Quand la temp\u00e9rature monte, la question n&#8217;est pas seulement de savoir si le salari\u00e9 peut exercer son droit de retrait. Une autre question arrive tr\u00e8s vite sur la fiche de paie : si l&#8217;entreprise arr\u00eate le chantier \u00e0 cause de la canicule, qui paie les heures perdues ?<\/p>\n<p>Dans le b\u00e2timent et les travaux publics, il existe un r\u00e9gime particulier : le ch\u00f4mage intemp\u00e9ries. Ce r\u00e9gime ne concerne pas seulement la pluie, la neige ou le gel. Depuis la r\u00e9forme entr\u00e9e en vigueur en 2024, la canicule peut aussi \u00eatre prise en compte lorsqu&#8217;elle rend le travail dangereux ou impossible.<\/p>\n<p>Pour un salari\u00e9 du BTP, l&#8217;enjeu est concret. Il faut v\u00e9rifier si l&#8217;arr\u00eat du chantier rel\u00e8ve vraiment du ch\u00f4mage intemp\u00e9ries, si l&#8217;indemnit\u00e9 figure correctement sur la fiche de paie, si l&#8217;employeur pouvait demander une reprise, et quelles preuves conserver en cas de retenue injustifi\u00e9e sur salaire.<\/p>\n<p>Ces questions rel\u00e8vent du <a href=\"https:\/\/kohenavocats.com\/avocats-droit-social-paris\/\">droit du travail et du contentieux prud&#8217;homal<\/a>, car elles touchent \u00e0 la fois \u00e0 la s\u00e9curit\u00e9, au temps de travail et \u00e0 la r\u00e9mun\u00e9ration.<\/p>\n<h2>La canicule peut-elle justifier le ch\u00f4mage intemp\u00e9ries dans le BTP ?<\/h2>\n<p>Oui, mais pas automatiquement.<\/p>\n<p>L&#8217;article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006903887\">L. 5424-8 du Code du travail<\/a> d\u00e9finit les intemp\u00e9ries comme les conditions atmosph\u00e9riques et les inondations lorsqu&#8217;elles rendent dangereux ou impossible l&#8217;accomplissement du travail, en raison de la sant\u00e9 ou de la s\u00e9curit\u00e9 des salari\u00e9s, ou en raison de la nature ou de la technique du travail \u00e0 accomplir.<\/p>\n<p>L&#8217;article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049850899\">D. 5424-7-1 du Code du travail<\/a> pr\u00e9cise que les p\u00e9riodes de canicule font partie des conditions atmosph\u00e9riques pouvant \u00eatre retenues au titre de ce r\u00e9gime.<\/p>\n<p>Cela signifie qu&#8217;une forte chaleur ne suffit pas \u00e0 elle seule. Il faut \u00e9tablir un lien avec le chantier : exposition directe au soleil, port obligatoire d&#8217;\u00e9quipements lourds, travail en hauteur, effort physique, absence d&#8217;ombre, impossibilit\u00e9 technique de d\u00e9caler l&#8217;intervention, risque pour la sant\u00e9 ou la s\u00e9curit\u00e9.<\/p>\n<p>Un bureau climatis\u00e9, un atelier ventil\u00e9 et un chantier de toiture en plein soleil ne se traitent pas de la m\u00eame mani\u00e8re.<\/p>\n<h2>Qui d\u00e9cide d&#8217;arr\u00eater le chantier ?<\/h2>\n<p>En pratique, l&#8217;arr\u00eat du chantier est d\u00e9cid\u00e9 par l&#8217;employeur ou son repr\u00e9sentant. Le salari\u00e9 ne d\u00e9cide pas lui-m\u00eame de placer ses heures en ch\u00f4mage intemp\u00e9ries.<\/p>\n<p>L&#8217;employeur doit appr\u00e9cier la situation r\u00e9elle : niveau de chaleur, consignes de pr\u00e9vention, nature des t\u00e2ches, \u00e9tat du chantier, \u00e9quipement disponible, horaires possibles, zones d&#8217;ombre, acc\u00e8s \u00e0 l&#8217;eau, pauses, s\u00e9curit\u00e9 des d\u00e9placements et risques propres au poste.<\/p>\n<p>S&#8217;il estime que le travail est devenu dangereux ou impossible, il peut arr\u00eater tout ou partie de l&#8217;activit\u00e9. L&#8217;arr\u00eat peut concerner un chantier entier, une \u00e9quipe, une tranche horaire, ou seulement certaines t\u00e2ches.<\/p>\n<p>Cette distinction est importante. Si le salari\u00e9 est renvoy\u00e9 chez lui parce que l&#8217;activit\u00e9 est arr\u00eat\u00e9e, il ne s&#8217;agit pas d&#8217;une absence personnelle. Il faut donc v\u00e9rifier le traitement en paie.<\/p>\n<h2>Le salari\u00e9 conserve-t-il tout son salaire ?<\/h2>\n<p>Le ch\u00f4mage intemp\u00e9ries BTP n&#8217;est pas un maintien int\u00e9gral automatique du salaire habituel.<\/p>\n<p>Le salari\u00e9 peut avoir droit \u00e0 une indemnisation sp\u00e9cifique s&#8217;il remplit les conditions du r\u00e9gime. L&#8217;article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006903890\">L. 5424-11 du Code du travail<\/a> pr\u00e9voit que le salari\u00e9 a droit \u00e0 l&#8217;indemnisation pour intemp\u00e9ries s&#8217;il justifie avoir accompli un nombre minimum d&#8217;heures de travail avant l&#8217;arr\u00eat, dans une entreprise relevant du r\u00e9gime.<\/p>\n<p>Il faut donc lire la fiche de paie. Les lignes \u00e0 contr\u00f4ler sont notamment :<\/p>\n<p>la p\u00e9riode exacte d&#8217;arr\u00eat ;<\/p>\n<p>le nombre d&#8217;heures d\u00e9clar\u00e9es en intemp\u00e9ries ;<\/p>\n<p>la base de calcul retenue ;<\/p>\n<p>le montant de l&#8217;indemnit\u00e9 ;<\/p>\n<p>les \u00e9ventuelles retenues sur salaire ;<\/p>\n<p>les cong\u00e9s pay\u00e9s et droits annexes impact\u00e9s ;<\/p>\n<p>la coh\u00e9rence entre le planning, les pointages et le bulletin.<\/p>\n<p>Un salari\u00e9 ne doit pas se contenter d&#8217;une explication orale. Si une journ\u00e9e de chaleur appara\u00eet comme absence non r\u00e9mun\u00e9r\u00e9e, absence injustifi\u00e9e ou cong\u00e9 impos\u00e9, il faut demander une correction \u00e9crite.<\/p>\n<h2>L&#8217;employeur peut-il imposer des cong\u00e9s ou des RTT \u00e0 la place ?<\/h2>\n<p>L&#8217;employeur ne peut pas transformer librement un arr\u00eat de chantier li\u00e9 \u00e0 la canicule en cong\u00e9s pay\u00e9s pris au dernier moment.<\/p>\n<p>Les cong\u00e9s pay\u00e9s ob\u00e9issent \u00e0 des r\u00e8gles de fixation et de modification. Les RTT et jours de repos peuvent d\u00e9pendre de l&#8217;accord collectif applicable, mais ils ne servent pas \u00e0 effacer sans justification une interruption d&#8217;activit\u00e9 relevant d&#8217;un risque m\u00e9t\u00e9o ou s\u00e9curit\u00e9.<\/p>\n<p>Si le bulletin mentionne un cong\u00e9 pay\u00e9, un RTT ou une absence alors que le chantier a \u00e9t\u00e9 arr\u00eat\u00e9 pour forte chaleur, le salari\u00e9 doit demander :<\/p>\n<p>la raison pr\u00e9cise de la qualification retenue ;<\/p>\n<p>le document interne constatant l&#8217;arr\u00eat ;<\/p>\n<p>le nombre d&#8217;heures d\u00e9clar\u00e9es ;<\/p>\n<p>la r\u00e8gle conventionnelle appliqu\u00e9e ;<\/p>\n<p>le mode de calcul de la paie.<\/p>\n<p>Le point d\u00e9cisif est la coh\u00e9rence. Un employeur ne peut pas dire oralement que le chantier \u00e9tait trop dangereux, puis traiter la journ\u00e9e comme une absence personnelle du salari\u00e9.<\/p>\n<h2>Et si le chantier continue malgr\u00e9 une chaleur dangereuse ?<\/h2>\n<p>Le ch\u00f4mage intemp\u00e9ries n&#8217;\u00e9puise pas la question de la s\u00e9curit\u00e9.<\/p>\n<p>M\u00eame si l&#8217;employeur ne d\u00e9clare pas d&#8217;arr\u00eat d&#8217;activit\u00e9, il reste tenu de prot\u00e9ger la sant\u00e9 et la s\u00e9curit\u00e9 des salari\u00e9s. Depuis le d\u00e9cret relatif \u00e0 la pr\u00e9vention des risques li\u00e9s aux \u00e9pisodes de chaleur, l&#8217;article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051679293\">R. 4225-2 du Code du travail<\/a> impose notamment de mettre \u00e0 disposition de l&#8217;eau potable et fra\u00eeche pour permettre aux travailleurs de se d\u00e9salt\u00e9rer et de se rafra\u00eechir.<\/p>\n<p>Sur un chantier, les mesures utiles peuvent aussi comprendre l&#8217;adaptation des horaires, l&#8217;augmentation des pauses, l&#8217;organisation de zones d&#8217;ombre, la rotation des t\u00e2ches, le report de certaines interventions, l&#8217;information des salari\u00e9s et l&#8217;attention port\u00e9e aux salari\u00e9s vuln\u00e9rables.<\/p>\n<p>Si ces mesures sont absentes et que la situation cr\u00e9e un danger grave et imminent, le salari\u00e9 peut envisager le droit de retrait. Il faut toutefois rester prudent : le droit de retrait s&#8217;appr\u00e9cie au cas par cas. Il doit \u00eatre exerc\u00e9 de mani\u00e8re proportionn\u00e9e et document\u00e9e.<\/p>\n<p>Avant de quitter le poste, il faut alerter imm\u00e9diatement l&#8217;employeur ou le responsable de chantier, expliquer le danger pr\u00e9cis, conserver une preuve de l&#8217;alerte et \u00e9viter toute formulation vague.<\/p>\n<h2>Quelles preuves conserver en cas de litige sur la paie ?<\/h2>\n<p>Le salari\u00e9 doit construire un dossier simple et chronologique.<\/p>\n<p>Il faut d&#8217;abord conserver les bulletins de paie du mois concern\u00e9 et des mois pr\u00e9c\u00e9dents. Ils permettent de comparer les lignes habituelles, les retenues, les heures d\u00e9clar\u00e9es et les indemnit\u00e9s.<\/p>\n<p>Il faut ensuite garder les plannings, pointages, SMS, messages d&#8217;\u00e9quipe, consignes de chantier, photographies non dangereuses de la situation, relev\u00e9s m\u00e9t\u00e9o publics, ordre de rentrer, consigne d&#8217;arr\u00eat ou demande de reprise.<\/p>\n<p>Le salari\u00e9 doit aussi noter les faits le jour m\u00eame : heure d&#8217;arriv\u00e9e, temp\u00e9rature ressentie, t\u00e2ches pr\u00e9vues, mesures disponibles, d\u00e9cision du chef de chantier, heure de d\u00e9part, personnes pr\u00e9sentes et explication donn\u00e9e.<\/p>\n<p>Cette chronologie est souvent plus utile qu&#8217;un long r\u00e9cit. Elle permet de r\u00e9pondre \u00e0 trois questions :<\/p>\n<p>le chantier a-t-il \u00e9t\u00e9 arr\u00eat\u00e9 ?<\/p>\n<p>pour quel motif ?<\/p>\n<p>comment l&#8217;arr\u00eat a-t-il \u00e9t\u00e9 trait\u00e9 sur la paie ?<\/p>\n<h2>Que faire si l&#8217;indemnit\u00e9 n&#8217;est pas pay\u00e9e ?<\/h2>\n<p>La premi\u00e8re d\u00e9marche consiste \u00e0 demander une explication \u00e9crite \u00e0 l&#8217;employeur ou au service paie.<\/p>\n<p>Le message doit rester factuel. Il peut indiquer que le chantier a \u00e9t\u00e9 arr\u00eat\u00e9 \u00e0 telle date en raison des fortes chaleurs, que la fiche de paie mentionne une absence ou une retenue, et que le salari\u00e9 demande la r\u00e9gularisation ou le d\u00e9tail du calcul appliqu\u00e9.<\/p>\n<p>Si l&#8217;entreprise r\u00e9pond que l&#8217;arr\u00eat ne rel\u00e8ve pas du ch\u00f4mage intemp\u00e9ries, il faut demander pourquoi : t\u00e2che encore possible, autre poste propos\u00e9, horaires adapt\u00e9s, seuil non atteint, absence des conditions l\u00e9gales, ou autre motif.<\/p>\n<p>Si aucune r\u00e9ponse n&#8217;est donn\u00e9e, le salari\u00e9 peut adresser une mise en demeure, saisir l&#8217;inspection du travail pour signaler le traitement du risque chaleur, puis envisager une action prud&#8217;homale si le rappel de salaire ou d&#8217;indemnit\u00e9 reste impay\u00e9.<\/p>\n<p>Le d\u00e9lai d\u00e9pend de la nature des demandes. En mati\u00e8re de salaire, il faut agir sans attendre, car la preuve devient plus difficile avec le temps et les plannings disparaissent vite.<\/p>\n<h2>Le cas particulier de Paris et de l&#8217;\u00cele-de-France<\/h2>\n<p>En \u00cele-de-France, les chantiers expos\u00e9s \u00e0 la chaleur posent souvent une difficult\u00e9 suppl\u00e9mentaire : les trajets longs, les transports perturb\u00e9s, les sites min\u00e9raux, les toitures, les travaux de fa\u00e7ade et les interventions en cour int\u00e9rieure peu ventil\u00e9e.<\/p>\n<p>Pour un salari\u00e9 rattach\u00e9 \u00e0 un chantier \u00e0 Paris, dans les Hauts-de-Seine, en Seine-Saint-Denis, dans le Val-de-Marne ou dans les autres d\u00e9partements franciliens, il faut identifier le lieu d&#8217;ex\u00e9cution du travail, l&#8217;\u00e9tablissement employeur et le conseil de prud&#8217;hommes comp\u00e9tent.<\/p>\n<p>Cette v\u00e9rification compte en cas de r\u00e9f\u00e9r\u00e9 ou de demande de rappel de salaire. Le dossier doit \u00eatre pr\u00e9par\u00e9 avec le contrat, les bulletins de paie, les relev\u00e9s d&#8217;heures, les messages de chantier, la convention collective applicable et les \u00e9l\u00e9ments m\u00e9t\u00e9o du jour concern\u00e9.<\/p>\n<h2>Les erreurs \u00e0 \u00e9viter<\/h2>\n<p>La premi\u00e8re erreur consiste \u00e0 ne garder aucune trace. Une journ\u00e9e de canicule se discute difficilement plusieurs mois plus tard sans planning, message ou bulletin.<\/p>\n<p>La deuxi\u00e8me erreur consiste \u00e0 accepter une qualification floue sur la fiche de paie. Une absence injustifi\u00e9e, un cong\u00e9 pay\u00e9, un RTT impos\u00e9 et une indemnit\u00e9 intemp\u00e9ries n&#8217;ont pas les m\u00eames cons\u00e9quences.<\/p>\n<p>La troisi\u00e8me erreur consiste \u00e0 confondre droit de retrait et ch\u00f4mage intemp\u00e9ries. Le premier est une r\u00e9action individuelle \u00e0 un danger grave et imminent. Le second est un r\u00e9gime d&#8217;indemnisation li\u00e9 \u00e0 l&#8217;arr\u00eat d&#8217;activit\u00e9 dans le BTP.<\/p>\n<p>La quatri\u00e8me erreur consiste \u00e0 ne regarder que la temp\u00e9rature.
