Le requ\u00e9rant invoque un trouble manifestement illicite fond\u00e9 sur un empi\u00e8tement et une violation d&#8217;un r\u00e8glement de lotissement. Le juge interdit les travaux au-del\u00e0 d&#8217;une limite de propri\u00e9t\u00e9 sous astreinte mais rejette les autres demandes, notamment la remise en \u00e9tat et le grief tir\u00e9 du r\u00e8glement.<\/p>\n<p>La caract\u00e9risation prudente du trouble manifestement illicite<\/p>\n<p>L&#8217;exigence d&#8217;une preuve certaine pour les mesures r\u00e9paratrices<\/p>\n<p>Le juge \u00e9carte la demande de remise en \u00e9tat en l&#8217;absence de constat objectif des d\u00e9passements. &#8220;la preuve n&#8217;est pas rapport\u00e9e par un constat objectif comportant des mesures pr\u00e9cises que les travaux d\u00e9j\u00e0 ex\u00e9cut\u00e9s ont d\u00e9pass\u00e9 la ligne divisoire&#8221; (Motifs). Cette exigence d&#8217;une preuve concr\u00e8te et mesur\u00e9e limite les mesures r\u00e9troactives en r\u00e9f\u00e9r\u00e9. Elle prot\u00e8ge ainsi le d\u00e9fendeur contre des obligations incertaines tout en pr\u00e9servant la fonction pr\u00e9ventive de la juridiction.<\/p>\n<p>La pr\u00e9vention d&#8217;un risque futur justifie une mesure d&#8217;interdiction<\/p>\n<p>Le juge retient n\u00e9anmoins un trouble futur fond\u00e9 sur le risque d&#8217;empi\u00e8tement. &#8220;l&#8217;existence de plans valid\u00e9s par une autorisation administrative ne prenant pas en compte les limites du g\u00e9om\u00e8tre fait craindre de mani\u00e8re l\u00e9gitime un empi\u00e8tement&#8221; (Motifs). Cette appr\u00e9hension l\u00e9gitime permet d&#8217;agir pr\u00e9ventivement. La d\u00e9cision ordonne donc une interdiction de travaux sous astreinte pour garantir le respect de la limite reconnue, anticipant ainsi un dommage irr\u00e9versible.<\/p>\n<p>La d\u00e9limitation du champ d&#8217;application des r\u00e8gles contractuelles<\/p>\n<p>L&#8217;inapplicabilit\u00e9 du r\u00e8glement aux espaces communs<\/p>\n<p>Le juge rejette le grief tir\u00e9 de la violation d&#8217;un r\u00e8glement de lotissement. &#8220;la S.C.I. STEVAL ne peut se pr\u00e9valoir des dispositions du r\u00e8glement de lotissement pour contester le non respect de r\u00e8gles applicables aux seuls espaces privatifs&#8221; (Motifs). Cette analyse restrictive s&#8217;appuie sur une interpr\u00e9tation litt\u00e9rale des statuts de l&#8217;association syndicale. Elle distingue clairement la propri\u00e9t\u00e9 privative de la gestion collective, limitant les recours individuels sur les parties communes.<\/p>\n<p>La confirmation de la comp\u00e9tence des associations syndicales<\/p>\n<p>La d\u00e9cision reconna\u00eet implicitement la pr\u00e9rogative de l&#8217;association syndicale sur les voiries. &#8220;l&#8217;implantation de l&#8217;antenne est op\u00e9r\u00e9e sur une voirie, dont la gestion des charges est donc confi\u00e9e statutairement \u00e0 l&#8217;ASL&#8221; (Motifs). Ce point \u00e9carte l&#8217;action individuelle au profit des m\u00e9canismes de gestion collective pr\u00e9vus par les statuts. Il renforce ainsi l&#8217;autorit\u00e9 des associations syndicales dans l&#8217;administration des \u00e9quipements communs, conform\u00e9ment \u00e0 leur objet statutaire.<\/p>\n<p>Cette ordonnance illustre la gestion \u00e9quilibr\u00e9e du r\u00e9f\u00e9r\u00e9 en mati\u00e8re immobili\u00e8re. Elle exige une preuve tangible pour les r\u00e9parations tout en autorisant des mesures pr\u00e9ventives contre un risque s\u00e9rieux. Elle pr\u00e9cise \u00e9galement le partage des comp\u00e9tences entre propri\u00e9taires individuels et associations syndicales.
