Le bail r\u00e9sili\u00e9, l&#8217;appartement reste occup\u00e9 par un proche du preneur. Le bailleur demande l&#8217;expulsion et le paiement de sommes dues. Le juge accueille ces demandes en distinguant les responsabilit\u00e9s contractuelles et d\u00e9lictuelles des personnes impliqu\u00e9es.<\/p>\n<p>La r\u00e9gularit\u00e9 de la r\u00e9siliation et ses cons\u00e9quences imm\u00e9diates<\/p>\n<p>Le juge constate d&#8217;abord la r\u00e9gularit\u00e9 du cong\u00e9 d\u00e9livr\u00e9 par le locataire, mettant fin au bail. Il rel\u00e8ve que &#171;le bail s&#8217;est ainsi trouv\u00e9 r\u00e9sili\u00e9 par l&#8217;effet du cong\u00e9 \u00e0 cette date&#187; (Sur le cong\u00e9 d\u00e9livr\u00e9 par le preneur et ses cons\u00e9quences). Cette constatation purement d\u00e9clarative s&#8217;appuie sur un courrier du locataire autorisant le bailleur \u00e0 &#171;d\u00e9barrasser le logement&#187;, suite \u00e0 son d\u00e9part. La port\u00e9e de ce point est essentielle car elle fixe la date pr\u00e9cise \u00e0 laquelle l&#8217;occupation devient sans droit ni titre. Le juge en d\u00e9duit logiquement l&#8217;obligation de lib\u00e9rer les lieux et ordonne l&#8217;expulsion de l&#8217;occupant, fils du locataire, et de toute personne occupant de son chef. La valeur de cette analyse r\u00e9side dans son application stricte de la loi, sans validation judiciaire suppl\u00e9mentaire du cong\u00e9 d\u00e8s lors que les faits sont \u00e9tablis.<\/p>\n<p>La mise en \u0153uvre de l&#8217;expulsion respecte ensuite les garanties proc\u00e9durales. Le juge indique qu&#8217;aucune circonstance ne justifie de r\u00e9duire &#171;le d\u00e9lai de deux mois, pr\u00e9vu par les dispositions des articles L. 412-1 et suivants&#187; (Sur le cong\u00e9 d\u00e9livr\u00e9 par le preneur et ses cons\u00e9quences). Ce rappel a pour sens d&#8217;encadrer strictement l&#8217;usage de la force publique. Il prot\u00e8ge l&#8217;occupant en lui laissant un temps minimal pour quitter les lieux volontairement. La port\u00e9e est pratique, car elle d\u00e9finit le cadre l\u00e9gal de l&#8217;ex\u00e9cution future, renvoyant au juge de l&#8217;ex\u00e9cution les difficult\u00e9s ult\u00e9rieures sur le mobilier.<\/p>\n<p>La distinction fondamentale des r\u00e9gimes de responsabilit\u00e9<\/p>\n<p>Le c\u0153ur de la d\u00e9cision op\u00e8re une s\u00e9paration nette entre la dette de loyers et l&#8217;indemnit\u00e9 d&#8217;occupation. Le locataire est seul tenu des loyers impay\u00e9s jusqu&#8217;\u00e0 la r\u00e9siliation du bail, en sa qualit\u00e9 de seul d\u00e9biteur contractuel. Le juge fonde cela sur l&#8217;article 1199 du code civil, pr\u00e9cisant que &#171;le contrat ne cr\u00e9e d&#8217;obligations qu&#8217;entre les parties&#187; (Sur la demande en paiement au titre des loyers et de l&#8217;indemnit\u00e9 d&#8217;occupation). La valeur de ce principe est de limiter strictement l&#8217;obligation contractuelle au signataire du bail, excluant toute responsabilit\u00e9 solidaire des occupants non parties. Cette solution rejoint une jurisprudence constante, comme le rappelle un arr\u00eat de la Cour de cassation qui a jug\u00e9 que les copreneurs solidaires restaient tenus des loyers. &#171;Attendu qu&#8217;ayant relev\u00e9 que le bail stipulait que les copreneurs \u00e9taient tenus solidairement et indivisiblement de son ex\u00e9cution&#8230; la cour d&#8217;appel a exactement d\u00e9duit&#8230; que celle-ci restait tenue de la totalit\u00e9 des loyers impay\u00e9s&#187; (Cass. Troisi\u00e8me chambre civile, le 14 juin 2018, n\u00b017-14.365).<\/p>\n<p>En revanche, l&#8217;indemnit\u00e9 d&#8217;occupation, de nature d\u00e9lictuelle, peut concerner d&#8217;autres personnes. Le juge explique qu&#8217;elle &#171;trouve son fait g\u00e9n\u00e9rateur dans l&#8217;occupation du bien, y sont tenus au premier chef les occupants du bien, m\u00eame non locataires&#187; (Sur la demande en paiement au titre des loyers et de l&#8217;indemnit\u00e9 d&#8217;occupation). La port\u00e9e de cette distinction est majeure pour le bailleur. Elle lui permet d&#8217;agir contre tout occupant ind\u00fb, m\u00eame sans lien contractuel. Le sens est de r\u00e9parer le pr\u00e9judice caus\u00e9 par la privation de jouissance, ind\u00e9pendamment du lien contractuel. Toutefois, en l&#8217;esp\u00e8ce, l&#8217;action n&#8217;\u00e9tant dirig\u00e9e que contre le locataire, c&#8217;est lui qui supporte seul la condamnation, incluant l&#8217;indemnit\u00e9 d&#8217;occupation future. Cette approche rejoint celle d&#8217;une cour d&#8217;appel ayant r\u00e9cemment distingu\u00e9 les responsabilit\u00e9s. &#171;Il est relev\u00e9 que MM. [J] et [S], occupants sans droit ni titre, ne sont pas cotitulaires du bail et ne sont donc pas tenus au paiement des loyers et charges&#187; (Cour d&#8217;appel de Paris, le 28 juin 2024, n\u00b024\/00153).
