Des bailleurs avaient assign\u00e9 leurs locataires en expulsion \u00e0 l&#8217;issue d&#8217;un contrat qualifi\u00e9 de location saisonni\u00e8re. Le tribunal avait d\u00e9clar\u00e9 les bailleurs irrecevables pour d\u00e9faut de qualit\u00e9 \u00e0 agir et rejet\u00e9 leur demande. Sur appel, la cour devait statuer sur la recevabilit\u00e9 de l&#8217;action et le bien-fond\u00e9 de la demande d&#8217;expulsion. La cour d&#8217;appel infirme le jugement et ordonne l&#8217;expulsion des locataires devenus occupants sans titre.<\/p>\n<p>La r\u00e9gularisation de l&#8217;action en justice<\/p>\n<p>La validation de la qualit\u00e9 \u00e0 agir des bailleurs<\/p>\n<p>L&#8217;arr\u00eat \u00e9carte la fin de non-recevoir tir\u00e9e d&#8217;un pr\u00e9tendu d\u00e9faut de qualit\u00e9. Les motifs du premier juge sont r\u00e9put\u00e9s appropri\u00e9s par les intim\u00e9s en application de l&#8217;article 954 du code de proc\u00e9dure civile. La cour rel\u00e8ve que les appelants justifient de leur qualit\u00e9 de propri\u00e9taires par un relev\u00e9 de propri\u00e9t\u00e9. Un acte de partage successoral est intervenu le 21 novembre 2022. La parcelle initiale a \u00e9t\u00e9 divis\u00e9e et l&#8217;un des appelants est devenu seul propri\u00e9taire du bien lou\u00e9. En cons\u00e9quence, il convient d&#8217;infirmer le jugement qui a estim\u00e9 irrecevable la demande. Cette analyse rappelle l&#8217;importance de la preuve de la propri\u00e9t\u00e9 pour agir en expulsion. Elle pr\u00e9cise que cette qualit\u00e9 peut \u00e9voluer en cours de proc\u00e9dure sans affecter la recevabilit\u00e9.<\/p>\n<p>L&#8217;identification du contrat comme bail non soumis \u00e0 la loi de 1989<\/p>\n<p>La cour caract\u00e9rise le contrat litigieux pour d\u00e9terminer le r\u00e9gime applicable. Les parties ont conclu un contrat qualifi\u00e9 de &#8216;contrat de location saisonni\u00e8re&#8217;, pour une dur\u00e9e de trois mois non renouvelable. Il est clairement stipul\u00e9 que &#8216;la pr\u00e9sente location n&#8217;a pas pour objet des locaux lou\u00e9s \u00e0 usage d&#8217;habitation principale&#8217;. Il n&#8217;est pas d\u00e9montr\u00e9 l&#8217;accord des bailleurs pour laisser les locataires en possession apr\u00e8s l&#8217;\u00e9ch\u00e9ance. En cons\u00e9quence, cette location n&#8217;est pas soumise \u00e0 la loi du 10 juillet 1989. Cette qualification est essentielle car elle exclut la protection contre l&#8217;expulsion offerte par ce texte. Le contrat, par sa nature temporaire et son objet, rel\u00e8ve du droit commun des obligations.<\/p>\n<p>Les cons\u00e9quences de l&#8217;occupation sans titre<\/p>\n<p>La suppression du d\u00e9lai de gr\u00e2ce en raison de la mauvaise foi<\/p>\n<p>L&#8217;arr\u00eat ordonne l&#8217;expulsion sans accorder le d\u00e9lai de deux mois pr\u00e9vu par la loi. Les locataires sont devenus occupants sans droit ni titre \u00e0 compter du 04 d\u00e9cembre 2020. Le d\u00e9lai de l&#8217;article L 412-1 du code de proc\u00e9dure civile d&#8217;ex\u00e9cution ne s&#8217;applique pas en cas de mauvaise foi. La cour constate que les intim\u00e9s n&#8217;ont jamais justifi\u00e9 de l&#8217;accord ou de la tol\u00e9rance de leurs bailleurs. Ils sont donc de mauvaise foi et le d\u00e9lai de deux mois n&#8217;aura pas lieu de s&#8217;appliquer. Cette solution est s\u00e9v\u00e8re mais logique au regard des circonstances de l&#8217;occupation. Elle prive les occupants de la protection temporelle normalement accord\u00e9e avant l&#8217;expulsion forc\u00e9e.<\/p>\n<p>La condamnation au paiement des sommes dues et aux frais<\/p>\n<p>La cour liquide l&#8217;indemnit\u00e9 d&#8217;occupation et les arri\u00e9r\u00e9s de loyers dus. L&#8217;indemnit\u00e9 d&#8217;occupation est destin\u00e9e \u00e0 compenser la jouissance du bien occup\u00e9 sans droit ni titre. Elle est fix\u00e9e \u00e0 la somme mensuelle de 1050 euros. En application de l&#8217;article 1353 du code civil, il appartenait aux occupants de d\u00e9montrer leur paiement. Ils ne l&#8217;ayant pas fait, ils sont condamn\u00e9s \u00e0 payer les arri\u00e9r\u00e9s calcul\u00e9s jusqu&#8217;\u00e0 la mutation de propri\u00e9t\u00e9. Ils sont \u00e9galement condamn\u00e9s aux d\u00e9pens et \u00e0 une somme au titre des frais irr\u00e9p\u00e9tibles. Cette condamnation compl\u00e8te vise \u00e0 r\u00e9parer int\u00e9gralement le pr\u00e9judice subi par les propri\u00e9taires.
