Le litige opposait l&#8217;int\u00e9ress\u00e9 \u00e0 plusieurs soci\u00e9t\u00e9s, dont une entreprise utilisatrice et deux entreprises de travail temporaire. La juridiction devait d\u00e9terminer les conditions de la requalification et en pr\u00e9ciser les cons\u00e9quences indemnitaires. L&#8217;arr\u00eat a partiellement fait droit aux demandes du salari\u00e9 en ordonnant la requalification et en accordant diverses indemnit\u00e9s.<\/p>\n<p>La d\u00e9monstration d&#8217;une collusion frauduleuse conditionne la responsabilit\u00e9 de l&#8217;entreprise de travail temporaire.<\/p>\n<p>Pour engager la responsabilit\u00e9 de l&#8217;entreprise de travail temporaire, le salari\u00e9 doit prouver une entente frauduleuse avec l&#8217;utilisatrice. La cour rappelle que la charge de cette preuve incombe au salari\u00e9 concern\u00e9. En l&#8217;esp\u00e8ce, elle estime que les \u00e9l\u00e9ments produits sont insuffisants pour \u00e9tablir cette collusion. Un simple changement de prestataire par l&#8217;entreprise utilisatrice ne constitue pas une preuve de fraude. &#8220;Toute entreprise utilisatrice est en effet libre de changer de prestataire&#8221; (Motifs). De m\u00eame, l&#8217;absence de proposition d&#8217;autres missions n&#8217;\u00e9tablit pas \u00e0 elle seule une entente illicite. Cette solution r\u00e9affirme le principe de libert\u00e9 contractuelle des entreprises utilisatrices. Elle prot\u00e8ge ainsi les soci\u00e9t\u00e9s de travail temporaire de responsabilit\u00e9s indirectes sans faute d\u00e9montr\u00e9e.<\/p>\n<p>La requalification engendre une pluralit\u00e9 de cons\u00e9quences au b\u00e9n\u00e9fice du salari\u00e9 et \u00e0 la charge de l&#8217;entreprise utilisatrice.<\/p>\n<p>La reconnaissance d&#8217;un contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e produit des effets r\u00e9troactifs et indemnitaires multiples. Le salari\u00e9 obtient une indemnit\u00e9 sp\u00e9cifique pr\u00e9vue par le code du travail. &#8220;Aux termes de l&#8217;article L. 1251-41, alin\u00e9a 2, du code du travail, si le juge fait droit \u00e0 la demande de requalification du salari\u00e9, il lui accorde une indemnit\u00e9 \u00e0 la charge de l&#8217;entreprise utilisatrice&#8221; (Motifs). Il peut \u00e9galement pr\u00e9tendre au paiement des salaires correspondant aux p\u00e9riodes interstitielles. Ce droit est subordonn\u00e9 \u00e0 la preuve de sa disponibilit\u00e9 pour l&#8217;entreprise utilisatrice. La cour retient cette preuve au vu de l&#8217;encha\u00eenement des missions courtes et successives. La rupture est ensuite analys\u00e9e comme un licenciement sans cause r\u00e9elle et s\u00e9rieuse. Cela ouvre droit \u00e0 une indemnit\u00e9 compensatrice de pr\u00e9avis et \u00e0 des dommages-int\u00e9r\u00eats. La juridiction fixe ces derniers en application de l&#8217;article L.1235-3 du code du travail. Elle \u00e9carte l&#8217;invocabilit\u00e9 directe de la Charte sociale europ\u00e9enne dans les litiges entre particuliers. Le salari\u00e9 b\u00e9n\u00e9ficie enfin des avantages conventionnels de l&#8217;entreprise utilisatrice. Cela inclut les cong\u00e9s pay\u00e9s suppl\u00e9mentaires et les majorations d&#8217;anciennet\u00e9. La perte de chance de b\u00e9n\u00e9ficier d&#8217;un contrat de s\u00e9curisation professionnelle est \u00e9galement indemnis\u00e9e. Cette approche globale vise \u00e0 r\u00e9parer int\u00e9gralement le pr\u00e9judice subi. Elle place l&#8217;entreprise utilisatrice au centre des obligations r\u00e9sultant de la requalification.<\/p>\n<p>La r\u00e9partition des obligations entre les cocontractants distingue nettement l&#8217;entreprise utilisatrice de l&#8217;entreprise de travail temporaire.<\/p>\n<p>La responsabilit\u00e9 financi\u00e8re est principalement support\u00e9e par l&#8217;entreprise utilisatrice en cas de requalification. La cour souligne que l&#8217;indemnit\u00e9 l\u00e9gale de requalification est exclusivement \u00e0 sa charge. &#8220;Contrairement \u00e0 ce que soutient [le salari\u00e9], l&#8217;entreprise utilisatrice est seule d\u00e9bitrice en cas de condamnation de l&#8217;indemnit\u00e9 de requalification&#8221; (Motifs). Les rappels de salaire pour les p\u00e9riodes interstitielles peuvent, eux, engager les deux parties. La d\u00e9cision op\u00e8re une r\u00e9partition proportionnelle de cette dette commune. Elle fixe la part de responsabilit\u00e9 de l&#8217;entreprise de travail temporaire \u00e0 soixante-dix pour cent. En revanche, les avantages conventionnels de l&#8217;utilisatrice ne sont pas \u00e9tendus \u00e0 l&#8217;entreprise de travail temporaire. Le salari\u00e9 ne peut les r\u00e9clamer \u00e0 cette derni\u00e8re, la requalification n&#8217;emportant pas cet effet. &#8220;La requalification des contrats de mission \u00e0 son \u00e9gard, en contrat de travail \u00e0 dur\u00e9e ind\u00e9termin\u00e9e, n&#8217;emportant obligation pour elle que de faire b\u00e9n\u00e9ficier [le salari\u00e9] des droits ouverts \u00e0 ses seuls salari\u00e9s&#8221; (Motifs). Cette distinction clarifie le r\u00e9gime des obligations respectives. Elle \u00e9vite une confusion des patrimoines et des r\u00e9gimes conventionnels applicables.<\/p>\n<p>La port\u00e9e de l&#8217;arr\u00eat renforce la protection du salari\u00e9 en situation de travail temporaire abusif.<\/p>\n<p>Cette d\u00e9cision illustre la mise en \u0153uvre effective des articles L.1251-40 et suivants du code du travail. Elle rappelle utilement les conditions de preuve de la collusion frauduleuse. La solution s&#8217;inscrit dans la lign\u00e9e de la jurisprudence de la Chambre sociale. &#8220;Consid\u00e9rant l&#8217;ensemble des d\u00e9veloppements qui pr\u00e9c\u00e8dent, la cour retient que sur toute la p\u00e9riode consid\u00e9r\u00e9e le motif du recours au travail temporaire &#8211; l&#8217;accroissement temporaire de l&#8217;activit\u00e9 habituelle de l&#8217;entreprise &#8211; n&#8217;est pas justifi\u00e9&#8221; (Cass. Chambre sociale, le 30 septembre 2020, n\u00b019-12.416). L&#8217;arr\u00eat d\u00e9taille avec pr\u00e9cision le calcul des diverses indemnit\u00e9s dues. Il offre ainsi une vision exhaustive des r\u00e9parations accessibles. La fixation d&#8217;indemnit\u00e9s pour perte de chance constitue une avanc\u00e9e notable. Elle reconna\u00eet des pr\u00e9judices distincts de la perte d&#8217;emploi proprement dite. En d\u00e9finitive, la d\u00e9cision \u00e9quilibre la protection des salari\u00e9s et la s\u00e9curit\u00e9 juridique des entreprises.
