Ce dernier sollicite la constatation de l\u2019acquisition d\u2019une <a href=\"https:\/\/kohenavocats.fr\/avocat-resiliation-bail-paris\/\" target=\"_blank\" title=\"clause r\u00e9solutoire\">clause r\u00e9solutoire<\/a> pour impay\u00e9s et l\u2019expulsion du locataire. Le juge retient l\u2019absence de contestation s\u00e9rieuse sur la r\u00e9gularit\u00e9 du commandement et la dette. Il constate la r\u00e9siliation du bail et ordonne l\u2019expulsion sous quinze jours. Il fixe \u00e9galement une indemnit\u00e9 d\u2019occupation provisionnelle et condamne le locataire au paiement d\u2019une provision pour l\u2019arri\u00e9r\u00e9 locatif.<\/p>\n<p>La comp\u00e9tence du juge des r\u00e9f\u00e9r\u00e9s pour constater une r\u00e9siliation de bail<\/p>\n<p>Le juge des r\u00e9f\u00e9r\u00e9s peut statuer sans condition d\u2019urgence sur l\u2019acquisition d\u2019une clause. Cette solution consacre une comp\u00e9tence fonctionnelle du juge des r\u00e9f\u00e9r\u00e9s en mati\u00e8re contractuelle. Elle permet une r\u00e9solution rapide des litiges li\u00e9s \u00e0 l\u2019ex\u00e9cution des baux commerciaux.<\/p>\n<p>Le maintien dans les lieux apr\u00e8s r\u00e9siliation constitue un trouble manifestement illicite. Ce fondement juridique autorise le juge \u00e0 ordonner l\u2019expulsion en r\u00e9f\u00e9r\u00e9. Il offre au bailleur un moyen efficace pour recouvrer la jouissance de son bien. La protection du droit de propri\u00e9t\u00e9 justifie cette intervention rapide du juge.<\/p>\n<p>Le r\u00e9gime probatoire et les effets du commandement r\u00e9gulier<\/p>\n<p>Le bailleur doit rapporter la preuve de sa cr\u00e9ance et de la r\u00e9gularit\u00e9 du commandement. L\u2019article L. 145-41 du code de commerce dispose que toute clause ins\u00e9r\u00e9e dans le bail pr\u00e9voyant la r\u00e9siliation de plein droit ne produit effet qu&#8217;un mois apr\u00e8s un commandement demeur\u00e9 infructueux. Le commandement doit, \u00e0 peine de nullit\u00e9, mentionner ce d\u00e9lai. Cette formalit\u00e9 substantielle prot\u00e8ge le locataire commercial d\u2019une r\u00e9siliation brutale. La jurisprudence ant\u00e9rieure confirme cette exigence protectrice.<\/p>\n<p>Le commandement en l\u2019esp\u00e8ce est jug\u00e9 r\u00e9gulier car il contient toutes les mentions requises. Le commandement contient ainsi toutes les pr\u00e9cisions permettant au locataire de conna\u00eetre la nature, les causes et le montant des sommes r\u00e9clam\u00e9es. Cette r\u00e9gularit\u00e9 formelle est essentielle pour l\u2019acquisition de la clause r\u00e9solutoire. Elle garantit le contradictoire et le droit \u00e0 la d\u00e9fense du preneur. L\u2019absence de contestation s\u00e9rieuse sur ce point entra\u00eene la r\u00e9siliation de plein droit.<\/p>\n<p>Le pouvoir du juge pour accorder des mesures provisionnelles<\/p>\n<p>Le juge peut allouer une provision sur une cr\u00e9ance non s\u00e9rieusement contestable. Selon l\u2019article 835, alin\u00e9a 2, du code de proc\u00e9dure civile, si l\u2019existence et le montant de l\u2019obligation ne sont pas s\u00e9rieusement contestables, le juge des r\u00e9f\u00e9r\u00e9s peut accorder une provision au bailleur. Cette disposition offre un recours utile pour le cr\u00e9ancier face \u00e0 un d\u00e9biteur d\u00e9faillant. Elle permet d\u2019\u00e9viter l\u2019aggravation du pr\u00e9judice financier pendant l\u2019instance.<\/p>\n<p>La fixation de l\u2019indemnit\u00e9 d\u2019occupation et le rejet des d\u00e9lais de paiement sont \u00e9galement prononc\u00e9s. L\u2019indemnit\u00e9 d\u2019occupation due par le locataire depuis l\u2019acquisition de la clause r\u00e9solutoire est fix\u00e9e \u00e0 titre provisionnel. Le juge rejette la demande de d\u00e9lais de paiement car elle n\u2019est pas justifi\u00e9e. Ces mesures assurent une compensation financi\u00e8re imm\u00e9diate au bailleur.
