Le tribunal judiciaire de Grenoble, statuant en mati\u00e8re sociale, a rendu un jugement le 8 mars 2024. Un salari\u00e9 a subi une crise de col\u00e8re suite \u00e0 une altercation avec son sup\u00e9rieur hi\u00e9rarchique sur son lieu de travail. Il a ensuite pr\u00e9sent\u00e9 un tableau d’anxi\u00e9t\u00e9 g\u00e9n\u00e9ralis\u00e9 constat\u00e9 m\u00e9dicalement le jour m\u00eame. La caisse de s\u00e9curit\u00e9 sociale a refus\u00e9 la reconnaissance de l’accident du travail. Le tribunal, saisi en recours, a d\u00fb d\u00e9terminer si les conditions l\u00e9gales de l’accident du travail \u00e9taient r\u00e9unies. Il a infirm\u00e9 la d\u00e9cision de la caisse et reconnu l’accident du travail, ordonnant la prise en charge.<\/p>\n

La caract\u00e9risation objective du fait accidentel<\/p>\n

La preuve de l’\u00e9v\u00e9nement soudain au temps et au lieu du travail.<\/p>\n

Le droit exige la survenance d’un fait accidentel \u00e0 une date certaine par le fait ou \u00e0 l’occasion du travail. La juridiction rel\u00e8ve que la r\u00e9alit\u00e9 de l’altercation verbale n’est pas contest\u00e9e par l’employeur lui-m\u00eame. Cet \u00e9v\u00e9nement a m\u00eame servi de fondement \u00e0 une sanction disciplinaire ult\u00e9rieure. “Il est d\u00e9montr\u00e9 que la crise de col\u00e8re, \u00e9v\u00e8nement soudain, survenu \u00e0 M. [X] au temps et lieu du travail, a pour origine ses conditions de travail et un diff\u00e9rend avec un sup\u00e9rieur” (Motifs, 1\/). La preuve est ainsi rapport\u00e9e par des \u00e9l\u00e9ments objectifs ext\u00e9rieurs aux seules affirmations du salari\u00e9. La d\u00e9cision rappelle utilement que la caract\u00e9risation du fait accidentel est ind\u00e9pendante de la qualification d’une faute de l’employeur. La port\u00e9e de cette analyse est de fixer clairement l’origine professionnelle de l’\u00e9v\u00e9nement d\u00e9clencheur, malgr\u00e9 un contexte de tensions pr\u00e9existantes.<\/p>\n

L’absence d’exigence d’une manifestation ext\u00e9rieure violente.<\/p>\n

Le tribunal \u00e9carte l’argument de la caisse fond\u00e9 sur l’exercice normal du pouvoir de direction. Il consid\u00e8re que les conditions du d\u00e9roulement de l’entrevue ne font pas obstacle \u00e0 la survenance d’une l\u00e9sion. “Les conditions du d\u00e9roulement de l\u2019entrevue avec le chef de groupe ne font pas obstacle \u00e0 la survenance d\u2019une l\u00e9sion et constituent d\u00e8s lors le fait \u00e0 l\u2019origine de l\u2019accident” (Motifs, 1\/). Cette approche est essentielle pour les pathologies psychiques. Elle admet qu’un simple diff\u00e9rend, sans violence manifeste, peut constituer le fait accidentel. La valeur de ce point est d’adapter le droit des accidents du travail aux r\u00e9alit\u00e9s des risques psychosociaux. Il s’agit d’un \u00e9v\u00e9nement identifiable, m\u00eame dans le cadre d’une relation hi\u00e9rarchique normale.<\/p>\n

L’\u00e9tablissement du lien de causalit\u00e9 direct et certain<\/p>\n

L’application de la pr\u00e9somption d’imputabilit\u00e9.<\/p>\n

Conform\u00e9ment \u00e0 l’article L.411-1 du code de la s\u00e9curit\u00e9 sociale, la victime b\u00e9n\u00e9ficie d’une pr\u00e9somption d\u00e8s lors qu’un fait accidentel est prouv\u00e9. Le certificat m\u00e9dical initial, \u00e9tabli le jour m\u00eame de l’incident, fait \u00e9tat d’un “tableau d’anxi\u00e9t\u00e9 g\u00e9n\u00e9ralis\u00e9” et \u00e9tablit le lien. “Ainsi, la victime peut b\u00e9n\u00e9ficier de la pr\u00e9somption du caract\u00e8re professionnel des l\u00e9sions qu’elle a subies” (Motifs, 2\/). La charge de la preuve d’une cause \u00e9trang\u00e8re incombe alors \u00e0 la caisse. La solution confirme la force de cette pr\u00e9somption protectrice pour le salari\u00e9. Son sens est d’assurer une protection efficace en inversant la charge de la preuve une fois l’\u00e9v\u00e9nement professionnel \u00e9tabli.<\/p>\n

Le rejet de la cause \u00e9trang\u00e8re fond\u00e9e sur l’\u00e9volution progressive.<\/p>\n

La caisse invoquait l’existence d’un contexte de travail tendu pour contester le lien direct. Le tribunal rejette cet argument en relevant l’absence d’ant\u00e9c\u00e9dents d’arr\u00eat pour cause psychologique. “La l\u00e9sion psychique qui a \u00e9t\u00e9 diagnostiqu\u00e9e le 23 f\u00e9vrier 2023 ne r\u00e9sulte donc pas exclusivement de la situation ant\u00e9rieure” (Motifs, 2\/). Il pr\u00e9cise que la caisse ne d\u00e9montre pas que la l\u00e9sion “se serait in\u00e9luctablement r\u00e9v\u00e9l\u00e9e sans la survenance de l\u2019incident”. Cette analyse se distingue des cas o\u00f9 le trouble est le r\u00e9sultat d’une d\u00e9gradation lente. “L’\u00e9puisement professionnel ne peut r\u00e9sulter d’un fait accidentel, mais est l’expression d’une d\u00e9gradation progressive de l’\u00e9tat de sant\u00e9” (Cour d’appel, le 24 avril 2025, n\u00b023\/01923). Ici, l’anxi\u00e9t\u00e9 est reli\u00e9e \u00e0 un \u00e9v\u00e9nement soudain et dat\u00e9.
