Une salari\u00e9e, directrice d\u2019un spa, avait fait l\u2019objet d\u2019un avertissement puis d\u2019un licenciement pour faute grave. Elle contestait la r\u00e9gularit\u00e9 de la sanction disciplinaire, d\u00e9non\u00e7ait un manquement de l\u2019employeur \u00e0 son obligation de s\u00e9curit\u00e9 et demandait la nullit\u00e9 de son licenciement. La cour annule l\u2019avertissement, retient une ex\u00e9cution d\u00e9loyale du contrat, et prononce la nullit\u00e9 du licenciement avec r\u00e9int\u00e9gration et indemnit\u00e9 d\u2019\u00e9viction.<\/p>\n<p>I. Le contr\u00f4le strict des sanctions disciplinaires et des obligations de l\u2019employeur<\/p>\n<p><em>La sanction disciplinaire infond\u00e9e<\/em><br \/>\nL\u2019employeur avait reproch\u00e9 \u00e0 la salari\u00e9e une insuffisance de r\u00e9sultats et un d\u00e9faut d\u2019enregistrement de ventes. La cour constate l\u2019absence d\u2019\u00e9l\u00e9ments probants produits par l\u2019employeur pour \u00e9tayer ces griefs. Elle rappelle que l\u2019insuffisance professionnelle ne peut servir de motif \u00e0 une sanction disciplinaire. &#171;En l&#8217;absence d&#8217;\u00e9l\u00e9ments produits par l&#8217;employeur au soutien de ses all\u00e9gations, c&#8217;est \u00e0 bon escient que les premiers juges ont dit que les faits reproch\u00e9s \u00e0 la salari\u00e9e n&#8217;\u00e9taient pas \u00e9tablis&#187; (Motifs, 1\/). Cette solution r\u00e9affirme le principe de loyaut\u00e9 de la preuve et le b\u00e9n\u00e9fice du doute pour le salari\u00e9. Elle limite strictement le pouvoir disciplinaire de l\u2019employeur aux seuls manquements av\u00e9r\u00e9s.<\/p>\n<p><em>Le manquement \u00e0 l\u2019obligation de s\u00e9curit\u00e9<\/em><br \/>\nLa salari\u00e9e avait signal\u00e9 par \u00e9crit des faits de harc\u00e8lement moral et d\u00e9gradation de ses conditions de travail. La cour juge que l\u2019employeur n\u2019a pas pris les mesures n\u00e9cessaires suite \u00e0 ces alertes. &#171;\u00c0 d\u00e9faut d&#8217;\u00e9l\u00e9ments objectifs sur la teneur de cet entretien et d&#8217;investigations sur les faits r\u00e9v\u00e9l\u00e9s par la salari\u00e9e, il n&#8217;est justifi\u00e9 d&#8217;aucune mesure de nature \u00e0 pr\u00e9server la s\u00e9curit\u00e9 et la sant\u00e9&#187; (Motifs, 2\/). Ce manquement constitue une ex\u00e9cution d\u00e9loyale du contrat. La d\u00e9cision renforce l\u2019obligation de s\u00e9curit\u00e9 de r\u00e9sultat, imposant \u00e0 l\u2019employeur une r\u00e9action active et document\u00e9e face \u00e0 tout signalement.<\/p>\n<p>II. La nullit\u00e9 du licenciement : l\u2019absence de faute grave et la protection des alertes<\/p>\n<p><em>L\u2019absence de preuve d\u2019une faute grave<\/em><br \/>\nLe licenciement \u00e9tait fond\u00e9 sur une strat\u00e9gie de discr\u00e9dit et des propos mensongers attribu\u00e9s \u00e0 la salari\u00e9e. La cour exige de l\u2019employeur la preuve de la mauvaise foi. &#171;Il n&#8217;est pas \u00e9tabli par l&#8217;employeur que la salari\u00e9e connaissait la fausset\u00e9 de son propos lorsqu&#8217;elle l&#8217;a \u00e9nonc\u00e9 ou qu&#8217;elle a agi avec une extr\u00eame l\u00e9g\u00e8ret\u00e9 ou avec exc\u00e8s&#187; (Motifs, 3\/). Un simple t\u00e9moignage, \u00e9manant du successeur de l\u2019int\u00e9ress\u00e9e, est jug\u00e9 non probant. Cette analyse rejoint la jurisprudence exigeant pour la faute grave une violation rendant impossible le maintien dans l\u2019entreprise. &#171;La faute grave est celle qui r\u00e9sulte d&#8217;un fait ou d&#8217;un ensemble de faits imputables au salari\u00e9 qui constituent une violation des obligations r\u00e9sultant du contrat de travail ou des relations de travail d&#8217;une importance telle qu&#8217;elle rend impossible le maintien du salari\u00e9 dans l&#8217;entreprise&#187; (Motifs, 3\/).<\/p>\n<p><em>La protection de la d\u00e9nonciation de faits r\u00e9pr\u00e9hensibles<\/em><br \/>\nLe licenciement faisait explicitement r\u00e9f\u00e9rence \u00e0 la d\u00e9nonciation d\u2019un harc\u00e8lement moral. La cour \u00e9carte la qualification de lanceur d\u2019alerte pour d\u2019autres faits d\u00e9nonc\u00e9s, mais prot\u00e8ge la salari\u00e9e. Le fait que le signalement soit int\u00e9gr\u00e9 au motif de licenciement entra\u00eene la nullit\u00e9, sans qu\u2019il soit besoin de caract\u00e9riser une atteinte \u00e0 une libert\u00e9 fondamentale. Cette solution prot\u00e8ge les salari\u00e9s qui alertent leur employeur sur des situations susceptibles de porter atteinte \u00e0 leur sant\u00e9. Elle dissuade les licenciements r\u00e9torsifs et consacre un droit \u00e0 l\u2019alerte interne, distinct du r\u00e9gime du lanceur d\u2019alerte.<\/p>\n<p>La port\u00e9e de l\u2019arr\u00eat est significative en mati\u00e8re de preuve et de proc\u00e9dure disciplinaire. Il rappelle la charge probatoire stricte de l\u2019employeur et sanctionne son inaction face \u00e0 un signalement. En pronon\u00e7ant la nullit\u00e9 du licenciement pour d\u00e9faut de preuve de la mauvaise foi, il prot\u00e8ge les salari\u00e9s qui expriment des griefs, m\u00eame si ceux-ci sont ult\u00e9rieurement contest\u00e9s.
