N\u00e4rings-, trafik- och milj\u00f6centralen (NTM-centralen) hade beviljat A tillst\u00e5nd f\u00f6r en anslutning till f\u00f6rbindelsev\u00e4gen f\u00f6r ut\u00f6vande av n\u00e4ringsverksamhet eller s\u00e4rskild anv\u00e4ndning. B och C som inte hade h\u00f6rts av NTM-centralen blev underr\u00e4ttade om tillst\u00e5ndet f\u00f6r anslutningen efter att besv\u00e4rstiden g\u00e5tt ut. F\u00f6rvaltningsdomstolen pr\u00f6vade B:S och C:s yrkanden som inl\u00e4mnats efter att besv\u00e4rstiden hade g\u00e5tt ut som en i f\u00f6rvaltningsprocesslagen (586\/1996) avsedd klagan och avslog den.<\/p>\n<p>H\u00f6gsta f\u00f6rvaltningsdomstolen beviljade besv\u00e4rstillst\u00e5nd. H\u00f6gsta f\u00f6rvaltningsdomstolen hade att p\u00e5 B:s och C:s besv\u00e4r avg\u00f6ra om NTM-centralen borde ha h\u00f6rt B och C innan den avgjorde ovan n\u00e4mnda tillst\u00e5nds\u00e4rende.<\/p>\n<p>H\u00f6gsta f\u00f6rvaltningsdomstolen konstaterade att det inte i landsv\u00e4gslagen (503\/2005) ing\u00e5r best\u00e4mmelser om vem som \u00e4r part i ett \u00e4rende som g\u00e4ller tillst\u00e5nd f\u00f6r anslutning. P\u00e5 behandlingen av ans\u00f6kan om tillst\u00e5nd f\u00f6r anslutning till\u00e4mpas d\u00e4rf\u00f6r f\u00f6rvaltningslagens best\u00e4mmelser om parter och h\u00f6rande av part.<\/p>\n<p>Enligt tillst\u00e5ndsans\u00f6kan var anslutningen t\u00e4nkt att g\u00f6ras till servitutsv\u00e4gen p\u00e5 B:s och C:s fastighet och anslutningens avfart, som enligt den anvisning som bifogats tillst\u00e5ndsbeslutet m\u00e5ste bel\u00e4ggas, placerade sig delvis p\u00e5 \u00e4ndringss\u00f6kandenas fastighet. P\u00e5 dessa grunder ans\u00e5g h\u00f6gsta f\u00f6rvaltningsdomstolen att B och C var parter i \u00e4rendet enligt 11 \u00a7 i f\u00f6rvaltningslagen. NTM-centralen borde d\u00e4rf\u00f6r ha berett B och C tillf\u00e4lle att bli h\u00f6rda innan \u00e4rendet avgjordes.<\/p>\n<p>Eftersom B och C inte hade h\u00f6rts i \u00e4rendet och eftersom NTM-centralens beslut kr\u00e4nkte deras r\u00e4ttigheter som \u00e4gare av den fastighet som var f\u00f6rem\u00e5l f\u00f6r de i tillst\u00e5ndet angivna \u00e5tg\u00e4rderna, upph\u00e4vde och undanr\u00f6jde h\u00f6gsta f\u00f6rvaltningsdomstolen NTM-centralens beslut och \u00e5terf\u00f6rvisade \u00e4rendet till NTM-centralen f\u00f6r ny behandling. Samtidigt upph\u00e4vdes f\u00f6rvaltningsdomstolens beslut att avsl\u00e5 klagan.<\/p>\n<h3>F\u00f6rvaltningslagen 11 \u00a7 och 34 \u00a7<\/h3>\n<p>Landsv\u00e4gslagen (503\/2005) 105 \u00a7 2 mom. (566\/2016)<\/p>\n<p>F\u00f6rvaltningsprocesslagen (586\/1996) 58 \u00a7, 59 \u00a7 1 mom. 1 punkten, 60 \u00a7 2 mom. och 67 \u00a7 2 mom.<\/p>\n<p>Lagen om r\u00e4tteg\u00e5ng i f\u00f6rvaltnings\u00e4renden 87 \u00a7, 107 \u00a7 1 mom., 111 \u00a7 1 mom., 125 \u00a7, 126 \u00a7 2 och 3 mom.<\/p>\n<p>A:lla oli tieoikeus B:n ja C:n omistaman kiinteist\u00f6n alueella. Elinkeino-, liikenne- ja ymp\u00e4rist\u00f6keskus (ELY-keskus) oli my\u00f6nt\u00e4nyt A:lle luvan tehd\u00e4 tiehen elinkeinon harjoittamiseen tai erityisk\u00e4ytt\u00f6\u00f6n tarkoitetun liittym\u00e4n yhdystielle. B ja C, joita ELY-keskus ei ollut kuullut asiassa, olivat saaneet tiedon liittym\u00e4luvan my\u00f6nt\u00e4misest\u00e4 valitusajan umpeuduttua. Hallinto-oikeus oli tutkinut B:n ja C:n valitusajan j\u00e4lkeen esitt\u00e4m\u00e4t vaatimukset asiassa tehtyn\u00e4 hallintolaink\u00e4ytt\u00f6laissa (586\/1996) tarkoitettuna kanteluna ja hyl\u00e4nnyt kantelun.<\/p>\n<p>Korkein hallinto-oikeus my\u00f6nsi asiassa valitusluvan. Korkeimmassa hallinto-oikeudessa oli B:n ja C:n valituksesta arvioitavana, oliko ELY-keskuksen tullut kuulla B:t\u00e4 ja C:t\u00e4 ennen edell\u00e4 tarkoitetun lupa-asian ratkaisemista.<\/p>\n<p>Korkein hallinto-oikeus totesi, ettei maantielaissa (503\/2005) ollut s\u00e4\u00e4nn\u00f6ksi\u00e4 siit\u00e4, keit\u00e4 liittym\u00e4lupaa koskevassa asiassa oli pidett\u00e4v\u00e4 asianosaisina. Liittym\u00e4lupahakemuksen k\u00e4sittelyyn sovellettiin siten hallintolain s\u00e4\u00e4nn\u00f6ksi\u00e4 asianosaisista ja heid\u00e4n kuulemisestaan.<\/p>\n<p>Koska lupahakemuksen mukaan liittym\u00e4 oli tarkoitus tehd\u00e4 B:n ja C:n kiinteist\u00f6ll\u00e4 sijaitsevaan rasitetiehen ja koska liittym\u00e4n odotustila, joka oli lupap\u00e4\u00e4t\u00f6ksen liitteen\u00e4 olevan ohjeen mukaisesti p\u00e4\u00e4llystett\u00e4v\u00e4, sijoittui osittain muutoksenhakijoiden kiinteist\u00f6n alueelle, korkein hallinto-oikeus katsoi, ett\u00e4 B:t\u00e4 ja C:t\u00e4 oli pidett\u00e4v\u00e4 liittym\u00e4lupa-asiassa hallintolain 11 \u00a7:ss\u00e4 tarkoitettuina asianosaisina. ELY-keskuksen olisi t\u00e4m\u00e4n vuoksi tullut varata B:lle ja C:lle tilaisuus tulla kuulluiksi ennen asian ratkaisemista.<\/p>\n<p>Koska B:t\u00e4 ja C:t\u00e4 ei ollut asiassa kuultu ja koska ELY-keskuksen p\u00e4\u00e4t\u00f6s loukkasi heid\u00e4n oikeuttaan liittym\u00e4luvassa m\u00e4\u00e4r\u00e4ttyjen toimenpiteiden kohteena olevan kiinteist\u00f6n omistajina, korkein hallinto-oikeus kumosi ja poisti ELY-keskuksen p\u00e4\u00e4t\u00f6ksen ja palautti asian ELY-keskukselle uudelleen k\u00e4sitelt\u00e4v\u00e4ksi.
