Le juge a condamn\u00e9 ce dernier au paiement provisionnel d\u2019un arri\u00e9r\u00e9 locatif et a ordonn\u00e9 l\u2019ex\u00e9cution provisoire de sa d\u00e9cision. Cette ordonnance illustre les conditions d\u2019octroi d\u2019une provision en r\u00e9f\u00e9r\u00e9 et le r\u00e9gime de son ex\u00e9cution imm\u00e9diate.<\/p>\n<p>Le r\u00e9gime probatoire all\u00e9g\u00e9 du r\u00e9f\u00e9r\u00e9-provision<\/p>\n<p>Le juge des r\u00e9f\u00e9r\u00e9s exige une obligation non s\u00e9rieusement contestable. Le cr\u00e9ancier doit produire des \u00e9l\u00e9ments objectifs \u00e9tablissant la cr\u00e9ance. En l\u2019esp\u00e8ce, le bailleur a produit un d\u00e9compte d\u00e9taill\u00e9 de l\u2019arri\u00e9r\u00e9. &#171;La S.A. HLM MON LOGIS produit un d\u00e9compte d\u00e9montrant que l&#8217;arri\u00e9r\u00e9 locatif s&#8217;\u00e9l\u00e8ve, apr\u00e8s soustraction des frais de poursuite, \u00e0 la somme de 4025,55 \u20ac&#187; (Motifs, Sur les demandes de condamnation au paiement). Cette production documentaire objective r\u00e9pond \u00e0 l\u2019exigence probatoire. Le d\u00e9biteur, quant \u00e0 lui, doit contester s\u00e9rieusement le principe ou le montant de la dette. L\u2019absence de contestation du locataire est ici d\u00e9terminante. &#171;Le locataire ne verse aucun \u00e9l\u00e9ment de nature \u00e0 contester le principe ou le montant de cette dette&#187; (Motifs, Sur les demandes de condamnation au paiement). Cette carence permet au juge de constater le caract\u00e8re non s\u00e9rieusement contestable de l\u2019obligation. La jurisprudence confirme cette approche en mati\u00e8re locative. &#171;Le paiement des loyers et charges aux termes convenus dans le contrat de location constitue une obligation essentielle du locataire&#187; (Tribunal judiciaire de Toulouse, le 28 ao\u00fbt 2025, n\u00b025\/01018). La provision est ainsi accord\u00e9e sur la base d\u2019une pr\u00e9somption de validit\u00e9 de la cr\u00e9ance, justifi\u00e9e par la nature de l\u2019obligation et le d\u00e9faut de d\u00e9fense s\u00e9rieuse.<\/p>\n<p>L\u2019ex\u00e9cution provisoire de droit en mati\u00e8re de provision<\/p>\n<p>La d\u00e9cision b\u00e9n\u00e9ficie automatiquement de l\u2019ex\u00e9cution provisoire. Le dispositif rappelle ce principe. &#171;RAPPELONS que la pr\u00e9sente ordonnance est de plein droit ex\u00e9cutoire \u00e0 titre provisoire&#187; (Dispositif). Ce r\u00e9gime est imp\u00e9ratif pour les ordonnances de r\u00e9f\u00e9r\u00e9 accordant une provision. La jurisprudence rappelle cette r\u00e8gle proc\u00e9durale. &#171;Par exception, le juge ne peut \u00e9carter l\u2019ex\u00e9cution provisoire de droit lorsqu\u2019il statue en r\u00e9f\u00e9r\u00e9, qu\u2019il prescrit des mesures provisoires pour le cours de l\u2019instance, qu\u2019il ordonne des mesures conservatoires ainsi que lorsqu\u2019il accorde une provision au cr\u00e9ancier&#187; (Tribunal judiciaire de Foix, le 21 octobre 2025, n\u00b025\/00095). L\u2019ex\u00e9cution imm\u00e9diate est donc la contrepartie n\u00e9cessaire de la proc\u00e9dure acc\u00e9l\u00e9r\u00e9e. Elle garantit l\u2019efficacit\u00e9 de la mesure provisoire en \u00e9vitant tout d\u00e9lai suppl\u00e9mentaire. Le juge n\u2019a ainsi aucun pouvoir discr\u00e9tionnaire pour \u00e9carter ce m\u00e9canisme dans ce contexte. Cette automaticit\u00e9 assure une protection efficace des int\u00e9r\u00eats du cr\u00e9ancier, dont la cr\u00e9ance est jug\u00e9e suffisamment \u00e9tablie.
