Le bailleur sollicitait la r\u00e9siliation du bail pour d\u00e9faut de paiement et le paiement des sommes dues. Les locataires demandaient des d\u00e9lais de paiement et la suspension de la clause r\u00e9solutoire. Le juge a constat\u00e9 la r\u00e9siliation de plein droit mais a accord\u00e9 des d\u00e9lais de paiement et suspendu les effets de la clause sous conditions.<\/p>\n<p>La mise en \u0153uvre conditionnelle de la r\u00e9siliation du bail<\/p>\n<p>Le juge constate d&#8217;abord la r\u00e9union des conditions de la clause r\u00e9solutoire. L&#8217;article 24 de la loi du 6 juillet 1989 impose un formalisme strict pour son acquisition. &#171;Toute clause pr\u00e9voyant la r\u00e9siliation de plein droit du contrat de location pour d\u00e9faut de paiement du loyer ou des charges aux termes convenus ou pour non versement du d\u00e9p\u00f4t de garantie ne produit effet que deux mois apr\u00e8s la signification d\u2019un commandement de payer demeur\u00e9 infructueux&#187; (Motifs, 1\u00b0). Le juge v\u00e9rifie le respect de cette condition suspensive. Il rel\u00e8ve que les locataires &#171;n\u2019ont pas r\u00e9gl\u00e9 les sommes dues dans les deux mois ayant suivi le commandement&#187; (Motifs, 1\u00b0). La clause est donc acquise \u00e0 une date certaine, ce qui permet de constater la r\u00e9siliation de plein droit. Cette analyse est conforme \u00e0 la jurisprudence qui rappelle que &#171;les conditions d&#8217;acquisition de la clause r\u00e9solutoire \u00e9taient r\u00e9unies&#187; apr\u00e8s un commandement infructueux (Cour d&#8217;appel de Douai, le 6 mars 2025, n\u00b023\/03351). La port\u00e9e est de rappeler le caract\u00e8re imp\u00e9ratif de ce d\u00e9lai de deux mois, protecteur du locataire.<\/p>\n<p>Le juge use ensuite de son pouvoir mod\u00e9rateur pour am\u00e9nager les cons\u00e9quences de cette r\u00e9siliation. La loi du 27 juillet 2023 a introduit des outils de traitement amiable du contentieux locatif. &#171;Le juge peut accorder, \u00e0 la demande du locataire, du bailleur ou d\u2019office, des d\u00e9lais de paiement au locataire \u00e0 condition qu\u2019il soit en situation de r\u00e9gler sa dette locative et qu\u2019il ait repris le versement int\u00e9gral du loyer courant avant la date d\u2019audience&#187; (Motifs, 1\u00b0). Le juge applique ce texte en relevant la reprise des paiements et la capacit\u00e9 des locataires \u00e0 honorer un \u00e9ch\u00e9ancier. Il suspend \u00e9galement les effets de la clause r\u00e9solutoire, comme le permet la loi. Cette solution illustre la volont\u00e9 du l\u00e9gislateur de privil\u00e9gier le maintien dans les lieux. Elle rejoint la jurisprudence admettant que &#171;le juge peut suspendre les effets de la clause r\u00e9solutoire \u00e0 la demande du locataire qui a repris le versement int\u00e9gral du loyer courant&#187; (Cour d&#8217;appel de Pau, le 6 mars 2025, n\u00b023\/02948). La valeur est humanitaire et \u00e9conomique, \u00e9vitant l&#8217;expulsion pour des difficult\u00e9s passag\u00e8res.<\/p>\n<p>Les cons\u00e9quences juridiques d&#8217;un dispositif judiciaire \u00e9quilibr\u00e9<\/p>\n<p>La d\u00e9cision organise un r\u00e9gime de faveur conditionnelle pour les locataires. Le juge accorde un \u00e9ch\u00e9ancier de paiement \u00e9tal\u00e9 sur dix mois pour solder la dette. Il assortit cette mesure d&#8217;une clause de d\u00e9ch\u00e9ance du terme protectrice du bailleur. &#171;A d\u00e9faut d\u2019un seul paiement \u00e0 son \u00e9ch\u00e9ance, toutes les sommes restant dues deviendront alors imm\u00e9diatement exigibles&#187; (Motifs, 1\u00b0). La suspension de la clause r\u00e9solutoire est \u00e9galement subordonn\u00e9e au respect strict de ce calendrier. &#171;Si les locataires se lib\u00e8rent dans le d\u00e9lai et selon les modalit\u00e9s fix\u00e9es, la clause r\u00e9solutoire sera r\u00e9put\u00e9e ne pas avoir jou\u00e9&#187; (Motifs, 1\u00b0). Ce dispositif cr\u00e9e une p\u00e9riode probatoire pour les locataires. Il concilie la sanction du contrat et le soutien aux d\u00e9biteurs de bonne foi. La port\u00e9e est pratique, offrant une feuille de route claire pour le recouvrement et le maintien dans les lieux.<\/p>\n<p>Le juge pr\u00e9cise enfin les sanctions en cas de manquement aux conditions pos\u00e9es. Le non-respect d&#8217;un seul versement entra\u00eene l&#8217;effet imm\u00e9diat de la r\u00e9siliation constat\u00e9e. &#171;En cas de non respect des modalit\u00e9s de paiement ainsi accord\u00e9es, la clause r\u00e9solutoire produira tous ses effets, le bail sera r\u00e9sili\u00e9, l\u2019expulsion des locataires pourra \u00eatre mise en oeuvre&#187; (Motifs, 1\u00b0). Le juge condamne \u00e9galement par avance au paiement d&#8217;une indemnit\u00e9 d&#8217;occupation jusqu&#8217;\u00e0 la lib\u00e9ration des lieux. Cette indemnit\u00e9 est &#171;\u00e9gale au montant du loyer et des charges qui auraient \u00e9t\u00e9 dus si le bail avait continu\u00e9 \u00e0 courir&#187; (Motifs, 1\u00b0). Le dispositif est donc complet et ex\u00e9cutoire par provision. La valeur est d&#8217;assurer la s\u00e9curit\u00e9 juridique du bailleur tout en donnant une ultime chance aux locataires.
