Le bailleur s&#8217;est d\u00e9sist\u00e9 de ses demandes principales en r\u00e9siliation de bail et en expulsion. Le juge se prononce sur le recouvrement des loyers impay\u00e9s et sur les frais de proc\u00e9dure. La solution condamne la locataire au paiement de la dette locative apur\u00e9e et aux d\u00e9pens, tout en constatant le d\u00e9sistement partiel du demandeur.<\/p>\n<p>Les effets proc\u00e9duraux de l&#8217;apurement de la dette<\/p>\n<p>L&#8217;apurement de la dette locative entra\u00eene un d\u00e9sistement des demandes les plus graves. Le jugement constate le renoncement du bailleur \u00e0 ses actions en r\u00e9siliation et en expulsion. Cette situation proc\u00e9durale d\u00e9coule directement du r\u00e8glement de l&#8217;arri\u00e9r\u00e9 locatif par le d\u00e9biteur. La port\u00e9e est significative pour le maintien des relations contractuelles.<\/p>\n<p>Le d\u00e9sistement accept\u00e9 met fin d\u00e9finitivement aux pr\u00e9tentions principales du cr\u00e9ancier. &#171;Il convient tout d&#8217;abord de constater le d\u00e9sistement du demandeur de sa demande principale en constat de r\u00e9siliation de bail et en expulsion&#187; (Motifs de la d\u00e9cision). Cette renonciation, une fois act\u00e9e par le juge, poss\u00e8de l&#8217;autorit\u00e9 de la chose jug\u00e9e. Elle emp\u00eache toute nouvelle action sur ce fondement pour les m\u00eames faits.<\/p>\n<p>Cette logique se retrouve dans une jurisprudence r\u00e9cente similaire. &#171;Cette situation d\u2019apurement de la dette et reprise du paiement du loyer courant, qui ne fait pas discussion entre les parties, conduit [&#8230;] \u00e0 se d\u00e9sister, plus pr\u00e9cis\u00e9ment \u00e0 renoncer \u00e0 ses demandes principales en r\u00e9siliation du bail ainsi qu\u2019en paiement de l\u2019\u00e9ventuel arri\u00e9r\u00e9 locatif&#187; (Tribunal judiciaire de Mulhouse, le 24 novembre 2025, n\u00b024\/00178). La valeur de la d\u00e9cision comment\u00e9e r\u00e9side dans sa confirmation de cette pratique.<\/p>\n<p>Le d\u00e9sistement partiel permet de recentrer le litige sur le seul recouvrement p\u00e9cuniaire. Il traduit une forme de pacification du conflit locatif une fois la dette apur\u00e9e. La solution pr\u00e9serve le lien contractuel tout en sanctionnant le retard de paiement. Elle illustre la fonction conciliatrice du juge des contentieux de la protection.<\/p>\n<p>Le maintien des condamnations p\u00e9cuniaires accessoires<\/p>\n<p>Malgr\u00e9 le d\u00e9sistement, le juge prononce des condamnations financi\u00e8res distinctes. La locataire est tenue au paiement de la somme due, des int\u00e9r\u00eats et des frais de proc\u00e9dure. Ces condamnations survivent au renoncement sur les demandes principales. Leur nature accessoire et indemnitaire justifie leur maintien.<\/p>\n<p>Le jugement d\u00e9taille pr\u00e9cis\u00e9ment les composantes de la condamnation p\u00e9cuniaire. &#171;CONDAMNE [&#8230;] \u00e0 payer [&#8230;] la somme de 3.007,15 euros correspondant au montant des loyers, charges impay\u00e9es au 30 juin 2025, outre int\u00e9r\u00eats au taux l\u00e9gal&#187; (Par ces motifs). Le montant est liquid\u00e9 \u00e0 une date certaine, ce qui en fixe le caract\u00e8re d\u00e9finitif. Les int\u00e9r\u00eats courent \u00e0 compter de la signification du jugement.<\/p>\n<p>Les frais irr\u00e9p\u00e9tibles sont allou\u00e9s en application de l&#8217;article 700 du code de proc\u00e9dure civile. &#171;Une somme de 100 euros sera allou\u00e9e de ce chef [&#8230;] Cette somme ne produira pas int\u00e9r\u00eats&#187; (Motifs de la d\u00e9cision). Cette condamnation symbolique rel\u00e8ve de l&#8217;appr\u00e9ciation souveraine des juges du fond. Elle vise \u00e0 compenser partiellement les frais non compris dans les d\u00e9pens.<\/p>\n<p>Les d\u00e9pens proprement dits incluent le co\u00fbt des actes de proc\u00e9dure ant\u00e9rieurs. &#171;CONDAMNE [&#8230;] \u00e0 supporter les d\u00e9pens de l&#8217;instance comprenant le co\u00fbt du commandement de payer&#187; (Par ces motifs). Cette prise en charge du commandement initial est conforme \u00e0 l&#8217;article 696 du code. Elle sanctionne le comportement du d\u00e9biteur \u00e0 l&#8217;origine du litige.<\/p>\n<p>La d\u00e9cision op\u00e8re ainsi une dissociation nette entre les demandes. Le d\u00e9sistement sur le fond n&#8217;efface pas les cons\u00e9quences financi\u00e8res de l&#8217;inex\u00e9cution. Le cr\u00e9ancier obtient une satisfaction p\u00e9cuniaire compl\u00e8te malgr\u00e9 son renoncement \u00e0 la r\u00e9siliation.
