Le bailleur demandait la constatation de la r\u00e9siliation du bail pour d\u00e9faut de paiement des loyers et l&#8217;expulsion du locataire, ainsi qu&#8217;une provision au titre d&#8217;une indemnit\u00e9 d&#8217;occupation. Le juge des r\u00e9f\u00e9r\u00e9s avait rejet\u00e9 ces demandes. La Cour d&#8217;appel, saisie de l&#8217;appel du bailleur, a infirm\u00e9 l&#8217;ordonnance premi\u00e8re pour accueillir l&#8217;ensemble des pr\u00e9tentions. Elle statue sur les conditions de mise en \u0153uvre d&#8217;une clause r\u00e9solutoire en mati\u00e8re de bail commercial et sur l&#8217;octroi d&#8217;une provision en r\u00e9f\u00e9r\u00e9.<\/p>\n<p>La r\u00e9gularit\u00e9 de la mise en \u0153uvre de la clause r\u00e9solutoire<\/p>\n<p>La cour rappelle le cadre proc\u00e9dural du r\u00e9f\u00e9r\u00e9 permettant de constater une r\u00e9siliation. Le juge des r\u00e9f\u00e9r\u00e9s peut ordonner toutes les mesures qui ne se heurtent \u00e0 aucune contestation s\u00e9rieuse. Il peut \u00e9galement prescrire des mesures conservatoires pour faire cesser un trouble manifestement illicite. En l&#8217;esp\u00e8ce, la demande de constatation de la r\u00e9siliation rel\u00e8ve de la premi\u00e8re hypoth\u00e8se, d\u00e8s lors que les conditions l\u00e9gales sont remplies.<\/p>\n<p>L&#8217;exigence d&#8217;un commandement pr\u00e9alable est strictement contr\u00f4l\u00e9e. Le texte applicable dispose que &#171;toute clause ins\u00e9r\u00e9e dans le bail pr\u00e9voyant la r\u00e9siliation de plein droit ne produit effet qu&#8217;un mois apr\u00e8s un commandement demeur\u00e9 infructueux&#187; (article L.145-41 du code de commerce). La cour v\u00e9rifie scrupuleusement la pr\u00e9sence de cette clause dans le contrat et la d\u00e9livrance d&#8217;un commandement r\u00e9gulier en forme. Elle rel\u00e8ve que le commandement d\u00e9livr\u00e9 mentionnait express\u00e9ment le d\u00e9lai d&#8217;un mois, conform\u00e9ment aux prescriptions l\u00e9gales.<\/p>\n<p>Les effets de la r\u00e9siliation r\u00e9guli\u00e8rement acquise<\/p>\n<p>La r\u00e9siliation ouvre droit \u00e0 l&#8217;expulsion et \u00e0 une indemnit\u00e9 d&#8217;occupation. La cour constate que le locataire ne d\u00e9montre pas avoir pay\u00e9 les sommes r\u00e9clam\u00e9es dans le d\u00e9lai imparti. D\u00e8s lors, la clause r\u00e9solutoire est r\u00e9put\u00e9e acquise \u00e0 la date d&#8217;effet pr\u00e9vue. La constatation de cette r\u00e9siliation en r\u00e9f\u00e9r\u00e9 est donc justifi\u00e9e, car elle ne rencontre aucune contestation s\u00e9rieuse sur son principe.<\/p>\n<p>L&#8217;expulsion est ordonn\u00e9e comme la cons\u00e9quence n\u00e9cessaire de la r\u00e9siliation. La cour ordonne l&#8217;expulsion des lieux avec le concours de la force publique. Cette mesure est pr\u00e9sent\u00e9e comme la suite logique de la constatation d&#8217;une occupation sans droit apr\u00e8s la date de r\u00e9siliation. Elle vise \u00e0 faire cesser un trouble manifestement illicite, ce qui entre dans les pouvoirs du juge des r\u00e9f\u00e9r\u00e9s.<\/p>\n<p>L&#8217;octroi d&#8217;une provision sur l&#8217;indemnit\u00e9 d&#8217;occupation<\/p>\n<p>Le fondement de la provision repose sur l&#8217;absence de contestation s\u00e9rieuse de l&#8217;obligation. La cour rappelle que le juge des r\u00e9f\u00e9r\u00e9s peut accorder une provision lorsque l&#8217;existence de l&#8217;obligation n&#8217;est pas s\u00e9rieusement contestable. Elle pr\u00e9cise que c&#8217;est au demandeur d&#8217;\u00e9tablir le principe et le montant de cette obligation. L&#8217;appr\u00e9ciation de l&#8217;absence de contestation s\u00e9rieuse se fait au moment o\u00f9 la cour statue.<\/p>\n<p>Le montant de la provision est fix\u00e9 en l&#8217;absence de d\u00e9bat sur son \u00e9valuation. En l&#8217;esp\u00e8ce, le bailleur ne demande une provision que pour la p\u00e9riode post\u00e9rieure \u00e0 la r\u00e9siliation. La cour estime que l&#8217;obligation de payer une indemnit\u00e9 d&#8217;occupation, depuis la date de r\u00e9siliation, n&#8217;est pas s\u00e9rieusement contestable. Elle fixe donc le montant provisionnel en se fondant sur le dernier loyer connu, consid\u00e9r\u00e9 comme une base non contest\u00e9e pour l&#8217;\u00e9valuation.<\/p>\n<p>La port\u00e9e pratique de la d\u00e9cision<\/p>\n<p>Cette d\u00e9cision illustre la rigueur proc\u00e9durale requise pour l&#8217;application d&#8217;une clause r\u00e9solutoire. Elle confirme que le respect des formalit\u00e9s du commandement, notamment la mention du d\u00e9lai d&#8217;un mois, est une condition de validit\u00e9 imp\u00e9rative. Un manquement \u00e0 ces formes entra\u00eenerait l&#8217;irrecevabilit\u00e9 de la demande en constatation de la r\u00e9siliation, comme le rappelle une jurisprudence constante.<\/p>\n<p>L&#8217;arr\u00eat renforce \u00e9galement l&#8217;efficacit\u00e9 du r\u00e9f\u00e9r\u00e9 comme mode de r\u00e9solution des conflits locatifs.
