La proc\u00e9dure concerne un litige portant sur la r\u00e9gularit\u00e9 du licenciement et diverses cr\u00e9ances salariales. La juridiction infirme partiellement le jugement pr\u00e9c\u00e9dent pour accorder des indemnit\u00e9s. Elle confirme cependant le rejet des demandes fond\u00e9es sur une discrimination li\u00e9e \u00e0 la grossesse.<\/p>\n<p>La validation des <a href=\"https:\/\/kohenavocats.com\/avocats-droit-social-paris\/avocats-heures-supplementaires-paris\/\" target=\"_blank\" title=\"heures suppl\u00e9mentaires\">heures suppl\u00e9mentaires<\/a> malgr\u00e9 un forfait-jours irr\u00e9gulier<\/p>\n<p>La cour \u00e9carte l\u2019application de la convention de forfait-jours pour un vice de forme. L\u2019employeur ne justifie pas la tenue des entretiens annuels obligatoires pr\u00e9vus par la loi. &#8220;Pour autant, il n&#8217;explique pas l&#8217;absence d&#8217;entretien en juin 2019 et la raison pour laquelle l&#8217;entretien de juin 2020 n&#8217;a pas \u00e9t\u00e9 reprogramm\u00e9&#8221; (Motifs). D\u00e8s lors, le forfait est priv\u00e9 d\u2019effet et le r\u00e9gime de droit commun s\u2019applique. La salari\u00e9e peut donc pr\u00e9tendre au paiement d\u2019heures suppl\u00e9mentaires effectivement accomplies.<\/p>\n<p>La preuve des heures suppl\u00e9mentaires est appr\u00e9ci\u00e9e avec souplesse par les juges. La salari\u00e9e produit des \u00e9l\u00e9ments pr\u00e9cis comme un planning et des courriels. &#8220;Contrairement \u00e0 ce que soutient l&#8217;employeur, ces \u00e9l\u00e9ments sont suffisamment pr\u00e9cis pour permettre \u00e0 l&#8217;employeur d&#8217;y r\u00e9pondre&#8221; (Motifs). L\u2019employeur ne rapportant pas de preuve contraire, la cour retient l\u2019existence d\u2019heures suppl\u00e9mentaires dues. Elle en fixe souverainement le nombre et octroie un rappel de salaire cons\u00e9quent. Cette solution rappelle que la charge de travail connue de l\u2019employeur vaut commande implicite de travail suppl\u00e9mentaire.<\/p>\n<p>L\u2019exclusion d\u2019une discrimination malgr\u00e9 un licenciement infond\u00e9<\/p>\n<p>La cour examine s\u00e9par\u00e9ment la cause du licenciement et l\u2019all\u00e9gation de discrimination. Le licenciement est jug\u00e9 d\u00e9pourvu de cause r\u00e9elle et s\u00e9rieuse. Les griefs invoqu\u00e9s par l\u2019employeur ne sont pas \u00e9tablis ou ne constituent pas des fautes. Sur la perte de clients, &#8220;il n&#8217;\u00e9tablit pas l&#8217;existence de comportements fautifs de cette derni\u00e8re ou un manquement d\u00e9lib\u00e9r\u00e9&#8221; (Motifs). Concernant les relations internes, les pi\u00e8ces &#8220;n&#8217;\u00e9tablissent pas un r\u00f4le probl\u00e9matique&#8221; de la salari\u00e9e. Le licenciement est donc sanctionn\u00e9 par des dommages-int\u00e9r\u00eats.<\/p>\n<p>La demande fond\u00e9e sur une discrimination en raison de la grossesse est n\u00e9anmoins rejet\u00e9e. La salari\u00e9e pr\u00e9sente des \u00e9l\u00e9ments laissant supposer une mise \u00e0 l\u2019\u00e9cart \u00e0 son retour de cong\u00e9 maternit\u00e9. &#8220;Les autres \u00e9l\u00e9ments laissent supposer l&#8217;existence d&#8217;une discrimination&#8221; (Motifs). Conform\u00e9ment \u00e0 l\u2019article L.1134-1 du code du travail, la charge de la preuve bascule alors sur l\u2019employeur. Celui-ci doit justifier ses d\u00e9cisions par des \u00e9l\u00e9ments objectifs \u00e9trangers \u00e0 toute discrimination.<\/p>\n<p>L\u2019employeur s\u2019acquitte de cette charge probatoire en d\u00e9montrant une r\u00e9organisation ant\u00e9rieure. Il prouve aussi l\u2019association de la salari\u00e9e aux \u00e9volutions et l\u2019absence de lien avec sa grossesse. &#8220;D\u00e8s lors, l&#8217;employeur \u00e9tablit que [la salari\u00e9e] a \u00e9t\u00e9 associ\u00e9e aux \u00e9volutions organisationnelles&#8221; (Motifs). La cour estime que les difficult\u00e9s relationnelles all\u00e9gu\u00e9es sont \u00e9trang\u00e8res \u00e0 toute discrimination. Cette analyse distingue clairement le caract\u00e8re injustifi\u00e9 du licenciement d\u2019une motivation discriminatoire.
