Le bailleur sollicitait la r\u00e9siliation du bail pour d\u00e9faut de paiement. Le locataire contestait le montant r\u00e9clam\u00e9 et l&#8217;ex\u00e9cution de certaines obligations. Le juge a d\u00e9clar\u00e9 l&#8217;incomp\u00e9tence du juge des r\u00e9f\u00e9r\u00e9s au profit du juge du fond. Il a ainsi rejet\u00e9 la demande et condamn\u00e9 le bailleur aux d\u00e9pens.<\/p>\n<p>La comp\u00e9tence du juge des r\u00e9f\u00e9r\u00e9s face \u00e0 une contestation s\u00e9rieuse<\/p>\n<p>Les conditions d&#8217;ouverture de la proc\u00e9dure de r\u00e9f\u00e9r\u00e9 sont strictement encadr\u00e9es. Le juge rappelle que sa saisine est subordonn\u00e9e \u00e0 l&#8217;absence de contestation s\u00e9rieuse. En l&#8217;esp\u00e8ce, plusieurs \u00e9l\u00e9ments fondent une telle contestation. Le montant du loyer et des charges r\u00e9clam\u00e9 est disput\u00e9 par le locataire. L&#8217;ex\u00e9cution du contrat concernant le garage et les charges est \u00e9galement controvers\u00e9e. Ces d\u00e9saccords substantiels emp\u00eachent une appr\u00e9ciation rapide et sommaire.<\/p>\n<p>La d\u00e9cision souligne ainsi le caract\u00e8re subsidiaire du r\u00e9f\u00e9r\u00e9 par rapport au fond. &#8220;D\u00e8s lors, les demandes des parties se heurtent \u00e0 plusieurs contestations s\u00e9rieuses, de sorte que le juge des r\u00e9f\u00e9r\u00e9s n\u2019est pas comp\u00e9tent au profit du juge du fond.&#8221; (Motifs de la d\u00e9cision). Le juge estime que les litiges n\u00e9cessitent une instruction approfondie. Cette solution prot\u00e8ge le principe du contradictoire et les droits de la d\u00e9fense. Elle r\u00e9affirme la distinction fondamentale entre l&#8217;urgence et les d\u00e9bats complexes sur le fond.<\/p>\n<p>L&#8217;impossibilit\u00e9 de constater la r\u00e9siliation de plein droit du bail<\/p>\n<p>La demande de r\u00e9siliation reposait sur une clause r\u00e9solutoire invoqu\u00e9e apr\u00e8s un commandement. Le juge des r\u00e9f\u00e9r\u00e9s pourrait th\u00e9oriquement constater une telle r\u00e9solution de plein droit. Cette possibilit\u00e9 est cependant conditionn\u00e9e par des crit\u00e8res stricts \u00e9tablis par la jurisprudence. La clause doit \u00eatre d\u00e9nu\u00e9e de toute ambigu\u00eft\u00e9 et ne n\u00e9cessiter aucune interpr\u00e9tation. Son invocation par le bailleur doit \u00e9galement \u00eatre manifestement de bonne foi.<\/p>\n<p>&#8220;Le juge des r\u00e9f\u00e9r\u00e9s peut constater la r\u00e9siliation de plein droit du bail au titre d&#8217;une clause contenue \u00e0 l&#8217;acte \u00e0 cet effet, \u00e0 condition que : &#8211; le d\u00e9faut de paiement de la somme r\u00e9clam\u00e9e dans le commandement de payer visant la clause r\u00e9solutoire soit manifestement fautif, &#8211; le bailleur soit, de toute \u00e9vidence, en situation d&#8217;invoquer de bonne foi la mise en jeu de cette clause, &#8211; la clause r\u00e9solutoire soit d\u00e9nu\u00e9e d&#8217;ambigu\u00eft\u00e9 et ne n\u00e9cessite pas interpr\u00e9tation&#8221; (Tribunal judiciaire de Paris, le 21 janvier 2025, n\u00b024\/56337). En l&#8217;esp\u00e8ce, la contestation sur le montant d\u00fb rend le d\u00e9faut de paiement non manifestement fautif. L&#8217;existence d&#8217;un accord homologu\u00e9 non ex\u00e9cut\u00e9 complexifie encore l&#8217;appr\u00e9ciation de la bonne foi.<\/p>\n<p>La port\u00e9e de cette d\u00e9cision est de rappeler la rigueur n\u00e9cessaire pour l&#8217;application des clauses r\u00e9solutoires. Elle prot\u00e8ge le locataire contre une expulsion acc\u00e9l\u00e9r\u00e9e lorsque la dette est s\u00e9rieusement contest\u00e9e. Le juge renvoie ainsi les parties \u00e0 une instance au fond pour trancher le litige. Cette solution garantit un examen complet des preuves et des arguments de chaque partie.
