Suite \u00e0 une assignation pour d\u00e9faut de paiement, la locataire n\u2019a pas comparu. Le juge a examin\u00e9 la r\u00e9gularit\u00e9 de la r\u00e9siliation du bail et le montant de la cr\u00e9ance locative. La d\u00e9cision prononce l\u2019expulsion et condamne au paiement d\u2019un arri\u00e9r\u00e9 tout en rejetant certaines demandes.<\/p>\n<p>La r\u00e9gularit\u00e9 de la r\u00e9siliation pour d\u00e9faut de paiement<\/p>\n<p>Le juge applique le d\u00e9lai l\u00e9gal ant\u00e9rieur \u00e0 la r\u00e9forme. L\u2019article 24 de la loi du 6 juillet 1989 pr\u00e9voit un d\u00e9lai de six semaines apr\u00e8s un commandement infructueux. Toutefois, la r\u00e9forme n\u2019est pas r\u00e9troactive pour les baux en cours. &#8220;Il est admis que l\u2019article 10 de la loi N\u00b02023-668 du 27 juillet 2023 ayant r\u00e9duit \u00e0 six semaines le d\u00e9lai minimal accord\u00e9 au locataire pour apurer sa dette n\u2019est pas imm\u00e9diatement applicable aux contrats en cours&#8221; (avis de la Cour de Cassation du 13 juin 2024 &#8211; Pourvoi N\u00b024-70.002). Le d\u00e9lai contractuel de deux mois reste donc applicable. Cette solution pr\u00e9serve la s\u00e9curit\u00e9 juridique et les droits acquis des parties aux contrats anciens. Elle limite la port\u00e9e imm\u00e9diate des r\u00e9formes protectrices des locataires.<\/p>\n<p>Le juge \u00e9carte la suspension li\u00e9e au surendettement. L\u2019article 24 VI de la loi du 6 juillet 1989 organise un r\u00e9gime d\u00e9rogatoire. La suspension de l\u2019exigibilit\u00e9 n\u2019emp\u00eache pas la r\u00e9siliation pour d\u00e9faut de paiement du loyer courant. La preuve du d\u00e9faut de paiement r\u00e9gulier des loyers courants est rapport\u00e9e. En cons\u00e9quence, la <a href=\"https:\/\/kohenavocats.fr\/avocat-resiliation-bail-paris\/\" target=\"_blank\" title=\"clause r\u00e9solutoire\">clause r\u00e9solutoire<\/a> reprend son plein effet et l\u2019expulsion est ordonn\u00e9e. Ce point rappelle que les mesures de traitement du surendettement ne prot\u00e8gent pas contre l\u2019inex\u00e9cution des obligations nouvelles.<\/p>\n<p>Le contr\u00f4le des demandes financi\u00e8res et l\u2019\u00e9quit\u00e9 proc\u00e9durale<\/p>\n<p>Le juge rejette les demandes non soumises au contradictoire. Les sommes r\u00e9clam\u00e9es au-del\u00e0 de l\u2019assignation constituent des demandes nouvelles. &#8220;Elles doivent donc \u00eatre regard\u00e9es comme des demandes nouvelles et irrecevables comme n&#8217;ayant pas pu \u00eatre soumises \u00e0 la contradiction des parties&#8221; (Tribunal judiciaire de Chartres, le 10 f\u00e9vrier 2026, n\u00b025\/00401). Ce principe fondamental du proc\u00e8s \u00e9quitable s\u2019applique m\u00eame en l\u2019absence de la partie d\u00e9faillante. Il garantit que le jugement ne statue que sur ce qui a \u00e9t\u00e9 d\u00e9battu.<\/p>\n<p>Le juge op\u00e8re un contr\u00f4le strict du d\u00e9compte et use de son pouvoir d\u2019\u00e9quit\u00e9. Les frais de poursuite sont exclus car ils ne constituent pas la dette principale. Le montant de la cr\u00e9ance est r\u00e9duit en cons\u00e9quence pour ne retenir que les sommes justifi\u00e9es. Par ailleurs, le juge d\u00e9boute le bailleur de sa demande sur le fondement de l\u2019article 700 du code de proc\u00e9dure civile. Il prend en compte la situation \u00e9conomique respective des parties.
