Celle-ci contestait la pose d\u2019une b\u00e2che publicitaire pour une marque concurrente lors de travaux de ravalement. Elle assigna son bailleur, le syndic de copropri\u00e9t\u00e9, le syndicat des copropri\u00e9taires et la soci\u00e9t\u00e9 signataire du contrat publicitaire. La question de droit \u00e9tait de savoir si cette b\u00e2che constituait un trouble manifestement illicite justifiant son retrait en r\u00e9f\u00e9r\u00e9. Le juge a rejet\u00e9 l\u2019ensemble des demandes et dit n\u2019y avoir lieu \u00e0 r\u00e9f\u00e9r\u00e9.<\/p>\n<p>I. La recevabilit\u00e9 des demandes et la r\u00e9gularit\u00e9 des actes de proc\u00e9dure.<br \/>A. Le rejet des exceptions de nullit\u00e9 des assignations.<\/p>\n<p>Le juge a \u00e9cart\u00e9 l\u2019exception de nullit\u00e9 soulev\u00e9e par le syndic, estimant que l\u2019assignation ne comportait aucune erreur de d\u00e9signation. Il a jug\u00e9 que la question de savoir si la demande devait \u00eatre dirig\u00e9e contre le syndic ou le syndicat relevait du bien-fond\u00e9. Cette solution a une valeur protectrice de la r\u00e9gularit\u00e9 formelle des actes, \u00e9vitant des annulations pour des motifs mineurs. Sa port\u00e9e est de rappeler que seule l\u2019ambigu\u00eft\u00e9 sur la partie assign\u00e9e constitue un vice de fond. De m\u00eame, l\u2019exception soulev\u00e9e par la soci\u00e9t\u00e9 publicitaire a \u00e9t\u00e9 rejet\u00e9e, les motifs de l\u2019assignation \u00e9tant jug\u00e9s suffisants pour pr\u00e9parer la d\u00e9fense.<\/p>\n<p>B. Le rejet des fins de non-recevoir pour d\u00e9faut de qualit\u00e9 \u00e0 d\u00e9fendre.<\/p>\n<p>Le juge a \u00e9cart\u00e9 les fins de non-recevoir, consid\u00e9rant que le d\u00e9faut de qualit\u00e9 all\u00e9gu\u00e9 relevait du bien-fond\u00e9 et non de la recevabilit\u00e9. Il a pr\u00e9cis\u00e9 que la demanderesse dirigeait sa demande principale contre le bailleur et le syndicat, et non contre le syndic ou la soci\u00e9t\u00e9 publicitaire. Cette d\u00e9cision a une valeur p\u00e9dagogique, distinguant clairement la recevabilit\u00e9 de l\u2019action de son succ\u00e8s au fond. Sa port\u00e9e est de limiter les exceptions dilatoires en r\u00e9f\u00e9r\u00e9, concentrant le d\u00e9bat sur l\u2019existence du trouble.<\/p>\n<p>II. L\u2019absence de trouble manifestement illicite justifiant une mesure en r\u00e9f\u00e9r\u00e9.<br \/>A. L\u2019insuffisance de preuve d\u2019une violation \u00e9vidente de la r\u00e8gle de droit.<\/p>\n<p>Le juge a rappel\u00e9 que le trouble manifestement illicite exige une violation \u00e9vidente de la r\u00e8gle de droit. Il a constat\u00e9 que les travaux et la b\u00e2che avaient \u00e9t\u00e9 valablement vot\u00e9s en assembl\u00e9e g\u00e9n\u00e9rale des copropri\u00e9taires. Il a estim\u00e9 que la locataire ne d\u00e9montrait pas que les nuisances exc\u00e9daient la g\u00eane normale de travaux de ravalement. Cette solution a une valeur d\u2019application stricte de l\u2019article 835 du code de proc\u00e9dure civile. Sa port\u00e9e est de rappeler que le r\u00e9f\u00e9r\u00e9 n\u2019est pas une voie pour contester des d\u00e9cisions collectives valides sans preuve d\u2019un exc\u00e8s.<\/p>\n<p>B. L\u2019absence de preuve d\u2019un pr\u00e9judice grave et actuel.<\/p>\n<p>Le juge a relev\u00e9 que la locataire n\u2019apportait aucune preuve d\u2019une baisse de fr\u00e9quentation ou de chiffre d\u2019affaires, malgr\u00e9 la pr\u00e9sence de la b\u00e2che depuis plusieurs semaines. Il a \u00e9galement not\u00e9 l\u2019absence de d\u00e9monstration d\u2019une concurrence directe entre son activit\u00e9 d\u2019ultra-luxe et la marque publicitaire. Il a conclu qu\u2019aucune perturbation r\u00e9sultant d\u2019un fait mat\u00e9riel ou juridique n\u2019\u00e9tait \u00e9tablie avec l\u2019\u00e9vidence requise. Cette d\u00e9cision a une valeur probatoire exigeante pour le demandeur en r\u00e9f\u00e9r\u00e9.
