e9riode fix\u00e9e. Il liquide l\u2019astreinte pour son montant int\u00e9gral sans discussion sur le comportement du d\u00e9biteur. Cette approche stricte s\u2019explique par l\u2019absence de cause \u00e9trang\u00e8re invoqu\u00e9e ou prouv\u00e9e. Elle assure une effectivit\u00e9 certaine \u00e0 la contrainte initialement prononc\u00e9e par le juge des r\u00e9f\u00e9r\u00e9s.<\/p>\n<p>Le refus de prononcer une nouvelle astreinte et l\u2019allocation de frais<\/p>\n<p>Le juge \u00e9carte la demande de fixation d\u2019une astreinte compl\u00e9mentaire. Il estime que le cr\u00e9ancier dispose d\u00e9j\u00e0 d\u2019un titre ex\u00e9cutoire pour la m\u00eame obligation. Condamner \u00e0 nouveau le d\u00e9biteur \u00e0 communiquer les documents serait donc inutile. Ce refus t\u00e9moigne d\u2019une application restrictive du pouvoir d\u2019astreindre. Il pr\u00e9vient les demandes successives et encourage le recours aux voies d\u2019ex\u00e9cution forc\u00e9e.<\/p>\n<p>La condamnation aux frais irr\u00e9p\u00e9tibles est motiv\u00e9e par l\u2019inertie du d\u00e9biteur. Le juge use de son pouvoir d\u2019appr\u00e9ciation souverain fond\u00e9 sur l\u2019\u00e9quit\u00e9. Il sanctionne ainsi le comportement ayant contraint le cr\u00e9ancier \u00e0 resaisir la justice. Cette d\u00e9cision compense partiellement les frais expos\u00e9s et participe \u00e0 l\u2019\u00e9quilibre de la proc\u00e9dure.
