Un cr\u00e9ancier poursuivant, titulaire d&#8217;un titre ex\u00e9cutoire constatant une cr\u00e9ance de 260 510,14 euros, avait fait d\u00e9livrer des commandements de payer valant saisie immobili\u00e8re le 18 septembre 2025. Assign\u00e9s \u00e0 l&#8217;audience d&#8217;orientation, les d\u00e9biteurs saisis ont sollicit\u00e9 l&#8217;autorisation de vendre amiablement leur immeuble, pr\u00e9sentant deux estimations immobili\u00e8res \u00e9valuant le prix entre 75 000 et 90 000 euros. Le cr\u00e9ancier s&#8217;en est rapport\u00e9 \u00e0 justice sur cette demande. Le juge a autoris\u00e9 la vente amiable au prix minimum de 90 000 euros, suspendu la proc\u00e9dure pour quatre mois et fix\u00e9 une audience de rappel. La question de droit centrale est celle des conditions dans lesquelles le juge de l&#8217;ex\u00e9cution peut autoriser une vente amiable en cours de saisie immobili\u00e8re. En permettant cette voie, le tribunal fait application des articles R. 322-15 et suivants du code des proc\u00e9dures civiles d&#8217;ex\u00e9cution. La solution retenue appelle une analyse de la r\u00e9gularit\u00e9 de la proc\u00e9dure de saisie, d&#8217;une part, et de l&#8217;appr\u00e9ciation des conditions de la vente amiable, d&#8217;autre part.<\/p>\n<h2 id=\"i-la-regularite-de-la-procedure-de-saisie-immobiliere-et-la-fixation-de-la-crean\">I. La r\u00e9gularit\u00e9 de la proc\u00e9dure de saisie immobili\u00e8re et la fixation de la cr\u00e9ance<\/h2>\n<p><\/p>\n<h3 id=\"a-la-verification-des-conditions-legales-de-la-saisie\">A. La v\u00e9rification des conditions l\u00e9gales de la saisie<\/h3>\n<p>Le juge de l&#8217;ex\u00e9cution a d&#8217;abord constat\u00e9 que les conditions pos\u00e9es par les articles L. 311-2, L. 311-4 et L. 311-6 du code des proc\u00e9dures civiles d&#8217;ex\u00e9cution \u00e9taient r\u00e9unies. Le cr\u00e9ancier justifiait d&#8217;un titre ex\u00e9cutoire, un jugement du 24 f\u00e9vrier 2022, signifi\u00e9 aux d\u00e9biteurs et rev\u00eatu de l&#8217;autorit\u00e9 de la chose jug\u00e9e. Il a ainsi satisfait \u00e0 l&#8217;exigence d&#8217;une cr\u00e9ance liquide et exigible. La Cour de cassation rappelle que <em>&#187; le cr\u00e9ancier ne peut poursuivre le recouvrement que des sommes dues en ex\u00e9cution du titre ex\u00e9cutoire, vis\u00e9 \u00e0 l&#8217;acte, en vertu duquel la saisie est pratiqu\u00e9e &#171;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67e4f450482b9311fa9a3eb0\" rel=\"nofollow\" target=\"_blank\">(Cass. 2e civ., 27 mars 2025, n\u00b022-18.591)<\/a><\/strong>. En l&#8217;esp\u00e8ce, le commandement de payer et l&#8217;assignation mentionnent le jugement fondant les poursuites. Le juge a donc pu valider la saisie immobili\u00e8re sans contestation sur ce point. Il a \u00e9galement v\u00e9rifi\u00e9 que les d\u00e9biteurs \u00e9taient propri\u00e9taires du bien, l&#8217;\u00e9tat hypoth\u00e9caire \u00e9tant produit. La r\u00e9gularit\u00e9 formelle de la proc\u00e9dure est ainsi \u00e9tablie.<\/p>\n<h3 id=\"b-la-fixation-du-montant-de-la-creance-et-des-frais\">B. La fixation du montant de la cr\u00e9ance et des frais<\/h3>\n<p>Le juge a arr\u00eat\u00e9 le montant de la cr\u00e9ance \u00e0 260 510,14 euros, en principal, int\u00e9r\u00eats \u00e9chus et frais justifi\u00e9s. Il a \u00e9cart\u00e9 certains frais non d\u00e9taill\u00e9s, exer\u00e7ant son pouvoir souverain d&#8217;appr\u00e9ciation. Cette fixation est n\u00e9cessaire pour d\u00e9terminer le montant que la vente devra permettre de recouvrer. Le tribunal a \u00e9galement tax\u00e9 les frais de poursuite \u00e0 2 153,75 euros, en d\u00e9duisant le droit d&#8217;engagement des poursuites inclus dans le commandement. Cette op\u00e9ration est conforme \u00e0 l&#8217;article R. 322-15 qui impose au juge de v\u00e9rifier l&#8217;ensemble des conditions de la saisie. En retenant une cr\u00e9ance sup\u00e9rieure au prix de vente envisag\u00e9 (90 000 euros), le jugement souligne que la vente amiable ne permettra pas un d\u00e9sint\u00e9ressement complet, mais le juge n&#8217;en fait pas un obstacle. Il privil\u00e9gie la solution n\u00e9goci\u00e9e, conform\u00e9ment \u00e0 l&#8217;esprit des textes qui tendent \u00e0 favoriser les ventes amiables lorsque les conditions sont satisfaisantes.<\/p>\n<h2 id=\"ii-lorientation-vers-la-vente-amiable-conditions-et-consequences\">II. L&#8217;orientation vers la vente amiable : conditions et cons\u00e9quences<\/h2>\n<p><\/p>\n<h3 id=\"a-lappreciation-des-conditions-satisfaisantes-de-la-vente-amiable\">A. L&#8217;appr\u00e9ciation des conditions satisfaisantes de la vente amiable<\/h3>\n<p>Aux termes de l&#8217;article R. 322-15, alin\u00e9a 2, du code des proc\u00e9dures civiles d&#8217;ex\u00e9cution, <em>&#187; lorsqu&#8217;il autorise la vente amiable, le juge s&#8217;assure qu&#8217;elle peut \u00eatre conclue dans des conditions satisfaisantes compte tenu de la situation du bien, des conditions \u00e9conomiques du march\u00e9 et des diligences \u00e9ventuelles du d\u00e9biteur &#171;<\/em>. En l&#8217;esp\u00e8ce, les d\u00e9biteurs ont produit deux estimations immobili\u00e8res dat\u00e9es de f\u00e9vrier 2025, \u00e9valuant le bien entre 75 000 et 90 000 euros. Sur cette base, le juge a fix\u00e9 le prix minimum \u00e0 90 000 euros. Il a estim\u00e9 que ces \u00e9l\u00e9ments \u00e9taient suffisants pour caract\u00e9riser une possibilit\u00e9 de vente dans des conditions acceptables. La cour d&#8217;appel de Douai a jug\u00e9 que lorsque le d\u00e9biteur ne fournit pas d&#8217;\u00e9l\u00e9ments d&#8217;estimation, le juge doit rejeter la demande de vente amiable et ordonner la vente forc\u00e9e (CA Douai, 23 janv. 2025, n\u00b024\/03041). Ici, les d\u00e9biteurs ont apport\u00e9 des estimations, ce qui a permis au juge de se prononcer favorablement. Il a ainsi us\u00e9 de son pouvoir souverain pour appr\u00e9cier le caract\u00e8re satisfaisant de la vente amiable, en l&#8217;absence d&#8217;opposition du cr\u00e9ancier.<\/p>\n<h3 id=\"b-les-modalites-de-la-vente-amiable-et-la-suspension-de-la-procedure\">B. Les modalit\u00e9s de la vente amiable et la suspension de la proc\u00e9dure<\/h3>\n<p>Le jugement fixe les modalit\u00e9s pratiques : prix plancher de 90 000 euros, frais de poursuite \u00e0 la charge de l&#8217;acqu\u00e9reur, consignation du prix \u00e0 la Caisse des d\u00e9p\u00f4ts et consignations. Il suspend le cours de la proc\u00e9dure pour une dur\u00e9e maximale de quatre mois, jusqu&#8217;\u00e0 l&#8217;audience de rappel du 17 juillet 2026. Cette suspension est conforme \u00e0 l&#8217;article R. 322-20 du code des proc\u00e9dures civiles d&#8217;ex\u00e9cution. Le juge rappelle qu&#8217;en cas de d\u00e9faillance des d\u00e9biteurs, la proc\u00e9dure pourra \u00eatre reprise sur assignation du cr\u00e9ancier. Ainsi, la d\u00e9cision m\u00e9nage un \u00e9quilibre entre les int\u00e9r\u00eats du d\u00e9biteur, qui peut \u00e9viter la vente forc\u00e9e, et ceux du cr\u00e9ancier, dont les droits sont pr\u00e9serv\u00e9s par le maintien de la possibilit\u00e9 de reprise des poursuites. Le jugement illustre la volont\u00e9 du l\u00e9gislateur de favoriser les ventes amiables, tout en encadrant strictement leurs conditions pour \u00e9viter les abus.
