Le bailleur fondait sa requ\u00eate sur l\u2019inoccupation personnelle du logement et une sous-location pr\u00e9sum\u00e9e. Le locataire, d\u00e9fendeur, est demeur\u00e9 absent \u00e0 l\u2019audience. La juridiction a prononc\u00e9 la r\u00e9siliation du bail et ordonn\u00e9 l\u2019expulsion sans d\u00e9lai, estimant les manquements graves et av\u00e9r\u00e9s.<\/p>\n<p>La caract\u00e9risation de manquements contractuels suffisamment graves<\/p>\n<p>L\u2019obligation d\u2019occupation personnelle comme r\u00e9sidence principale. Le juge rappelle les obligations l\u00e9gales et contractuelles pesant sur le locataire d\u2019un logement social. Le preneur doit occuper personnellement les lieux \u00e0 titre de r\u00e9sidence principale effective. &#171;Les locaux lou\u00e9s doivent constituer la r\u00e9sidence principale effective du preneur et \u00eatre ainsi occup\u00e9 au moins huit mois par an&#187; (Motifs). Cette obligation vise \u00e0 pr\u00e9server la destination sociale du bien.<\/p>\n<p>La preuve d\u2019une sous-location et d\u2019une inoccupation prolong\u00e9e. La preuve des manquements est rapport\u00e9e par le bailleur de mani\u00e8re concordante. Un constat d\u2019huissier r\u00e9v\u00e8le que des tiers occupent les lieux depuis dix-huit mois. &#171;Monsieur [G] [E] et Madame [R] [B] ont indiqu\u00e9 \u00ab occuper l\u2019appartement depuis au moins 18 mois \u00bb&#187; (Motifs). La domiciliation fiscale du locataire \u00e0 une autre adresse confirme l\u2019absence d\u2019occupation personnelle.<\/p>\n<p>La gravit\u00e9 justifiant la r\u00e9siliation aux torts du locataire. Ces violations sont jug\u00e9es suffisamment graves pour entra\u00eener la rupture du contrat. Le juge rel\u00e8ve leur caract\u00e8re r\u00e9p\u00e9t\u00e9 et prolong\u00e9 sur au moins deux ans. &#171;Ces violations sont par ailleurs suffisamment graves et r\u00e9p\u00e9t\u00e9es pour entra\u00eener le prononc\u00e9 de la r\u00e9siliation judiciaire du bail&#187; (Motifs). Le d\u00e9tournement de la finalit\u00e9 sociale du logement fonde cette appr\u00e9ciation s\u00e9v\u00e8re.<\/p>\n<p>Les cons\u00e9quences de la r\u00e9siliation : une expulsion sans d\u00e9lai de protection<\/p>\n<p>Le prononc\u00e9 de l\u2019expulsion et la suppression du d\u00e9lai l\u00e9gal. La r\u00e9siliation du bail rend le locataire sans droit au maintien dans les lieux. Le juge ordonne donc son expulsion. Il \u00e9carte \u00e9galement l\u2019application du d\u00e9lai de deux mois pr\u00e9vu par l\u2019article L.412-1 du code des proc\u00e9dures civiles d\u2019ex\u00e9cution. Cette dispense est justifi\u00e9e par la mauvaise foi d\u00e9duite de l\u2019inoccupation constat\u00e9e.<\/p>\n<p>La condamnation au paiement d\u2019une indemnit\u00e9 d\u2019occupation. L\u2019occupation sans droit ouvre obligation \u00e0 r\u00e9paration pour le bailleur l\u00e9s\u00e9. Le locataire est condamn\u00e9 \u00e0 verser une indemnit\u00e9 mensuelle. Celle-ci correspond \u00e0 la valeur locative du bien jusqu\u2019\u00e0 sa lib\u00e9ration effective. Cette condamnation vise \u00e0 compenser le pr\u00e9judice subi par la privation de jouissance.<\/p>\n<p>La mise en balance avec le droit au respect du domicile. Le juge proc\u00e8de \u00e0 un contr\u00f4le de proportionnalit\u00e9 de la mesure d\u2019expulsion. Il reconna\u00eet l\u2019ing\u00e9rence dans le droit au respect du domicile. Il estime cette ing\u00e9rence justifi\u00e9e par la protection des droits du bailleur. &#171;La mesure d&#8217;expulsion n&#8217;apparait nullement disproportionn\u00e9e au regard de la balance des int\u00e9r\u00eats enjeu&#187; (Motifs). La finalit\u00e9 sociale du logement prime sur l\u2019occupation illicite.<\/p>\n<p>Cette d\u00e9cision affirme une s\u00e9v\u00e9rit\u00e9 croissante envers les d\u00e9tournements de logements sociaux. Elle rappelle que l\u2019obligation d\u2019occupation personnelle est une condition essentielle. Sa violation grave et prolong\u00e9e justifie une sanction maximale, incluant l\u2019expulsion sans d\u00e9lai. La jurisprudence du Tribunal judiciaire de Pontoise adopte une position similaire. &#171;Attendu que de tels faits constituent une violation grave et r\u00e9p\u00e9t\u00e9e des obligations essentielles du bail&#187; (Tribunal judiciaire de Pontoise, le 12 f\u00e9vrier 2026, n\u00b025\/01124).
