INDEMNITE DE PREAVIS \u2013 NON-PAIEMENT \u2013 LICENCIEMENT \u2013 INFLUENCE (NON)<\/p>\n<p>\u00ab Le pr\u00e9avis qui se d\u00e9finit comme un d\u00e9lai pr\u00e9fix \u00e0 observer par les parties avant la rupture effective du contrat n&#039;intervient \u00e0 aucun moment dans la proc\u00e9dure de licenciement pr\u00e9vue par l&#039;article 32 du Code de Travail, ainsi le respect ou non, d&#039;une telle mesure pr\u00e9alable au licenciement ne saurait lui imprimer un caract\u00e8re abusif ou l\u00e9gitime. \u00bb<\/p>\n<p>Sieurs R.R.P. et R.F.<\/p>\n<p>La soci\u00e9t\u00e9 P.<\/p>\n<p>REPUBLIQUE DE MADAGASCAR<\/p>\n<p>COUR DE CASSATION<\/p>\n<p>CHAMBRE CIVILE COMMERCIALE ET SOCIALE<\/p>\n<p>La Cour de Cassation, Chambre civile commerciale et sociale en son audience publique ordinaire du mardi treize f\u00e9vrier deux mille dix huit, tenue au palais de Justice \u00e0 Anosy, a rendu l\u2019arr\u00eat dont la teneur suit :<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi;<\/p>\n<p>Statuant sur le pourvoi de R.R.P. et R.F., demeurant respectivement \u00e0 (adresse), ayant pour conseil Ma\u00eetre RAKOTOARISON Maharavo, avocat \u00e0 la Cour, \u00e9lisant domicile en l&#039;\u00e9tude dudit conseil au lot C 103 Ambatomalaza Alasora, contre l&#039;arr\u00eat n\u00b0 234 rendu le 04 novembre 2004 par la Chambre Sociale de la Cour d&#039;Appel d&#039;Antananarivo, dans la proc\u00e9dure qui les oppose \u00e0 la Soci\u00e9t\u00e9 P. ; <\/p>\n<p>Vu les m\u00e9moires en demande et en d\u00e9fense ;<\/p>\n<p>Sur les deux moyens de cassation r\u00e9unis tir\u00e9 de l&#039;article 26 de la Loi organique n\u00b02004.036 du 1er octobre 2004 sur la Cour Supr\u00eame, pris de la violation des articles 32, 33 et 29 de la loi n\u00b0 94 029 du 25 ao\u00fbt 1995 et des articles 2 et 4 du D\u00e9cret n\u00b0 64 162 du 22 avril 1964, pour fausse application ou fausse interpr\u00e9tation de la loi, en ce que la Cour d&#039;Appel a d\u00e9clar\u00e9 que le licenciement est conforme aux prescriptions de l&#039;article 32 du Code du Travail alors que les travailleurs n&#039;ont pu toucher leur indemnit\u00e9 de pr\u00e9avis que devant l&#039;Inspecteur de Travail et non au moment de leur licenciement comme l&#039;exige la loi ; (premier moyen)<\/p>\n<p>En ce que la Cour d&#039;Appel n&#039;a pas tenu compte du manquement de la soci\u00e9t\u00e9 P., qui n&#039;avait nullement l&#039;intention de s&#039;acquitter de l&#039;indemnit\u00e9 de pr\u00e9avis au moment du cong\u00e9diement, alors que celui qui prend l&#039;initiative de la rupture doit observer scrupuleusement les r\u00e8gles du pr\u00e9avis ;
