La bailleuse sollicitait \u00e9galement l&#8217;expulsion du locataire et le versement de provisions. Le juge a accueilli l&#8217;ensemble des demandes en constatant la r\u00e9solution du bail et en ordonnant la lib\u00e9ration des lieux.<\/p>\n<p>La mise en \u0153uvre effective de la clause r\u00e9solutoire conventionnelle<\/p>\n<p>Le juge des r\u00e9f\u00e9r\u00e9s constate la r\u00e9siliation de plein droit du bail apr\u00e8s un commandement infructueux. Il rappelle le formalisme imp\u00e9ratif attach\u00e9 \u00e0 l&#8217;exercice de cette facult\u00e9 contractuelle. &#171;L&#8217;article L.145-41 du Code de commerce dispose que toute clause ins\u00e9r\u00e9e dans le bail pr\u00e9voyant la r\u00e9siliation de plein droit ne produit effet qu&#8217;un mois apr\u00e8s un commandement demeur\u00e9 infructueux&#187; (Motifs). La d\u00e9cision souligne ainsi la condition suspensive de d\u00e9lai, prot\u00e9geant le preneur contre une rupture brutale.<\/p>\n<p>La port\u00e9e de cette solution est de rappeler la soumission des baux commerciaux \u00e0 un r\u00e9gime imp\u00e9ratif. Le formalisme du commandement pr\u00e9alable constitue une garantie proc\u00e9durale essentielle pour le locataire. La clause r\u00e9solutoire ne peut donc s&#8217;exercer de mani\u00e8re automatique sans respecter ce d\u00e9lai de gr\u00e2ce l\u00e9gal.<\/p>\n<p>L&#8217;ordonnance valide ensuite l&#8217;application de la clause p\u00e9nale stipul\u00e9e au contrat. Le juge retient son caract\u00e8re non s\u00e9rieusement contestable en l&#8217;esp\u00e8ce. &#171;Le contrat pr\u00e9voit en page 7 qu&#8217;\u00e0 titre de clause p\u00e9nale, le preneur accepte enti\u00e8rement et d\u00e9finitivement d&#8217;avoir \u00e0 payer au bailleur une somme \u00e9gale \u00e0 10 % des sommes dues&#187; (Motifs). Cette stipulation est appliqu\u00e9e aux loyers \u00e9chus ainsi qu&#8217;\u00e0 l&#8217;indemnit\u00e9 d&#8217;occupation future.<\/p>\n<p>La valeur de cette analyse r\u00e9side dans le contr\u00f4le exerc\u00e9 par le juge sur les clauses p\u00e9nales. Bien que qualifi\u00e9e de non s\u00e9rieusement contestable, la clause est examin\u00e9e et son application est strictement calcul\u00e9e sur les sommes dues. Le r\u00e9f\u00e9r\u00e9 permet ainsi une sanction rapide du comportement d\u00e9faillant du locataire.<\/p>\n<p>Les pouvoirs du juge des r\u00e9f\u00e9r\u00e9s face \u00e0 l&#8217;inex\u00e9cution contractuelle<\/p>\n<p>La juridiction use de ses pouvoirs pour ordonner des mesures provisoires urgentes. Elle constate l&#8217;absence de contestation s\u00e9rieuse sur l&#8217;existence de la cr\u00e9ance locative. &#171;Dans les cas o\u00f9 l&#8217;existence de l&#8217;obligation n&#8217;est pas s\u00e9rieusement contestable, le Pr\u00e9sident du Tribunal judiciaire [&#8230;] peut accorder une provision au cr\u00e9ancier&#187; (Motifs, sur la demande de provisions). Le d\u00e9compte produit par la bailleuse est donc accept\u00e9 \u00e0 titre provisionnel.<\/p>\n<p>Le sens de cette d\u00e9marche est d&#8217;offrir une protection efficace au cr\u00e9ancier face \u00e0 un d\u00e9biteur d\u00e9faillant. Le r\u00e9f\u00e9r\u00e9 devient un instrument de sanction rapide de l&#8217;inex\u00e9cution, permettant une condamnation provisionnelle sans attendre l&#8217;issue d&#8217;une proc\u00e9dure au fond. L&#8217;urgence d\u00e9coule ici du pr\u00e9judice financier continu.<\/p>\n<p>Le juge ordonne \u00e9galement l&#8217;expulsion du locataire et fixe une indemnit\u00e9 d&#8217;occupation provisionnelle. Cette mesure est pr\u00e9sent\u00e9e comme une cons\u00e9quence n\u00e9cessaire de la r\u00e9siliation. &#171;Il y a lieu, de ce fait, d&#8217;ordonner la lib\u00e9ration des lieux [&#8230;] sous huit jours \u00e0 compter de la signification&#187; (Motifs). L&#8217;indemnit\u00e9 est calcul\u00e9e sur la base du loyer major\u00e9 de la clause p\u00e9nale.<\/p>\n<p>La port\u00e9e de ces mesures est de permettre une remise en \u00e9tat compl\u00e8te de la situation. Le juge des r\u00e9f\u00e9r\u00e9s assure ainsi l&#8217;effectivit\u00e9 de sa d\u00e9cision en pr\u00e9voyant l&#8217;ex\u00e9cution forc\u00e9e.
