Le juge aux affaires familiales du tribunal judiciaire de Grenoble, statuant par jugement du 25 mars 2025, organise le partage d’une indivision n\u00e9e de la rupture d’un concubinage. Il statue sur plusieurs demandes accessoires, dont une indemnit\u00e9 d’occupation et la prescription de cr\u00e9ances all\u00e9gu\u00e9es. La solution retenue consacre une conception extensive de la jouissance privative et un point de d\u00e9part pr\u00e9cis pour la prescription des cr\u00e9ances entre concubins.<\/p>\n

La caract\u00e9risation extensive de l’occupation privative<\/p>\n

Le juge adopte une d\u00e9finition large de la jouissance privative pour fonder l’indemnit\u00e9 d’occupation. Il estime que la jouissance privative r\u00e9sulte de l’impossibilit\u00e9 de droit ou de fait pour les co-indivisaires d’user de la chose. La circonstance qu’un seul des indivisaires dispose de la cl\u00e9 pour acc\u00e9der au bien suffit \u00e0 caract\u00e9riser cette impossibilit\u00e9. “La jouissance privative d\u2019un immeuble indivis r\u00e9sulte de l\u2019impossibilit\u00e9 de droit ou de fait pour les co-indivisaires d\u2019user de la chose” (Motifs, sur l\u2019indemnit\u00e9 d\u2019occupation). L’indemnit\u00e9 est ainsi due m\u00eame sans occupation effective d\u00e8s lors que l’acc\u00e8s est interdit aux autres. Cette analyse se distingue d’une jurisprudence r\u00e9cente qui exigeait un fait d’exclusion. “La circonstance que l\u2019un des titulaires du droit de jouissance indivise occupe seul l\u2019immeuble ne caract\u00e9rise pas en soi une occupation privative d\u00e8s lors qu\u2019il n\u2019est pas \u00e9tabli que par son fait il exclut un autre indivisaire” (Cour d\u2019appel, le 20 novembre 2025, n\u00b024\/00752). Le pr\u00e9sent jugement \u00e9carte cet \u00e9l\u00e9ment d’exclusion active pour retenir une simple impossibilit\u00e9 d’acc\u00e8s.<\/p>\n

Le r\u00e9gime des cr\u00e9ances entre concubins et le point de d\u00e9part de la prescription<\/p>\n

La d\u00e9cision pr\u00e9cise le r\u00e9gime de la prescription des cr\u00e9ances n\u00e9es pendant le concubinage. Le juge admet que le d\u00e9lai pour agir \u00e9tait suspendu durant la vie commune en application de l’article 2234 du Code civil. La cr\u00e9anci\u00e8re “ne pouvait revendiquer une cr\u00e9ance \u00e0 l\u2019encontre de son concubin le temps de la vie commune” (Motifs, sur les autres cr\u00e9ances all\u00e9gu\u00e9es). Cependant, le point de d\u00e9part du d\u00e9lai de prescription quinquennal est fix\u00e9 au r\u00e8glement de chaque somme litigieuse all\u00e9gu\u00e9e, et non \u00e0 la rupture. La connaissance du droit est pr\u00e9sum\u00e9e \u00e0 cette date ancienne, rendant l’action prescrite. La suspension prend fin \u00e0 la rupture, laissant un d\u00e9lai r\u00e9siduel pour agir. L’emp\u00eachement li\u00e9 \u00e0 la vie commune n’est ni l\u00e9gal, ni conventionnel, ni une force majeure. Cette solution encadre strictement les demandes indemnitaires post-rupture et s\u00e9curise les situations anciennes.
