Le litige portait sur la r\u00e9gularit\u00e9 de son licenciement intervenu dans un contexte de cessation d\u2019activit\u00e9 de l\u2019entreprise et sur diverses demandes indemnitaires. La cour a infirm\u00e9 partiellement la d\u00e9cision premi\u00e8re pour requalifier le licenciement et allouer de nouvelles indemnit\u00e9s.<\/p>\n<p>La preuve d\u00e9cisive de la cause \u00e9conomique du licenciement<\/p>\n<p>L\u2019exigence d\u2019une justification concr\u00e8te de la cessation d\u2019activit\u00e9. La cour rappelle que la cessation compl\u00e8te et d\u00e9finitive de l\u2019entreprise constitue en soi un motif \u00e9conomique de licenciement. Elle pr\u00e9cise n\u00e9anmoins que cette cessation doit \u00eatre \u00e9tablie de mani\u00e8re certaine au moment du licenciement. En l\u2019esp\u00e8ce, l\u2019employeur et l\u2019AGS n\u2019ont pas produit d\u2019\u00e9l\u00e9ments probants, tels qu\u2019une radiation du registre des entreprises, d\u00e9montrant une cessation effective \u00e0 la date du licenciement. &#8220;Il n&#8217;est donc pas \u00e9tabli que le licenciement [&#8230;] soit justifi\u00e9 par une cessation compl\u00e8te et d\u00e9finitive de l&#8217;activit\u00e9&#8221; (Motifs). La cour \u00e9carte \u00e9galement l\u2019argument tir\u00e9 d\u2019\u00e9ventuelles difficult\u00e9s financi\u00e8res, faute de justificatifs comptables. Cette analyse impose une charge de la preuve rigoureuse sur l\u2019employeur pour fonder un <a href=\"https:\/\/kohenavocats.com\/avocats-droit-social-paris\/avocats-licenciement-economique-paris\/\" target=\"_blank\" title=\"licenciement \u00e9conomique\">licenciement \u00e9conomique<\/a>. Elle prot\u00e8ge le salari\u00e9 contre des motifs invoqu\u00e9s de mani\u00e8re abstraite ou non v\u00e9rifi\u00e9e, renfor\u00e7ant ainsi le contr\u00f4le judiciaire sur la r\u00e9alit\u00e9 de la cause.<\/p>\n<p>L\u2019indiff\u00e9rence des proc\u00e9dures collectives ult\u00e9rieures \u00e0 la justification du licenciement. La d\u00e9cision distingue clairement le moment du licenciement de l\u2019ouverture ult\u00e9rieure d\u2019une <a href=\"https:\/\/kohenavocats.fr\/elementor-60\/avocats-droit-affaires-paris\/avocat-procedures-collectives-paris\/\" target=\"_blank\" title=\"proc\u00e9dure collective\">proc\u00e9dure collective<\/a>. Le <a href=\"https:\/\/kohenavocats.fr\/exp-8\/\" target=\"_blank\" title=\"redressement judiciaire\">redressement judiciaire<\/a> prononc\u00e9 plus d\u2019un an apr\u00e8s le licenciement ne suffit pas \u00e0 r\u00e9trospectivement valider sa cause. &#8220;L&#8217;hypoth\u00e8se d&#8217;une poursuite d&#8217;activit\u00e9, m\u00eame r\u00e9duite, entre les deux dates ne peut \u00eatre exclue&#8221; (Motifs). Cette solution isole l\u2019appr\u00e9ciation de la cause r\u00e9elle et s\u00e9rieuse au jour de la rupture. Elle emp\u00eache qu\u2019une d\u00e9faillance future de l\u2019entreprise serve \u00e0 couvrir un licenciement abusif, conform\u00e9ment \u00e0 la jurisprudence selon laquelle la liquidation ne prive pas le salari\u00e9 d\u2019invoquer une faute de l\u2019employeur \u00e0 l\u2019origine des difficult\u00e9s. &#8220;Le fait que la cessation d&#8217;activit\u00e9 de l&#8217;entreprise r\u00e9sulte de sa liquidation judiciaire ne prive pas le salari\u00e9 de la possibilit\u00e9 d&#8217;invoquer l&#8217;existence d&#8217;une faute de l&#8217;employeur&#8221; (Cour d&#8217;appel, le 19 d\u00e9cembre 2025, n\u00b021\/15237).<\/p>\n<p>La sanction des manquements contractuels et l\u2019articulation des indemnit\u00e9s<\/p>\n<p>La r\u00e9paration distincte du pr\u00e9judice li\u00e9 \u00e0 l\u2019obligation de s\u00e9curit\u00e9 de l\u2019employeur. La cour admet la demande en dommages-int\u00e9r\u00eats pour violation de l\u2019obligation de s\u00e9curit\u00e9. Elle rel\u00e8ve l\u2019absence de mesures de bruit et de visites m\u00e9dicales p\u00e9riodiques, malgr\u00e9 une activit\u00e9 expos\u00e9e. &#8220;Ce dernier a \u00e9t\u00e9 expos\u00e9 \u00e0 un risque en raison du non-respect de ces prescriptions [&#8230;] ce qui constitue un pr\u00e9judice&#8221; (Motifs). Ce chef d\u2019indemnisation, autonome, est accord\u00e9 m\u00eame en l\u2019absence de pr\u00e9judice physique av\u00e9r\u00e9. Il consacre une obligation de moyens renforc\u00e9e dans les secteurs \u00e0 risques et sanctionne tout manquement aux prescriptions du code du travail. La cour op\u00e8re ainsi une protection objective de la sant\u00e9 du salari\u00e9, distincte de la question de la cause du licenciement.<\/p>\n<p>Le non-cumul des indemnit\u00e9s pour licenciement abusif et irr\u00e9gulier. La cour rappelle le principe de non-cumul des indemnit\u00e9s pr\u00e9vues aux articles L.1235-3 et L.1235-2 du code du travail. Une indemnit\u00e9 pour licenciement sans cause r\u00e9elle et s\u00e9rieuse ayant \u00e9t\u00e9 allou\u00e9e, la demande pour irr\u00e9gularit\u00e9 de proc\u00e9dure est rejet\u00e9e. Cette solution respecte l\u2019\u00e9conomie du texte qui distingue le vice de fond du vice de forme. Elle guide l\u2019action du salari\u00e9 en l\u2019incitant \u00e0 concentrer ses efforts sur la contestation du motif, l\u2019indemnit\u00e9 pour vice de forme \u00e9tant accessoire et plafonn\u00e9e.
