II &#8212; N?o deve, por isso mesmo, ser atribu?da a resolu??o de tal lit?gio ? jurisdi??o administrativa, mas sim ao tribunal judicial, atenta a compet?ncia residual destes (art. 64.? do CPC). III &#8212; O art. 1405.?, n.? 2, do CC ? bem claro quando estabelece que cada consorte pode reivindicar de terceiro a coisa comum, sem que a este lhe seja l?cito opor-lhe que ela lhe n?o pertence por inteiro. IV &#8212; Consagra aquela norma a legitimidade de cada compropriet?rio para a ac??o de reivindica??o, numa situa??o manifesta de litiscons?rcio volunt?rio activo, pelo que os autores, desacompanhados dos demais com propriet?rios, s?o parte leg?tima (arts. 30.? e 32.?, n.? 2, ambos do CPC).
