La bailleuse a notifi\u00e9 un commandement de payer le 25 novembre 2024, accordant un d\u00e9lai de deux mois. La locataire n\u2019ayant pas apur\u00e9 sa dette dans ce d\u00e9lai, la clause r\u00e9solutoire est r\u00e9put\u00e9e acquise depuis le 26 janvier 2025. Le juge constate la r\u00e9siliation mais, face \u00e0 la volont\u00e9 de la locataire de r\u00e9gulariser sa situation et \u00e0 l\u2019accord des parties, suspend ses effets et accorde des d\u00e9lais de paiement. La d\u00e9cision articule ainsi l\u2019application du droit commun des clauses r\u00e9solutoires avec les pouvoirs d\u2019am\u00e9nagement du juge.<\/p>\n<p>Le principe de non-r\u00e9troactivit\u00e9 de la loi nouvelle<\/p>\n<p>Le juge rappelle d\u2019abord le r\u00e9gime l\u00e9gal des clauses r\u00e9solutoires en mati\u00e8re de bail d\u2019habitation. Il souligne que la loi du 6 juillet 1989 impose une telle clause pour d\u00e9faut de paiement, dont l\u2019effet est subordonn\u00e9 \u00e0 un commandement de payer demeur\u00e9 infructueux. La d\u00e9cision pr\u00e9cise que le d\u00e9lai l\u00e9gal \u00e9tait de deux mois pour les contrats conclus avant la r\u00e9forme du 27 juillet 2023. &#171;La loi du 27 juillet 2023 ne comprend aucune disposition d\u00e9rogeant \u00e0 l&#8217;article 2 du code civil, selon lequel la loi ne dispose que pour l&#8217;avenir et n&#8217;a point d&#8217;effet r\u00e9troactif&#187; (Motifs, Sur la r\u00e9siliation du bail). Le juge en d\u00e9duit qu\u2019il n\u2019y a pas lieu d\u2019appliquer le nouveau d\u00e9lai de six semaines au bail litigieux, conclu ant\u00e9rieurement. Ce raisonnement confirme une application stricte du principe de non-r\u00e9troactivit\u00e9, prot\u00e9geant la s\u00e9curit\u00e9 juridique des conventions en cours. Il rejoint la solution d\u00e9gag\u00e9e par le Tribunal judiciaire de Nantes, le 3 juillet 2025, qui a jug\u00e9 que le d\u00e9lai de six semaines &#171;ne s\u2019applique en r\u00e9alit\u00e9 pas imm\u00e9diatement aux contrats en cours&#187; (Tribunal judiciaire de Nantes, le 3 juillet 2025, n\u00b025\/00814). La port\u00e9e de ce point est essentielle pour les praticiens, qui doivent v\u00e9rifier la date de conclusion du bail pour d\u00e9terminer le d\u00e9lai applicable au commandement de payer.<\/p>\n<p>La suspension conditionnelle des effets de la clause r\u00e9solutoire<\/p>\n<p>La d\u00e9cision op\u00e8re ensuite un revirement pragmatique en am\u00e9nageant les cons\u00e9quences de la r\u00e9siliation. Constatant que les conditions de la clause sont r\u00e9unies, le juge use de son pouvoir d\u2019octroyer des d\u00e9lais de paiement pr\u00e9vu par l\u2019article 24 de la loi de 1989. Il suspend les effets de la r\u00e9siliation pendant l\u2019ex\u00e9cution d\u2019un plan d\u2019apurement de trente-six mois. &#171;Si le locataire se lib\u00e8re de sa dette locative dans le d\u00e9lai et selon les modalit\u00e9s fix\u00e9s par le juge, la clause de r\u00e9siliation de plein droit est r\u00e9put\u00e9e ne pas avoir jou\u00e9&#187; (Motifs, Sur la r\u00e9siliation du bail). Ce pouvoir de suspension, exerc\u00e9 d\u2019office avec l\u2019accord des parties, att\u00e9nue le caract\u00e8re automatique de la clause. Il illustre la fonction conciliatrice du juge des contentieux de la protection, qui privil\u00e9gie le maintien dans les lieux lorsque le rattrapage de la dette est possible. Cette approche trouve un \u00e9cho dans la jurisprudence du Tribunal judiciaire de Cr\u00e9teil, lequel a rappel\u00e9 que &#171;la clause r\u00e9solutoire ne joue pas, si le locataire se lib\u00e8re dans les conditions fix\u00e9es par le juge&#187; (Tribunal judiciaire de Cr\u00e9teil, le 18 d\u00e9cembre 2025, n\u00b025\/00779). La valeur de cette solution r\u00e9side dans son \u00e9quilibre entre la sanction de l\u2019inex\u00e9cution et la pr\u00e9servation du lien contractuel.<\/p>\n<p>Le r\u00e9gime dissuasif du plan d\u2019apurement et ses sanctions<\/p>\n<p>Le juge organise enfin un dispositif incitatif et s\u00e9curis\u00e9 pour l\u2019ex\u00e9cution du plan. Les modalit\u00e9s de paiement sont pr\u00e9cis\u00e9es, avec une premi\u00e8re \u00e9ch\u00e9ance dans les dix jours suivant la signification du jugement. Le m\u00e9canisme de sanction est d\u00e9taill\u00e9 avec rigueur : tout d\u00e9faut de paiement entra\u00eene la r\u00e9siliation de plein droit r\u00e9troactive au 26 janvier 2025. &#171;Pour le cas o\u00f9 une mensualit\u00e9 [&#8230;] resterait impay\u00e9e quinze jours apr\u00e8s l&#8217;envoi d&#8217;une mise en demeure [&#8230;] le bail sera consid\u00e9r\u00e9 comme r\u00e9sili\u00e9 de plein droit depuis le 26 janvier 2025&#187; (Par ces motifs). La d\u00e9cision pr\u00e9voit alors l\u2019exigibilit\u00e9 imm\u00e9diate du solde, une indemnit\u00e9 d\u2019occupation, et une proc\u00e9dure d\u2019expulsion simplifi\u00e9e. Ce cadre juridique stricte donne une force ex\u00e9cutoire imm\u00e9diate au jugement tout en offrant une ultime chance \u00e0 la locataire. Il s\u00e9curise la position de la bailleuse, qui n\u2019aura pas \u00e0 engager une nouvelle action en justice en cas de nouvel impay\u00e9.
