L&#8217;occupant doit une indemnit\u00e9 mensuelle jusqu&#8217;\u00e0 la lib\u00e9ration effective des lieux. Son montant est &#8220;fix\u00e9e au montant r\u00e9sultant du loyer et des charges, tel qu\u2019il aurait \u00e9t\u00e9 si le contrat s\u2019\u00e9tait poursuivi&#8221; (Motifs, sur l&#8217;indemnit\u00e9 d\u2019occupation). Cette solution est conforme aux principes g\u00e9n\u00e9raux de la responsabilit\u00e9 civile. Elle place l&#8217;occupant sans titre dans une situation financi\u00e8rement neutre. Il ne peut tirer profit de son occupation illicite. La d\u00e9cision cr\u00e9e une continuit\u00e9 dans les obligations p\u00e9cuniaires de l&#8217;occupant.
