Le bailleur demandait la r\u00e9siliation du bail pour impay\u00e9s et le paiement des sommes dues. Le locataire \u00e9tait en proc\u00e9dure de surendettement. Le juge a constat\u00e9 la r\u00e9siliation tout en suspendant ses effets et en accordant des d\u00e9lais de paiement. Cette solution illustre l&#8217;articulation complexe entre le droit des baux et la protection des locataires en difficult\u00e9.<\/p>\n<p>La mise en \u0153uvre contr\u00f4l\u00e9e de la clause r\u00e9solutoire<\/p>\n<p>Le juge v\u00e9rifie scrupuleusement les conditions de l&#8217;expulsion. La clause r\u00e9solutoire pour d\u00e9faut de paiement ne produit effet que sous conditions l\u00e9gales strictes. Le bailleur doit d\u00e9montrer l&#8217;existence d&#8217;un commandement de payer demeur\u00e9 infructueux pendant deux mois. En l&#8217;esp\u00e8ce, le bailleur a produit le commandement d\u00e9livr\u00e9 le 16 ao\u00fbt 2024. Le locataire n&#8217;ayant pas r\u00e9gl\u00e9 dans le d\u00e9lai, le juge constate que &#171;les conditions d&#8217;acquisition de la clause r\u00e9solutoire sont r\u00e9unies au 17 octobre 2024&#187;. Cette application rigoureuse prot\u00e8ge le locataire contre une expulsion trop rapide. Elle rejoint la jurisprudence exigeant un commandement pr\u00e9alable demeur\u00e9 sans effet. &#171;toute clause pr\u00e9voyant la r\u00e9siliation de plein droit du contrat de location pour d\u00e9faut de paiement du loyer ou des charges aux termes convenus ou pour non-versement du d\u00e9p\u00f4t de garantie ne produit effet que deux mois apr\u00e8s un commandement de payer demeur\u00e9 infructueux&#187; (Tribunal judiciaire de Tours, le 5 juin 2025, n\u00b024\/04922). La d\u00e9cision rappelle ainsi le formalisme protecteur impos\u00e9 au bailleur.<\/p>\n<p>Le juge proc\u00e8de ensuite \u00e0 un contr\u00f4le approfondi de la cr\u00e9ance locative. Le juge v\u00e9rifie d&#8217;office la r\u00e9gularit\u00e9 du d\u00e9compte produit par le bailleur. Il \u00e9carte les frais d&#8217;huissier du calcul de la dette locative proprement dite. Il retranche \u00e9galement des sommes insuffisamment justifi\u00e9es, comme des frais de dossier. Le juge rel\u00e8ve aussi une imputation irr\u00e9guli\u00e8re pour d\u00e9faut d&#8217;assurance. Il note que le bailleur a d\u00e9duit une somme mensuelle &#171;sans justifier de la souscription d\u2019un contrat d\u2019assurance par le bailleur pour compte de locataire non assur\u00e9&#187;. Ce contr\u00f4le actif permet de d\u00e9terminer le montant exact de la dette. Il garantit que seules les sommes l\u00e9gitimement dues peuvent fonder l&#8217;expulsion. Ce pouvoir d&#8217;office du juge, pr\u00e9vu par la loi, constitue une sauvegarde essentielle pour le locataire.<\/p>\n<p>L&#8217;am\u00e9nagement judiciaire au b\u00e9n\u00e9fice du locataire en difficult\u00e9<\/p>\n<p>La situation de surendettement du locataire conduit \u00e0 un r\u00e9am\u00e9nagement des d\u00e9lais. Le juge applique le r\u00e9gime d\u00e9rogatoire de l&#8217;article 24 VI de la loi de 1989. Ce texte s&#8217;applique lorsque le locataire fait l&#8217;objet d&#8217;une proc\u00e9dure de surendettement. Il impose au juge d&#8217;accorder des d\u00e9lais de paiement si le locataire a repris les paiements courants. En l&#8217;esp\u00e8ce, une d\u00e9cision de recevabilit\u00e9 a \u00e9t\u00e9 rendue par la commission. Le juge constate que &#171;Monsieur [K] [V] a repris les paiements avant l\u2019audience&#187;. Il en tire la cons\u00e9quence l\u00e9gale de suspendre les effets de la clause r\u00e9solutoire. Cette suspension \u00e9vite une expulsion imm\u00e9diate malgr\u00e9 la r\u00e9siliation constat\u00e9e. Elle traduit la volont\u00e9 du l\u00e9gislateur de pr\u00e9server le logement en cas de difficult\u00e9s financi\u00e8res av\u00e9r\u00e9es.<\/p>\n<p>Le juge organise un plan de paiement strictement encadr\u00e9 et conditionnel. L&#8217;autorisation de payer en mensualit\u00e9s est subordonn\u00e9e au respect scrupuleux des termes fix\u00e9s. Le juge pr\u00e9cise que les mensualit\u00e9s doivent \u00eatre pay\u00e9es &#171;en sus du loyer courant et en m\u00eame temps que lui&#187;. Il assortit sa d\u00e9cision de conditions suspensives rigoureuses pour le locataire. &#171;faute pour le locataire de respecter les modalit\u00e9s de paiement ainsi accord\u00e9s, le solde de l\u2019arri\u00e9r\u00e9 deviendra imm\u00e9diatement exigible et la clause r\u00e9solutoire reprendra son plein effet&#187;. Ce dispositif \u00e9quilibre la protection du locataire et les droits du bailleur. Il offre une chance de se maintenir dans les lieux tout en s\u00e9curisant le cr\u00e9ancier.
