Le bail contenait une clause r\u00e9solutoire sp\u00e9cifique pr\u00e9voyant un d\u00e9lai contractuel de deux mois apr\u00e8s commandement. Le locataire n&#8217;ayant pas r\u00e9gl\u00e9 sa dette dans ce d\u00e9lai ni repris le paiement des loyers courants, le juge constate la r\u00e9siliation et ordonne l&#8217;expulsion. Il rejette cependant la demande de d\u00e9lais de paiement et celle d&#8217;expulsion imm\u00e9diate, tout en condamnant le locataire au paiement des sommes dues.<\/p>\n<p>La primaut\u00e9 du d\u00e9lai contractuel sur le d\u00e9lai l\u00e9gal<\/p>\n<p>Le juge op\u00e8re une distinction essentielle entre les effets l\u00e9gaux du contrat et les stipulations conventionnelles. Il rappelle que l&#8217;article 24 de la loi du 6 juillet 1989 pr\u00e9voit un d\u00e9lai l\u00e9gal de six semaines apr\u00e8s commandement. Toutefois, ce d\u00e9lai ne s&#8217;applique que si le bail est muet sur ce point. &#171;\u00c0 l&#8217;inverse, lorsque le d\u00e9lai d\u2019acquisition de la clause a \u00e9t\u00e9 contractualis\u00e9, celui-ci ne peut plus \u00eatre consid\u00e9r\u00e9 comme un effet l\u00e9gal du contrat.&#187; (Motifs de la d\u00e9cision). Le juge applique donc le d\u00e9lai de deux mois librement convenu par les parties.<\/p>\n<p>Ce raisonnement consacre la libert\u00e9 contractuelle dans la d\u00e9termination des conditions de la r\u00e9siliation. Le d\u00e9lai contractuel ne heurte pas l&#8217;ordre public, car il ne rev\u00eat pas &#171;un imp\u00e9rieux motif d&#8217;int\u00e9r\u00eat g\u00e9n\u00e9ral interdisant aux parties d&#8217;y d\u00e9roger dans un sens favorable au locataire.&#187; (Motifs de la d\u00e9cision). La port\u00e9e de cette solution est significative pour la s\u00e9curit\u00e9 juridique des conventions. Elle valide la pratique consistant \u00e0 am\u00e9nager les d\u00e9lais de d\u00e9faillance, pourvu que le seuil minimal de loyaut\u00e9 soit respect\u00e9.<\/p>\n<p>Les conditions strictes de l&#8217;octroi de d\u00e9lais de paiement<\/p>\n<p>La d\u00e9cision rappelle avec rigueur le r\u00e9gime d\u00e9rogatoire des d\u00e9lais de paiement suspensifs. Le juge peut accorder de tels d\u00e9lais \u00e0 la demande d&#8217;une partie ou d&#8217;office, sous des conditions cumulatives. Le locataire doit \u00eatre &#171;en situation de r\u00e9gler sa dette locative&#187; et il doit avoir &#171;repris le versement int\u00e9gral du loyer courant avant la date de l&#8217;audience.&#187; (Motifs de la d\u00e9cision). En l&#8217;esp\u00e8ce, cette derni\u00e8re condition n&#8217;\u00e9tant pas remplie, le juge refuse tout am\u00e9nagement.<\/p>\n<p>Cette analyse est en parfaite conformit\u00e9 avec la jurisprudence existante sur le sujet. La Cour d&#8217;appel de Paris a ainsi pr\u00e9cis\u00e9 que &#171;le juge peut, m\u00eame d&#8217;office, accorder des d\u00e9lais de paiement dans la limite de trois ann\u00e9es, par d\u00e9rogation au d\u00e9lai pr\u00e9vu au premier alin\u00e9a de l&#8217;article 1343-5 du code civil, au locataire en situation de r\u00e9gler sa dette locative.&#187; (Cour d&#8217;appel de Paris, le 1 juin 2022, n\u00b021\/21710). La condition du paiement du loyer courant est donc une exigence proc\u00e9durale incontournable.<\/p>\n<p>La valeur de cette solution r\u00e9side dans sa clart\u00e9 et sa pr\u00e9visibilit\u00e9. Elle prot\u00e8ge le bailleur contre les man\u0153uvres dilatoires tout en offrant une issue au locataire de bonne foi. La suspension des effets de la clause r\u00e9solutoire n&#8217;est qu&#8217;une facult\u00e9 subordonn\u00e9e \u00e0 une reprise effective des paiements. Cette jurisprudence rappelle que le m\u00e9canisme des d\u00e9lais de paiement est une faveur exceptionnelle, et non un droit automatique.<\/p>\n<p>Les cons\u00e9quences pratiques de la r\u00e9siliation constat\u00e9e<\/p>\n<p>Le juge d\u00e9taille pr\u00e9cis\u00e9ment les suites de la r\u00e9siliation, en refusant toute ex\u00e9cution imm\u00e9diate. L&#8217;expulsion ne pourra intervenir qu&#8217;apr\u00e8s un nouveau commandement de quitter les lieux et hors p\u00e9riode hivernale. Ce refus de r\u00e9duire les d\u00e9lais l\u00e9gaux prot\u00e8ge le locataire contre une mise \u00e0 la rue brutale. Il rappelle que l&#8217;expulsion imm\u00e9diate n\u00e9cessite la d\u00e9monstration de circonstances particuli\u00e8res non \u00e9tablies en l&#8217;esp\u00e8ce.<\/p>\n<p>Par ailleurs, la condamnation au paiement d&#8217;une indemnit\u00e9 d&#8217;occupation est automatique. L&#8217;occupation sans droit constitue un fait g\u00e9n\u00e9rateur de responsabilit\u00e9 d\u00e9lictuelle. Le juge fixe son montant \u00e0 l&#8217;\u00e9quivalent du loyer, &#171;du 18 f\u00e9vrier 2025 et jusqu\u2019\u00e0 la lib\u00e9ration effective des lieux.&#187; (Motifs de la d\u00e9cision). Cette solution est classique et vise \u00e0 compenser int\u00e9gralement le pr\u00e9judice subi par le propri\u00e9taire.<\/p>\n<p>Enfin, le juge proc\u00e8de \u00e0 une analyse minutieuse des demandes accessoires. Il rejette la demande de dommages-int\u00e9r\u00eats pour r\u00e9sistance abusive, faute de preuve de mauvaise foi. Il limite \u00e9galement les int\u00e9r\u00eats moratoires au jour de l&#8217;assignation, exigeant une mise en demeure pr\u00e9alable pour chaque \u00e9ch\u00e9ance.
