Le premier sollicite la r\u00e9siliation du bail pour impay\u00e9s et le second demande des d\u00e9lais ainsi que des dommages-int\u00e9r\u00eats pour infestation de punaises de lit. La juridiction confirme la r\u00e9siliation du bail et rejette les demandes de d\u00e9lais. Elle accorde une indemnisation partielle au locataire pour trouble de jouissance tout en le condamnant aux d\u00e9pens.<\/p>\n<p>La rigueur proc\u00e9durale et l&#8217;effet automatique de la clause r\u00e9solutoire<\/p>\n<p>Le respect des principes directeurs du proc\u00e8s est strictement contr\u00f4l\u00e9. La cour \u00e9carte des conclusions d\u00e9pos\u00e9es \u00e0 la cl\u00f4ture des d\u00e9bats, estimant qu&#8217;elles ont mis la partie adverse &#171;dans l&#8217;impossibilit\u00e9 de disposer d&#8217;un d\u00e9lai suffisant pour lui r\u00e9pondre dans le respect du principe du contradictoire&#187;. Cette application stricte de l&#8217;article 16 du code de proc\u00e9dure civile souligne l&#8217;importance d&#8217;un d\u00e9bat loyal. Sur le fond, la cour constate l&#8217;acquisition de la clause r\u00e9solutoire du bail. Elle rappelle que &#171;tous arguments relatifs \u00e0 sa bonne ou mauvaise foi ou \u00e0 des efforts de paiement post\u00e9rieurs \u00e9tant \u00e0 cet \u00e9gard sans emport sur les effets automatiques de la clause r\u00e9solutoire&#187;. Cette solution affirme le caract\u00e8re automatique de la r\u00e9solution d\u00e8s la condition suspensive r\u00e9alis\u00e9e, \u00e9cartant toute appr\u00e9ciation souveraine des juges du fond sur le comportement du d\u00e9biteur.<\/p>\n<p>L&#8217;\u00e9quilibre des obligations locatives et la r\u00e9paration des pr\u00e9judices<\/p>\n<p>La cour op\u00e8re une analyse distincte des obligations respectives des parties. Concernant la dette locative, elle refuse d&#8217;accorder des d\u00e9lais de paiement au locataire. Elle motive ce refus par &#171;l&#8217;anciennet\u00e9 de la dette&#187; et &#171;l&#8217;absence de preuve d&#8217;efforts d&#8217;apurement&#187; malgr\u00e9 la reprise d&#8217;un emploi. Cette appr\u00e9ciation restrictive des conditions de l&#8217;article 24 de la loi de 1989 prot\u00e8ge les int\u00e9r\u00eats du bailleur face \u00e0 une dette persistante. En revanche, la cour retient la responsabilit\u00e9 du bailleur pour trouble de jouissance li\u00e9 aux punaises de lit. Elle juge \u00e9tablie la pr\u00e9sence des insectes et rel\u00e8ve que &#171;le bailleur ne d\u00e9montrant pas avoir fait passer ni m\u00eame missionn\u00e9 une soci\u00e9t\u00e9 le 18 septembre 2023 [&#8230;] il ne saurait faire grief au preneur d&#8217;avoir fait diligenter une intervention en urgence&#187;. La responsabilit\u00e9 de plein droit du bailleur est ainsi affirm\u00e9e, sauf preuve d&#8217;une faute du locataire ou d&#8217;un cas de force majeure.<\/p>\n<p>La port\u00e9e de cette indemnisation est toutefois limit\u00e9e par la date de r\u00e9siliation du bail. La cour d\u00e9cide que &#171;l&#8217;obligation du bailleur de d\u00e9livrer un logement d\u00e9cent a pris fin&#187; \u00e0 la date d&#8217;acquisition de la clause r\u00e9solutoire. L&#8217;indemnisation est donc circonscrite aux troubles survenus avant cette date, r\u00e9duisant significativement le pr\u00e9judice allou\u00e9. Enfin, la cour rejette la demande de dommages-int\u00e9r\u00eats du bailleur, estimant que les frais de traitement des parties communes lui incombent naturellement et qu&#8217;aucun pr\u00e9judice distinct n&#8217;est justifi\u00e9.
