La cour confirme la validit\u00e9 du cong\u00e9 et le principe d&#8217;une indemnit\u00e9 d&#8217;occupation. La port\u00e9e est probatoire et exige un lien causal certain. Elle \u00e9vite les indemnisations pour simples d\u00e9sagr\u00e9ments.<\/p>\n<p>La distinction nette entre obligations contractuelles et responsabilit\u00e9 extracontractuelle<\/p>\n<p>La cour refuse d&#8217;indemniser un pr\u00e9judice moral invoqu\u00e9 par la locataire. Elle rappelle que seul l&#8217;emp\u00eachement total d&#8217;habiter le logement permet de suspendre le paiement.
