L&#8217;acqu\u00e9reur d&#8217;un lot de copropri\u00e9t\u00e9 assigne son vendeur en r\u00e9paration de d\u00e9sordres affectant le bien. Ces d\u00e9sordres, r\u00e9v\u00e9l\u00e9s par une expertise, trouvent leur origine dans des travaux de r\u00e9novation ex\u00e9cut\u00e9s par le vendeur lui-m\u00eame. Le tribunal accueille la demande et condamne le vendeur \u00e0 une r\u00e9duction du prix ainsi qu&#8217;au paiement de frais irr\u00e9p\u00e9tibles. La solution repose sur l&#8217;assimilation du vendeur particulier \u00e0 un professionnel, l&#8217;\u00e9cartant du b\u00e9n\u00e9fice d&#8217;une clause d&#8217;exclusion de garantie.<\/p>\n<p>L&#8217;assimilation du vendeur \u00e0 un professionnel<\/p>\n<p>Le juge retient que l&#8217;auteur des travaux est pr\u00e9sum\u00e9 conna\u00eetre les vices. La d\u00e9cision op\u00e8re une assimilation du vendeur particulier \u00e0 un professionnel de la construction. Cette qualification d\u00e9coule directement de son intervention personnelle sur la structure du bien. &#171;Monsieur [S] [U] doit \u00eatre assimil\u00e9 \u00e0 un professionnel en ce qu\u2019il a effectu\u00e9 lui-m\u00eame, assist\u00e9 de sa famille, les travaux \u00e0 l\u2019origine des d\u00e9sordres&#187; (Motifs). Cette pr\u00e9somption de connaissance a pour effet de le priver du b\u00e9n\u00e9fice de la clause de non-garantie stipul\u00e9e dans l&#8217;acte. La mauvaise foi est ainsi d\u00e9duite de son comportement actif en tant qu&#8217;auteur des travaux d\u00e9fectueux.<\/p>\n<p>Cette analyse trouve un \u00e9cho dans la jurisprudence de la Cour de cassation. Celle-ci a en effet censur\u00e9 une cour d&#8217;appel pour n&#8217;avoir pas recherch\u00e9 &#171;si la SCI avait elle-m\u00eame r\u00e9alis\u00e9 les travaux \u00e0 l&#8217;origine des d\u00e9sordres affectant le bien vendu, peu important les changements survenus quant \u00e0 l&#8217;identit\u00e9 de ses associ\u00e9s et g\u00e9rants, de sorte qu&#8217;elle s&#8217;\u00e9tait comport\u00e9e en constructeur et devait \u00eatre pr\u00e9sum\u00e9e avoir connaissance du vice&#187; (Cass. Troisi\u00e8me chambre civile, le 19 octobre 2023, n\u00b022-15.536). Le pr\u00e9sent jugement applique rigoureusement ce principe en l&#8217;\u00e9tendant \u00e0 un vendeur personne physique. La port\u00e9e est significative car elle neutralise les clauses exon\u00e9ratoires pour tout vendeur s&#8217;\u00e9tant comport\u00e9 en constructeur.<\/p>\n<p>La preuve du vice et de son origine exclusive<\/p>\n<p>La caract\u00e9risation du vice cach\u00e9 est solidement \u00e9tay\u00e9e par le rapport d&#8217;expertise. Le juge rel\u00e8ve que les d\u00e9sordres sont \u00e9volutifs et d&#8217;une certaine gravit\u00e9, affectant l&#8217;usage du bien. L&#8217;expert a \u00e9tabli un lien de causalit\u00e9 certain et exclusif avec les travaux du vendeur. &#171;Il ressort du rapport d\u2019expertise judiciaire que les d\u00e9sordres, ci-dessus \u00e9nonc\u00e9s, ont pour origine exclusive les travaux r\u00e9alis\u00e9s par Monsieur [S] [U]&#187; (Motifs). Le tribunal rejette les causes alternatives avanc\u00e9es par la d\u00e9fense, comme les vibrations ferroviaires ou des travaux tiers. La charge de la preuve pesant sur l&#8217;acqu\u00e9reur est ainsi satisfaite de mani\u00e8re probante.<\/p>\n<p>Le raisonnement souligne l&#8217;importance d&#8217;une expertise judiciaire contradictoire et motiv\u00e9e. Face \u00e0 des d\u00e9sordres techniques complexes, le juge s&#8217;appuie sur les constatations et conclusions de l&#8217;expert pour fonder sa conviction. Il \u00e9carte les simples affirmations du vendeur qui ne sont \u00e9tay\u00e9es par aucun \u00e9l\u00e9ment objectif. Cette approche consacre l&#8217;autorit\u00e9 de l&#8217;expertise lorsqu&#8217;elle d\u00e9montre une origine exclusive et une violation des r\u00e8gles de l&#8217;art. Elle permet \u00e9galement l&#8217;allocation de dommages-int\u00e9r\u00eats compl\u00e9mentaires. &#171;La mauvaise foi de Monsieur [S] [U] ayant \u00e9t\u00e9 retenue, Madame [Y] [N] est \u00e9galement bien fond\u00e9e \u00e0 solliciter l\u2019indemnisation du relogement indispensable&#187; (Motifs). La r\u00e9paration couvre ainsi tous les chefs de pr\u00e9judice directs.<\/p>\n<p>Cette solution est conforme aux articles 1644 et 1645 du code civil, l&#8217;acqu\u00e9reur ayant choisi de garder le bien. Le juge valide la m\u00e9thode d&#8217;\u00e9valuation bas\u00e9e sur le devis de r\u00e9paration, sans remise en cause de son montant. La d\u00e9cision illustre les cons\u00e9quences p\u00e9cuniaires lourdes d&#8217;une telle action pour le vendeur de mauvaise foi. La port\u00e9e pratique est d&#8217;inciter \u00e0 la prudence tout vendeur ayant r\u00e9alis\u00e9 des travaux sur son bien.
