Le bailleur invoque une clause r\u00e9solutoire apr\u00e8s un commandement de payer demeur\u00e9 infructueux. Les locataires opposent une d\u00e9cision de recevabilit\u00e9 \u00e0 une proc\u00e9dure de surendettement. Le juge doit concilier l&#8217;application de la clause r\u00e9solutoire avec les dispositions protectrices du code de la consommation. Il prononce l&#8217;expulsion et condamne au paiement d&#8217;une indemnit\u00e9 d&#8217;occupation.<\/p>\n<p>La mise en \u0153uvre de la clause r\u00e9solutoire malgr\u00e9 la proc\u00e9dure de surendettement<\/p>\n<p>Le juge constate d&#8217;abord la r\u00e9gularit\u00e9 de la proc\u00e9dure pr\u00e9alable \u00e0 l&#8217;expulsion. Le bailleur a respect\u00e9 l&#8217;obligation de signalement \u00e0 la commission de coordination des expulsions locatives. Cette formalit\u00e9 est essentielle pour la recevabilit\u00e9 de la demande d&#8217;expulsion. Le juge v\u00e9rifie scrupuleusement le respect des seuils d&#8217;impay\u00e9s fix\u00e9s par arr\u00eat\u00e9 pr\u00e9fectoral. La saisine de la commission dans les d\u00e9lais l\u00e9gaux rend la demande recevable sur ce point.<\/p>\n<p>Le c\u0153ur du d\u00e9bat r\u00e9side dans l&#8217;opposition entre la clause r\u00e9solutoire et la proc\u00e9dure de surendettement. Le commandement de payer visant la clause a \u00e9t\u00e9 signifi\u00e9 le 17 janvier 2024. &#171;En cons\u00e9quence, la r\u00e9siliation de plein droit du contrat de bail est acquise \u00e0 compter du 17 mars 2024, soit ant\u00e9rieurement \u00e0 la d\u00e9cision de recevabilit\u00e9 du dossier de surendettement&#187; (Motifs de la d\u00e9cision). La chronologie des faits est donc d\u00e9terminante. Le juge estime que la r\u00e9siliation est d\u00e9j\u00e0 intervenue lorsque la commission se prononce. Cette solution rejoint une jurisprudence constante. &#171;La d\u00e9cision de recevabilit\u00e9 \u00e0 la proc\u00e9dure de surendettement ne peut en cons\u00e9quence paralyser l&#8217;application de la clause r\u00e9solutoire&#187; (Cour d&#8217;appel de Riom, le 7 janvier 2025, n\u00b022\/02322). La protection du surendettement ne peut r\u00e9troagir pour an\u00e9antir un droit d\u00e9j\u00e0 acquis.<\/p>\n<p>Les cons\u00e9quences p\u00e9cuniaires du maintien dans les lieux apr\u00e8s r\u00e9siliation<\/p>\n<p>La r\u00e9siliation du bail transforme la nature des cr\u00e9ances dues. Les sommes r\u00e9clam\u00e9es pour la p\u00e9riode post\u00e9rieure \u00e0 la r\u00e9siliation sont requalifi\u00e9es. &#171;Cellles correspondant \u00e0 la p\u00e9riode suivant la r\u00e9siliation du bail doivent \u00eatre requalifi\u00e9es en indemnit\u00e9 d&#8217;occupation&#187; (Motifs de la d\u00e9cision). Cette requalification est une application du principe de prohibition de l&#8217;enrichissement sans cause. L&#8217;occupant sans titre doit compenser le pr\u00e9judice subi par le propri\u00e9taire. Le juge fixe le montant de cette indemnit\u00e9 en r\u00e9f\u00e9rence au loyer initial. &#171;Cette indemnit\u00e9 d&#8217;occupation sera fix\u00e9e au montant du loyer augment\u00e9 des charges&#187; (Motifs de la d\u00e9cision). Cette m\u00e9thode de calcul est usuelle et se fonde sur la privation de jouissance.<\/p>\n<p>Le juge \u00e9carte enfin le b\u00e9n\u00e9fice des d\u00e9lais de paiement pr\u00e9vus par l&#8217;article 24 VI de la loi de 1989. Ce dispositif protecteur est subordonn\u00e9 \u00e0 une condition. &#171;Les dispositions sp\u00e9cifiques \u00e0 la proc\u00e9dure de surendettement seront donc \u00e9cart\u00e9es en l&#8217;absence de reprise du paiement des loyers courants&#187; (Motifs de la d\u00e9cision). Les locataires n&#8217;ayant pas repris les paiements apr\u00e8s la d\u00e9cision de recevabilit\u00e9, ils ne peuvent invoquer cette protection. Le juge souligne l&#8217;anciennet\u00e9 et l&#8217;importance de l&#8217;arri\u00e9r\u00e9 pour justifier l&#8217;expulsion.
