La d\u00e9fenderesse, ne comparaissant pas, a vu sa responsabilit\u00e9 engag\u00e9e sur le fondement des articles 10 de la loi du 10 juillet 1965 et 1353 du code civil. Le juge a accueilli la demande du syndicat, ordonn\u00e9 le paiement des sommes dues avec int\u00e9r\u00eats, et allou\u00e9 des frais irr\u00e9p\u00e9tibles, tout en pronon\u00e7ant l&#8217;ex\u00e9cution provisoire de la d\u00e9cision.<\/p>\n<p>La sanction de la d\u00e9faillance proc\u00e9durale<\/p>\n<p>La cons\u00e9quence du d\u00e9faut de comparution.<\/p>\n<p>L&#8217;article 472 du code de proc\u00e9dure civile r\u00e9git strictement le d\u00e9faut de comparution. Il permet au juge de statuer sur le fond en l&#8217;absence d&#8217;une partie, mais limite son office. &#8220;Le juge ne fait droit \u00e0 la demande que dans la mesure o\u00f9 il l&#8217;estime r\u00e9guli\u00e8re, recevable et bien fond\u00e9e&#8221; (Motifs, avant 1\u00b0). Cette disposition prot\u00e8ge le d\u00e9fendeur absent d&#8217;une d\u00e9cision automatique. Le juge doit v\u00e9rifier le bien-fond\u00e9 de la demande sur la base des seuls \u00e9l\u00e9ments produits par le demandeur, ce qui constitue une garantie essentielle. La d\u00e9cision illustre cette application rigoureuse, le tribunal ayant examin\u00e9 les pi\u00e8ces justificatives avant de condamner.<\/p>\n<p>La charge de la preuve en mati\u00e8re de cr\u00e9ances de copropri\u00e9t\u00e9.<\/p>\n<p>Le demandeur doit rapporter la preuve de l&#8217;obligation invoqu\u00e9e, conform\u00e9ment au droit commun. &#8220;Celui qui r\u00e9clame l&#8217;ex\u00e9cution d&#8217;une obligation doit la prouver&#8221; (Motifs, 1\u00b0). Le syndicat a satisfait \u00e0 cette exigence en produisant une documentation compl\u00e8te. Il a justifi\u00e9 sa demande &#8220;en produisant notamment le relev\u00e9 de propri\u00e9t\u00e9, le contrat de syndic, les proc\u00e8s-verbaux de l&#8217;assembl\u00e9e g\u00e9n\u00e9rale&#8230; le d\u00e9compte des sommes dues, les appels de fonds, les relances ainsi que la sommation de payer&#8221; (Motifs, 1\u00b0). Cette exigence probatoire renforce la s\u00e9curit\u00e9 juridique des proc\u00e9dures par d\u00e9faut. Elle rejoint la solution constante selon laquelle la cr\u00e9ance du syndicat doit \u00eatre \u00e9tablie par des \u00e9l\u00e9ments pr\u00e9cis et concordants.<\/p>\n<p>Le r\u00e9gime des charges et des frais de recouvrement<\/p>\n<p>Le principe de r\u00e9partition et l&#8217;exception des frais individualis\u00e9s.<\/p>\n<p>Le fondement de l&#8217;obligation de participer aux charges est clairement rappel\u00e9. &#8220;Les copropri\u00e9taires sont tenus de participer aux charges entra\u00een\u00e9es par les services collectifs et les \u00e9l\u00e9ments d&#8217;\u00e9quipement commun en fonction de l&#8217;utilit\u00e9 que ces services et \u00e9l\u00e9ments pr\u00e9sentent \u00e0 l&#8217;\u00e9gard de chaque lot&#8221; (Motifs, 1\u00b0). Ce principe d&#8217;utilit\u00e9 objective, \u00e9galement soulign\u00e9 par d&#8217;autres juridictions, guide la r\u00e9partition. &#8220;Les copropri\u00e9taires sont tenus de participer aux charges&#8230; en fonction de l&#8217;utilit\u00e9 objective que ces services et \u00e9l\u00e9ments pr\u00e9sentent \u00e0 l&#8217;\u00e9gard de chaque lot&#8221; (Tribunal judiciaire de Pointe-\u00e0-Pitre, le 17 juillet 2025, n\u00b024\/02127). La d\u00e9cision pr\u00e9cise \u00e9galement le r\u00e9gime d\u00e9rogatoire des frais de recouvrement, imputables au seul copropri\u00e9taire d\u00e9faillant d\u00e8s la mise en demeure. Cette distinction entre charges communes et frais individualis\u00e9s est essentielle pour l&#8217;\u00e9quilibre financier de la copropri\u00e9t\u00e9.<\/p>\n<p>La condamnation aux frais de proc\u00e9dure et l&#8217;ex\u00e9cution provisoire.<\/p>\n<p>Le juge applique les r\u00e8gles de droit commun concernant les d\u00e9pens et les frais irr\u00e9p\u00e9tibles. La partie perdante est condamn\u00e9e aux d\u00e9pens en vertu de l&#8217;article 696 du code de proc\u00e9dure civile. Pour les frais non compris dans les d\u00e9pens, le juge use de son pouvoir d&#8217;appr\u00e9ciation souverain fond\u00e9 sur l&#8217;\u00e9quit\u00e9. Il fixe ainsi une somme de 500 euros au titre de l&#8217;article 700. Enfin, le tribunal rappelle le principe de l&#8217;ex\u00e9cution provisoire de droit pour les jugements de premi\u00e8re instance.
