L\u2019affaire na\u00eet d\u2019une indivision successorale autour de deux immeubles donn\u00e9s \u00e0 bail et du devenir des loyers per\u00e7us. Des coh\u00e9ritiers all\u00e8guent un recel et sollicitent, en proc\u00e9dure d\u2019urgence, le versement direct des loyers entre les mains du notaire ainsi que des mesures de communication forc\u00e9e. D\u2019autres soutiennent qu\u2019aucun d\u00e9tournement n\u2019est \u00e9tabli et que les loyers ont \u00e9t\u00e9 dirig\u00e9s vers l\u2019indivision, les op\u00e9rations successorales se poursuivant devant le notaire. La question pos\u00e9e tient \u00e0 l\u2019office du juge des r\u00e9f\u00e9r\u00e9s en mati\u00e8re successorale, \u00e0 l\u2019articulation des articles 835 et 145 du code de proc\u00e9dure civile, et \u00e0 la port\u00e9e de l\u2019article 778 du code civil. La solution confirme le refus des mesures sollicit\u00e9es, pr\u00e9cise qu\u2019\u00ab il n\u2019y a pas lieu \u00e0 r\u00e9f\u00e9r\u00e9 \u00bb, et rappelle la rigueur des conditions gouvernant l\u2019urgence conservatoire et la preuve in futurum.<\/p>\n<p>I. L\u2019office du juge des r\u00e9f\u00e9r\u00e9s en mati\u00e8re successorale<\/p>\n<p>A. Mesures conservatoires et fronti\u00e8res du trouble manifestement illicite<br \/>\nLe texte de r\u00e9f\u00e9rence est rappel\u00e9 sans d\u00e9tour: \u00ab L\u2019article 835 alin\u00e9a 1 du code de proc\u00e9dure civile pr\u00e9voit que le pr\u00e9sident du tribunal judiciaire peut toujours, m\u00eame en cas de contestation s\u00e9rieuse, prescrire en r\u00e9f\u00e9r\u00e9 les mesures conservatoires ou de remise en \u00e9tat qui s\u2019imposent, soit pour pr\u00e9venir un dommage imminent, soit pour faire cesser un trouble manifestement illicite. \u00bb La d\u00e9cision pr\u00e9cise l\u2019assise notionnelle: \u00ab Le trouble manifestement illicite r\u00e9sulte de toute perturbation r\u00e9sultant d\u2019un fait qui, directement ou indirectement, constitue une violation \u00e9vidente de la r\u00e8gle de droit. \u00bb Elle d\u00e9finit, en miroir, le risque \u00e9vit\u00e9: \u00ab Le dommage imminent s\u2019entend du dommage, qui n\u2019est pas encore r\u00e9alis\u00e9, mais qui se produira s\u00fbrement si la situation pr\u00e9sente doit se perp\u00e9tuer. \u00bb L\u2019office du juge des r\u00e9f\u00e9r\u00e9s admet donc l\u2019intervention conservatoire, y compris en pr\u00e9sence de contestations, \u00e0 la condition d\u2019un trouble \u00e9vident ou d\u2019un p\u00e9ril certain. En revanche, la condamnation \u00e0 un paiement ou l\u2019ex\u00e9cution d\u2019une obligation contest\u00e9e rel\u00e8ve des mesures de provision, lesquelles exigent l\u2019absence de contestation s\u00e9rieuse, distincte des mesures strictement conservatoires.<\/p>\n<p>La Cour s\u2019inscrit dans cette orthodoxie en distinguant entre protection d\u2019une situation et anticipation d\u2019un droit. Elle admet que le s\u00e9questre peut, en principe, entrer dans le champ conservatoire, mais refuse qu\u2019il serve de relais pour obtenir un paiement sous astreinte lorsque l\u2019obligation est d\u00e9battue et partiellement satisfaite. Cette fronti\u00e8re, classique, pr\u00e9serve le provisoire de d\u00e9rives condamnatoires.<\/p>\n<p>B. La preuve in futurum et l\u2019exigence de motif l\u00e9gitime<br \/>\nLe cadre probatoire est \u00e9galement rappel\u00e9: \u00ab En application des dispositions de l\u2019article 145 de ce m\u00eame code, s\u2019il existe un motif l\u00e9gitime de conserver ou d\u2019\u00e9tablir avant tout proc\u00e8s la preuve des faits dont pourrait d\u00e9pendre la solution d\u2019un litige, les mesures d\u2019instruction l\u00e9galement admissibles peuvent \u00eatre ordonn\u00e9es [\u2026]. \u00bb La Cour \u00e9nonce la double condition d\u2019admissibilit\u00e9 et d\u2019utilit\u00e9: \u00ab Elle est \u00e9galement subordonn\u00e9e \u00e0 l\u2019existence d\u2019un motif l\u00e9gitime et \u00e0 la recherche ou la conservation des preuves, qui doit \u00eatre utile. \u00bb Le contr\u00f4le porte ainsi sur la pertinence de la demande et sur l\u2019absence de d\u00e9rive exploratoire. L\u2019article 145 ne fonde pas une collecte g\u00e9n\u00e9rale d\u2019informations financi\u00e8res; il suppose des \u00e9l\u00e9ments objectifs rendant la preuve n\u00e9cessaire au litige envisag\u00e9.<\/p>\n<p>Appliquant ce standard, la Cour souligne que des pi\u00e8ces bancaires existent d\u00e9j\u00e0, que l\u2019\u00e9tat des loyers ressort des \u00e9changes avec le notaire, et que l\u2019all\u00e9gation de recel manque d\u2019indices concrets. La demande probatoire, d\u00e8s lors, n\u2019est pas utile au sens de l\u2019article 145.<\/p>\n<p>II. L\u2019application aux loyers indivis et au recel successoral<\/p>\n<p>A. Loyers, s\u00e9questre et contestation s\u00e9rieuse<br \/>\nLa Cour constate que les loyers ont \u00e9t\u00e9 vers\u00e9s au notaire pendant une p\u00e9riode significative et que les baux ont cess\u00e9 par le d\u00e9part des locataires. L\u2019objectif de s\u00e9questre, d\u00e9j\u00e0 atteint en pratique, \u00f4te \u00e0 la mesure son caract\u00e8re n\u00e9cessaire. La d\u00e9cision retient, de mani\u00e8re nette, que \u00ab la demande de versements des loyers des immeubles indivis sous astreinte \u00e0 compter du 1er octobre 2023 se heurte \u00e0 une contestation s\u00e9rieuse. \u00bb En effet, la mesure sollicit\u00e9e \u00e9quivaut \u00e0 une ex\u00e9cution contrainte d\u2019une obligation contest\u00e9e, exc\u00e9dant le p\u00e9rim\u00e8tre conservatoire de l\u2019article 835 alin\u00e9a 1. Le juge des r\u00e9f\u00e9r\u00e9s ne peut suppl\u00e9er le notaire dans la conduite ordonn\u00e9e des flux lorsque la satisfaction partielle est av\u00e9r\u00e9e et que le d\u00e9bat sur d\u2019\u00e9ventuels arri\u00e9r\u00e9s n\u00e9cessite un examen au fond.<\/p>\n<p>Cette appr\u00e9ciation conduit logiquement \u00e0 une confirmation de l\u2019ordonnance, avec la pr\u00e9cision de principe selon laquelle \u00ab il n\u2019y a pas lieu \u00e0 r\u00e9f\u00e9r\u00e9 \u00bb. La formule consacre l\u2019impropri\u00e9t\u00e9 du cadre d\u2019urgence face \u00e0 une divergence qui requiert le juge du fond.<\/p>\n<p>B. Recel successoral et refus des divulgations forc\u00e9es<br \/>\nSur le terrain du recel, le rappel de l\u2019article 778 du code civil assoit la gravit\u00e9 des cons\u00e9quences: \u00ab L\u2019h\u00e9ritier receleur est tenu de rendre tous les fruits et revenus produits par les biens recel\u00e9s dont il a eu la jouissance depuis l\u2019ouverture de la succession. \u00bb Encore faut-il \u00e9tablir la mat\u00e9rialit\u00e9 des d\u00e9tournements et l\u2019intention de dissimulation. La Cour rel\u00e8ve l\u2019insuffisance d\u2019\u00e9l\u00e9ments objectifs, malgr\u00e9 l\u2019existence de relev\u00e9s bancaires et l\u2019absence de preuve d\u2019une alt\u00e9ration des facult\u00e9s de la d\u00e9funte sur la p\u00e9riode critique. L\u2019\u00e9difice probatoire exig\u00e9 pour caract\u00e9riser un trouble manifestement illicite n\u2019est pas atteint.<\/p>\n<p>Dans ce contexte, les demandes de communication g\u00e9n\u00e9rale d\u2019avis fiscaux et d\u2019extraits de comptes, sous astreinte, ne satisfont ni le crit\u00e8re de pertinence ni celui d\u2019utilit\u00e9. L\u2019outil de l\u2019article 145 ne saurait pallier l\u2019absence d\u2019indices pr\u00e9cis; il encadre la preuve, il ne l\u2019invente pas.
