Un salari\u00e9, licenci\u00e9 pour faute grave suite \u00e0 des agissements lors d&#8217;une formation, conteste la l\u00e9gitimit\u00e9 de son licenciement et r\u00e9clame diverses indemnit\u00e9s. La juridiction inf\u00e9rieure avait partiellement accueilli ses demandes. La cour d&#8217;appel, saisie de l&#8217;ensemble du litige, doit se prononcer sur la prescription d&#8217;un avertissement ant\u00e9rieur, la qualification de faute grave et le droit \u00e0 une prime exceptionnelle. Elle infirme le jugement pour reconna\u00eetre la faute grave et d\u00e9boute le salari\u00e9 de la plupart de ses pr\u00e9tentions.<\/p>\n<p>La prescription de la sanction ant\u00e9rieure<\/p>\n<p>Le respect des d\u00e9lais l\u00e9gaux de prescription<\/p>\n<p>La cour commence par examiner la r\u00e9gularit\u00e9 de l&#8217;invocation d&#8217;un avertissement ancien. L&#8217;employeur souhaitait fonder son licenciement sur cet ant\u00e9c\u00e9dent disciplinaire. La cour rappelle le principe l\u00e9gal selon lequel &#8220;aucune sanction disciplinaire de plus de trois ans \u00e0 la date d&#8217;engagement des poursuites disciplinaires ne peut \u00eatre invoqu\u00e9e&#8221; (article L. 1332-5 du code du travail). L&#8217;avertissement fut notifi\u00e9 en octobre 2018 et la proc\u00e9dure de licenciement engag\u00e9e en octobre 2021. Le d\u00e9lai de trois ans \u00e9tant \u00e9coul\u00e9, la sanction est d\u00e9clar\u00e9e prescrite. Cet examen liminaire respecte strictement la r\u00e8gle de prescription, prot\u00e9geant le salari\u00e9 contre l&#8217;usage de faits anciens. La d\u00e9cision confirme ainsi la s\u00e9curit\u00e9 juridique attach\u00e9e aux d\u00e9lais, emp\u00eachant toute r\u00e9surgence tardive d&#8217;\u00e9l\u00e9ments disciplinaires.<\/p>\n<p>L&#8217;exclusion du grief de l&#8217;argumentaire patronal<\/p>\n<p>La prescription entra\u00eene l&#8217;\u00e9viction pure et simple de l&#8217;avertissement du d\u00e9bat. L&#8217;employeur ne peut donc s&#8217;en pr\u00e9valoir pour justifier la rupture. La cour confirme le jugement sur ce point, limitant strictement l&#8217;appr\u00e9ciation de la faute grave aux seuls griefs invoqu\u00e9s dans la lettre de licenciement. Cette rigueur proc\u00e9durale garantit que le litige reste circonscrit aux reproches formellement notifi\u00e9s au salari\u00e9. Elle pr\u00e9vient toute surprise proc\u00e9durale et assure l&#8217;\u00e9quit\u00e9 du contradictoire. La port\u00e9e de cette analyse est essentielle, car elle isole l&#8217;appr\u00e9ciation de la faute grave sur les seuls faits r\u00e9cents, sans influence d&#8217;\u00e9l\u00e9ments prescrits.<\/p>\n<p>La caract\u00e9risation de la faute grave<\/p>\n<p>L&#8217;\u00e9tablissement de faits constitutifs d&#8217;une faute<\/p>\n<p>La cour d\u00e9finit ensuite le cadre l\u00e9gal de la faute grave. Elle rappelle qu&#8217;il incombe \u00e0 l&#8217;employeur &#8220;d&#8217;\u00e9tablir l&#8217;exactitude des faits imput\u00e9s&#8221; et &#8220;de d\u00e9montrer que ces faits constituent une violation des obligations d\u00e9coulant du contrat de travail d&#8217;une importance telle qu&#8217;elle rend impossible le maintien de ce salari\u00e9 dans l&#8217;entreprise&#8221;. Pour ce faire, l&#8217;employeur produit plusieurs attestations concordantes d\u00e9crivant les agissements du salari\u00e9 lors d&#8217;une formation. Ces \u00e9crits d\u00e9taillent des propos &#8220;d\u00e9gradants et humiliants&#8221; sur le physique et les aptitudes de coll\u00e8gues et du formateur. Ils relatent \u00e9galement des gestes obsc\u00e8nes \u00e0 connotation sexuelle. La cour estime que ces attestations &#8220;emportent la conviction&#8221;. Elles d\u00e9montrent un &#8220;comportement agressif, d\u00e9nigrant, grossier et irrespectueux&#8221;. Cette accumulation de preuves \u00e9crites et concordantes satisfait pleinement le fardeau de la preuve pesant sur l&#8217;employeur.<\/p>\n<p>La gravit\u00e9 justifiant la rupture imm\u00e9diate<\/p>\n<p>La cour appr\u00e9cie ensuite la gravit\u00e9 de ces faits au regard de l&#8217;obligation de loyaut\u00e9. Elle estime que les &#8220;propos exc\u00e8dent le droit \u00e0 la libert\u00e9 d&#8217;expression reconnu au salari\u00e9&#8221;. Elle rejette l&#8217;excuse d&#8217;un contexte de restructuration, constatant l&#8217;absence de tensions internes \u00e9tablies. Les attestations r\u00e9v\u00e8lent l&#8217;impact profond des agissements sur les victimes, l&#8217;une se disant &#8220;particuli\u00e8rement choqu\u00e9 et bless\u00e9&#8221;, l&#8217;autre s&#8217;\u00e9tant &#8220;senti agress\u00e9&#8221;. La cour en d\u00e9duit que ces &#8220;propos et comportements sont exclusifs de toute plaisanterie&#8221;. Ils avaient pour objet de &#8220;provoquer, d\u00e9nigrer et humilier&#8221;. Au regard de cette analyse, la cour juge que, &#8220;nonobstant l&#8217;anciennet\u00e9 du salari\u00e9 et l&#8217;absence d&#8217;ant\u00e9c\u00e9dent disciplinaire, ces agissements rendaient impossible le maintien du salari\u00e9 dans l&#8217;entreprise&#8221;. Cette appr\u00e9ciation in concreto de la gravit\u00e9, qui \u00e9carte des circonstances att\u00e9nuantes, rejoint la solution d&#8217;une jurisprudence selon laquelle un refus persistant rendait &#8220;impossible le maintien du salari\u00e9 dans l&#8217;entreprise&#8221; (Cour d&#8217;appel de Versailles, le 23 mars 2023, n\u00b020\/01999). La faute grave est ainsi caract\u00e9ris\u00e9e.<\/p>\n<p>La port\u00e9e de l&#8217;arr\u00eat est significative en mati\u00e8re de preuve et de qualification disciplinaire. Il rappelle la n\u00e9cessit\u00e9 de preuves solides et concordantes pour l&#8217;employeur. Il affirme avec force que des atteintes r\u00e9p\u00e9t\u00e9es \u00e0 la dignit\u00e9 d&#8217;autrui, en milieu professionnel, constituent une violation fondamentale du contrat. La solution op\u00e8re une balance nette entre libert\u00e9 d&#8217;expression et obligation de respect, au profit de cette derni\u00e8re.
